    In temeiul prevederilor art. 107 din Constitutia Romaniei si ale art. 2 din Legea nr. 496/2001 pentru ratificarea Protocolului dintre Guvernul Romaniei si Guvernul Republicii Populare Chineze privind rezolvarea problemelor restante la conturile instituite in baza acordurilor interguvernamentale, semnat la Bucuresti la 27 februarie 2001,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    Se aproba restituirea de la bugetul de stat pe anul 2001, cap. 66.01 "Industrie", subcapitolul 38 "Transferuri" art. 40.51 "Cooperare Economica Internationala", a sumelor retinute cu titlu de garantie de buna executie de 5% pentru blocul energetic nr. 2, conform conditiilor stipulate in contractul extern, semnat in baza Protocolului incheiat intre guvernele Romaniei si Republicii Populare Chineze privind rambursarea creditelor fara dobanda, acordate de Republica Populara Chineza Romaniei in anul 1970, prin export de echipamente la Centrala termoelectrica de 2 x 330 MW Pucheng - Republica Populara Chineza, sume prevazute in anexa care face parte integranta din prezenta hotarare.
    Art. 2
    Sumele retinute cu titlu de garantie de buna executie de 5% pentru blocul energetic nr. 2 se actualizeaza prin utilizarea cursului in lei al francului elvetian comunicat de Banca Nationala a Romaniei, in vigoare la data la care se face decontarea.
