Ministrul administratiei publice si ministrul justitiei,
avand in vedere prevederile art. 13 alin. (4) din Ordonanta Guvernului nr.
10/2000 privind desfasurarea activitatii de realizare si verificare a
lucrarilor de specialitate din domeniile cadastrului, geodeziei si cartografiei
de catre persoanele fizice si juridice autorizate pe teritoriul Romaniei,
aprobata si modificata prin Legea nr. 795/2001, si ale art. VII din Ordonanta
de urgenta a Guvernului nr. 70/2001 pentru modificarea si completarea Legii
cadastrului si a publicitatii imobiliare nr. 7/1996,
in temeiul prevederilor art. 9 alin. (3) din Hotararea Guvernului nr.
8/2001 privind infiintarea, organizarea si functionarea Ministerului
Administratiei Publice si ale art. 7 alin. (3) din Hotararea Guvernului nr.
212/2001 privind organizarea si functionarea Ministerului Justitiei, cu
modificarile ulterioare,
emit prezentul ordin.
Art. 1
Se aproba onorariile minime si maxime pentru activitatile de specialitate
desfasurate de persoanele fizice si juridice autorizate in scopul efectuarii
inscrierilor cu caracter nedefinitiv in cartile funciare, prevazute in anexele
nr. 1, 2 si 3, care fac parte integranta din prezentul ordin.
Art. 2
La fiecare oficiu judetean de cadastru, geodezie si cartografie si al
municipiului Bucuresti si la fiecare birou de carte funciara Lista onorariilor
minime si maxime, avizate de Oficiul Concurentei cu nr. 561 din 18 februarie
2002, va fi la dispozitia publicului spre consultare.
Art. 3
Inspectia de Stat pentru Cadastru, Geodezie si Cartografie din cadrul
Oficiului National de Cadastru, Geodezie si Cartografie si Directia publicitate
mobiliara, imobiliara si notari publici din cadrul Ministerului Justitiei vor
aduce la indeplinire prevederile prezentului ordin.
Art. 4
Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I,
si va intra in vigoare la data publicarii lui.

ANEXA 1
ONORARIILE MINIME SI MAXIME
pentru activitatile de specialitate desfasurate de persoane autorizate in scopul
efectuarii inscrierilor cu caracter nedefinitiv in cartile funciare
Art. 1
(1) Pentru activitatile de specialitate desfasurate in scopul efectuarii
inscrierilor cu caracter nedefinitiv in cartile funciare, persoanele fizice si
juridice autorizate in conditiile legii sa execute astfel de lucrari, denumite
in continuare persoane autorizate, pot solicita si incasa onorarii in
conformitate cu dispozitiile art. 13 alin. (4) din Ordonanta Guvernului nr.
10/2000, aprobata si modificata prin Legea nr. 795/2001, si ale prezentului
ordin.
(2) Onorariile se vor stabili prin negociere si se vor incadra intre
limitele minime si maxime stabilite prin prezentul ordin.
(3) Valorile minime si maxime negociate ale onorariilor pentru intocmirea
documentatiilor tehnice cadastrale in cazul terenurilor cu sau fara constructii
sunt prevazute in anexa nr. 2.
(4) Incalcarea dispozitiilor alin. (2) constituie abatere disciplinara si
se sanctioneaza conform prevederilor legale in vigoare.
Art. 2
(1) La onorariile stabilite conform prevederilor art. 1 se vor adauga, dupa
caz, onorariile aferente executarii releveelor constructiilor, stabilite prin
negociere cu beneficiarii, avandu-se in vedere valorile minime si maxime ale
onorariilor pentru aceasta activitate, prezentate in anexa nr. 3.
(2) In cazul actualizarii releveelor constructiilor, limita onorariului nu
va depasi 50% din valoarea minima/maxima ce ar rezulta in cazul executiei
acestora.
(3) Valoarea totala a onorariului pentru activitatile de specialitate
desfasurate de persoane autorizate in scopul efectuarii inscrierilor cu
caracter nedefinitiv in cartile funciare va rezulta prin insumarea onorariilor
aferente intocmirii documentatiilor tehnice cadastrale pentru terenurile cu sau
fara constructii si a celor aferente executarii releveelor.
(4) Onorariile negociate includ T.V.A.
(5) Onorariile stabilite nu contin:
- taxa de receptie a documentatiei tehnice cadastrale;
- cheltuieli de transport al persoanei autorizate la bunul imobil, cand
este cazul.
Art. 3
(1) Onorariile sunt stabilite potrivit art. 1 pentru urmatoarele
activitati:
a) activitatea de informare, documentare, pregatire si culegere a datelor,
inclusiv cumpararea coordonatelor punctelor si planurilor necesare intocmirii
lucrarii;
b) realizarea si, dupa caz, verificarea lucrarii;
c) colationarea, multiplicarea si pregatirea dosarelor lucrarii.
(2) In sensul alin. (1) lit. b) prin realizarea lucrarii se intelege
executarea operatiunilor de teren si birou, intocmirea documentelor tehnice
care compun lucrarea, validarea datelor si documentelor grafice si textuale,
precum si prezentarea si sustinerea receptiei lucrarilor, cand este cazul, iar
prin verificarea lucrarii se intelege executarea operatiunilor de verificare in
teren si la birou, precum si intocmirea dosarului de verificare, dupa caz.
Art. 4
Onorariile prevazute in anexele nr. 2 si 3 vor fi actualizate periodic, in
functie de indicele ratei de inflatie, prin ordin comun al presedintelui
Oficiului National de Cadastru, Geodezie si Cartografie si al ministrului
justitiei, cu avizul Oficiului Concurentei.
