    Avand in vedere prevederile art. 34 din Ordonanta de urgenta a Guvernului nr. 97/2001 privind reglementarea productiei, circulatiei si comercializarii alimentelor, aprobata si modificata prin Legea nr. 57/2002,
    in temeiul prevederilor Hotararii Guvernului nr. 409/2004 privind organizarea si functionarea Ministerului Agriculturii, Padurilor si Dezvoltarii Rurale, ale Hotararii Guvernului nr. 743/2003 privind organizarea si functionarea Ministerului Sanatatii, cu modificarile si completarile ulterioare, precum si ale Hotararii Guvernului nr. 755/2003 privind organizarea si functionarea Autoritatii Nationale pentru Protectia Consumatorilor,

    ministrul agriculturii, padurilor si dezvoltarii rurale, ministrul sanatatii si presedintele Autoritatii Nationale pentru Protectia Consumatorilor emit urmatorul ordin:

    Art. 1
    Se aproba Norma cu privire la natura, continutul, fabricarea, calitatea, ambalarea, etichetarea, marcarea, depozitarea si transportul morcovilor in conserva, prevazute in anexa care face parte integranta din prezentul ordin.
    Art. 2
    Ministerul Agriculturii, Padurilor si Dezvoltarii Rurale, Ministerul Sanatatii si Autoritatea Nationala pentru Protectia Consumatorilor, prin directiile pentru agricultura si dezvoltare rurala judetene si a municipiului Bucuresti, prin directiile de sanatate publica judetene si a municipiului Bucuresti si prin oficiile pentru protectia consumatorilor judetene si a municipiului Bucuresti, vor duce la indeplinire prevederile prezentului ordin.
    Art. 3
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I, si va intra in vigoare in termen de 12 luni de la data publicarii.

    ANEXA 1

                                NORMA
cu privire la natura, continutul, fabricarea, calitatea, ambalarea, etichetarea, marcarea, depozitarea si transportul morcovilor in conserva

    CAP. 1
    Dispozitii generale

    Art. 1
    Prezenta norma prevede cerintele minime de siguranta alimentara, igiena alimentara, calitate si identificare a produsului, care trebuie respectate la fabricarea si/sau comercializarea morcovilor in conserva pe teritoriul Romaniei, pentru a putea garanta ca acestia nu prezinta nici un risc pentru consumul uman si sunt prezentati corect, conform principiilor de baza privind protectia consumatorului.
    Art. 2
    Reglementarile prezentei norme nu se aplica morcovilor in conserva preparati in gospodarii individuale pentru consumul propriu si nici produselor care sunt in tranzit sau care sunt depozitate temporar, ca bunuri care tranziteaza tara, daca nu prezinta un pericol pentru sanatatea umana sau pentru mediu.
    Art. 3
    Prezenta norma nu se aplica produselor fabricate si/sau comercializate in mod legal intr-un stat membru al Uniunii Europene sau in Turcia ori care sunt fabricate in mod legal intr-un stat semnatar al acordului privind Spatiul Economic European, cu conditia ca cerintele aplicabile acestor produse in statul respectiv sa asigure un nivel de protectie echivalent cu cel prevazut in prezenta norma.

    CAP. 2
    Natura. Continut

    Art. 4
    Morcovi in conserva este denumirea de produs finit, fabricat in scopul vanzarii, data in general alimentelor preparate din morcovi din soiurile de cultura ale speciei Daucus carota L., conservati in apa sau alt mediu lichid in care se pot adauga diferite ingrediente sau in vid, introdusi in ambalaje care se inchid ermetic, supusi unui tratament termic, inainte sau dupa introducerea lor in ambalaj, pentru a impiedica alterarea lor.
    Art. 5
    Denumirea fiecarui produs trebuie sa indice corect natura alimentului si pentru aceasta trebuie sa includa cel putin urmatoarele informatii:
    a) denumirea materiei prime: "Morcovi";
    b) denumirea formei de prezentare: "Intregi", "Taiati", "Sferturi" etc., conform specificatiilor din anexa nr. 1;
    c) descrierea mediului fluid in care sunt conservati, de exemplu "In X", "Cu X": "In sos de margarina", "Cu (sau In) sos de unt etc.;
    d) daca produsul este conservat in vid, se mentioneaza aceasta in denumire: "Ambalat sub vid".

    CAP. 3
    Fabricare

    Art. 6
    Alimentul "Morcovi in conserva", definit si descris in prezenta norma, trebuie sa fie sanatos, salubru, corespunzator pentru consumul uman, preparat din materii prime si auxiliare sanatoase, fabricat si ambalat in conditii de igiena impuse de reglementarile in vigoare.
    Art. 7
    Materia prima folosita la fabricarea morcovilor in conserva, definita si descrisa in anexa nr. 1, trebuie sa indeplineasca cerintele de calitate si siguranta alimentara pentru legume si fructe proaspete, prevazute de reglementarile in vigoare.
    Art. 8
    Morcovii pot fi conservati:
    a) in mediu lichid, cand ambalarea se face la presiune atmosferica, iar cantitatea de lichid corespunde cerintelor privind dozarea produsului in ambalaj, asa cum sunt prevazute in anexa nr. 4; sau
    b) in vid, atunci cand ambalarea se face sub vid, iar mediul lichid din ambalaj nu depaseste 20% (m/m) din masa neta a produsului.
    Art. 9
    Ingredientele utilizate la fabricarea morcovilor in conserva trebuie sa indeplineasca cerintele specificate in anexa nr. 2, sa corespunda reglementarilor in vigoare si sa nu depaseasca limitele maxim admise.
    Art. 10
    Spatiile in care se fabrica morcovii in conserva, incluzand aici instalatiile si echipamentele aferente, trebuie sa indeplineasca cerintele de igiena alimentara, iar personalul trebuie sa indeplineasca cerintele de sanatate si calificare stabilite prin reglementarile in vigoare.

    CAP. 4
    Calitate. Siguranta alimentara

    Art. 11
    Produsul finit "Morcovi in conserva" trebuie sa indeplineasca cerintele organoleptice si fizico-chimice prevazute in anexa nr. 3, respectiv in anexa nr. 4. Produsele care nu indeplinesc aceste cerinte nu pot fi denumite si descrise conform prevederilor prezentei norme.
    Art. 12
    Prezenta in produsul finit a microorganismelor, parazitilor si substantelor generate de microorganisme trebuie sa nu depaseasca limitele maxim admise prevazute de reglementarile in vigoare.
    Art. 13
    Se interzic fabricarea si comercializarea morcovilor in conserva care contin cantitati de contaminanti si reziduuri pesticide peste limitele maxime admise prevazute prin reglementarile in vigoare.

    CAP. 5
    Ambalare, etichetare, marcare, depozitare si transport

    Art. 14
    Ambalajele care intra in contact cu alimentele definite prin prezenta norma trebuie sa fie confectionate din materiale care indeplinesc cerintele prevazute de reglementarile in vigoare.
    Art. 15
    Ambalajele de transport trebuie sa asigure integritatea produselor, sa fie curate, uscate si in stare buna. Aceste ambalaje pot fi confectionate din lemn, carton, folie termocontractila sau alte materiale care trebuie sa corespunda reglementarilor in vigoare.
    Art. 16
    Etichetarea si marcarea produselor definite prin prezenta norma trebuie sa se faca cu respectarea reglementarilor in vigoare privind etichetarea alimentelor, inscrierea tuturor informatiilor necesare, astfel incat consumatorul sa fie informat corect la momentul cumpararii, si trebuie sa contina cel putin urmatoarele informatii:
    1. denumirea sub care este vandut alimentul, conform art. 4;
    2. cantitatea neta;
    3. cantitatea neta fara lichid;
    4. lista ingredientelor;
    5. conditiile de depozitare, conform art. 18;
    6. data durabilitatii minimale se inscrie sub forma "A se consuma, de preferinta, inainte de ...", cu mentionarea lunii si anului;
    7. o mentiune care sa permita identificarea lotului (aceasta mentiune nu este obligatorie in cazul in care data durabilitatii minimale este indicata prin mentionarea clara si necodificata cel putin a zilei si lunii, in aceasta ordine);
    8. numele si adresa producatorului sau ale ambalatorului ori ale distribuitorului sau ale importatorului produsului;
    9. tara de origine a produsului.
    Art. 17
    Pentru morcovii in conserva care se comercializeaza pe teritoriul Romaniei, informatiile de pe etichete trebuie sa fie inscrise in limba romana, indiferent de tara producatoare, fara a exclude insa prezentarea lor in alte limbi.
    Art. 18
    Depozitarea produselor definite prin prezenta norma trebuie sa se faca in incaperi curate, aerisite, ferite de razele solare sau de inghet, la o temperatura de maximum 20 grade C si umiditate relativa a aerului de maximum 80% .
    Art. 19
    Transportul produselor definite prin prezenta norma trebuie sa se faca cu vehicule curate, acoperite, in conditii care sa asigure integritatea ambalajelor si mentinerea calitatii produselor, precum si protectia contra razelor solare sau a inghetului.
    Art. 20
    Fiecare transport de morcovi in conserva trebuie sa fie insotit de documente care sa ateste originea, provenienta si securitatea alimentara.

    CAP. 6
    Dispozitii finale

    Art. 21
    Anexele nr. 1 - 4 fac parte integranta din prezenta norma.

    ANEXA 1
    la norma

                     MATERIA PRIMA. DEFINITII SI DESCRIERE

    (1) Morcovii trebuie sa fie intregi, sanatosi, cu aspect proaspat, neramificati, netezi, curati, fara lovituri mecanice, netrecuti in tija florala, nelemnificati, necrapati, fara gust si/sau miros strain.
    (2) Nu sunt restrictii cu privire la soiul utilizat.
    (3) Inainte de conservare morcovii trebuie bine spalati, depelati, trebuie indepartate frunzele si coletul.
    (4) Morcovii in conserva se pot fabrica in urmatoarea gama sortimentala:
    a) intregi:
    - soiuri de morcovi conici sau cilindrici (de exemplu: Chantenay si Amsterdam) cu diametrul maxim de 50 mm (raportul dintre diametrul celui mai mare si celui mai mic morcov trebuie sa fie maximum 3:1;
    - soiuri de morcovi sferici ("morcovi de Paris") cu diametrul maxim de 45 mm;
    b) "baby whole" intregi:
    - soiuri de "morcovi tineri" sferici cu diametrul maxim de 18 mm;
    - soiuri de "morcovi tineri" conici sau cilindrici, avand diametrul si lungimea maxime de 23 mm si, respectiv, 100 mm;
    c) jumatati - morcovi taiati in doua parti aproximativ egale, de-a lungul axei longitudinale;
    d) sferturi - morcovi taiati in patru parti aproximativ egale;
    e) taiati longitudinal - morcovi taiati longitudinal (sub forma neteda sau ondulata) in patru bucati sau mai mult, de dimensiuni aproximativ egale de 20 mm;
    f) rondele - morcovi taiati rondele cu diametrul si grosimea maxime de 50 si, respectiv, 10 mm;
    g) cuburi - morcovi taiati cuburi cu latura de maximum 12,5 mm;
    h) "julienne" - morcovi taiati longitudinal sub forma de batoane netede sau ondulate; sectiunea batoanelor trebuie sa fie de maximum 5 mm;
    i) cuburi duble - bucati de forma regulata si sectiune patrata, avand dimensiunea cea mai lunga aproape egala cu dublul celei mai scurte, care trebuie sa aiba maximum 12,5 mm;
    j) bucati - morcovi intregi taiati transversal in sectiuni cu o grosime de 10 mm; bucati de morcovi avand forme neregulate si dimensiuni superioare rondelelor sau cuburilor, intregi, taiati in jumatati si apoi divizati transversal in sectiuni;
    k) "finger cut" - bucati de morcovi intregi, avand lungimea de cel putin 40 mm si diametrul mai mic sau egal cu 23 mm;
    l) orice alte forme de divizare, cu conditia ca produsele respective sa fie distincte de cele de mai sus, sa se deosebeasca intre ele, sa indeplineasca criteriile de calitate si siguranta alimentara cuprinse in prezentele norme.

    Defecte admise:
    In cazul "baby whole" intregi, morcovilor jumatati, sferturi, bucati si "finger cut", la un esantion de 80 de unitati numarul total al defectelor admise este 13, cu mentiunea ca dintre acestea numarul total al defectelor majore si grave admise este 10 (in aceasta suma se admite cel mult un defect grav).
    In cazul morcovilor intregi, la un esantion de 40 de unitati numarul total al defectelor admise este 13, cu mentiunea ca dintre acestea numarul total al defectelor majore si grave admise este 5 (in aceasta suma se admite cel mult un defect grav).

    La un esantion de 400 g morcovi divizati masa totala a defectelor admise este 50 g, cu mentiunea ca nici o categorie de defecte nu trebuie sa depaseasca 25 g.

    Acceptarea lotului
    O proba de morcovi in conserva care nu indeplineste una sau mai multe dintre cerintele organoleptice, exceptandu-le pe cele care se bazeaza pe valori medii, este considerata "necorespunzatoare". Un lot de morcovi in conserva va fi considerat corespunzator calitativ daca:
    a) numarul recipientelor "necorespunzatoare" nu depaseste criteriul de acceptare (c) al planului de esantionare specific, prezentat in Planurile de esantionare pentru produse alimentare preambalate Nivel de calitate acceptabil (NCA) = 6,5, din Codex alimentarius; si
    b) cerintele de acceptare calculate ca valori medii ale probelor sunt indeplinite.

    Acceptarea lotului
    (1) Un recipient care nu indeplineste cerintele minime pentru gradul de umplere se considera "necorespunzator". Un lot de morcovi in conserva va fi considerat corespunzator calitativ daca numarul recipientelor "necorespunzatoare" nu depaseste criteriul de acceptare (c) al planului de esantionare specific, prezentat in "Planurile de esantionare pentru produse alimentare preambalate" Nivel de calitate acceptabil (NCA) = 6,5, din Codex alimentarius.
    (2) La verificarea prin metoda continutului minim de morcovi din recipient (masa neta fara lichid) dupa indepartarea lichidului, se considera ca produsul corespunde cerintelor daca greutatea medie a continutului tuturor recipientelor examinate nu este mai mica decat valoarea minima ceruta, cu conditia ca nici un recipient sa nu prezinte o valoare exagerat de mica.
