pentru stabilirea modelului si continutului cererii de inregistrare si ale certificatului de inregistrare in registrul comertului

    In temeiul art. 107 din Constitutie si al art. 3 alin. (13) din Ordonanta de urgenta a Guvernului nr. 76/2001 privind simplificarea unor formalitati administrative pentru inregistrarea si autorizarea functionarii comerciantilor, republicata, cu modificarile si completarile ulterioare,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    (1) Se aproba modelul si continutul cererii de inregistrare in registrul comertului, prevazute in anexa nr. 1.
    (2) Se aproba modelul si continutul cererii pentru obtinerea autorizarii functionarii, prevazute in anexa nr. 2.
    (3) Se aproba modelul si continutul formularului "Declaratie pe proprie raspundere", din care rezulta ca la sediul social/secundar nu se desfasoara activitatile prevazute in obiectul de activitate declarat, prevazute in anexa nr. 3.
    (4) Formularele prevazute la alin. (1) - (3) vor fi utilizate pentru inregistrarea in registrul comertului a societatilor comerciale, regiilor autonome, organizatiilor cooperatiste si a grupurilor de interes economic.
    (5) Formularul prevazut la alin. (1) va fi utilizat si pentru inregistrarea in registrul comertului a persoanelor fizice si asociatiilor familiale, in conditiile prevazute de Legea nr. 507/2002 privind organizarea si desfasurarea unor activitati economice de catre persoane fizice.
    Art. 2
    (1) Se aproba modelul si continutul certificatului de inregistrare in registrul comertului, prevazute in anexa nr. 4.
    (2) Se aproba modelul si continutul formularului care devine anexa la certificatul de inregistrare, prevazute in anexa nr. 5.
    Art. 3
    Anexele nr. 1 - 5*) fac parte integranta din prezenta hotarare.

    *) Anexele nr. 1 - 5 sunt reproduse in facsimil.

    Art. 4
    Cererea de inregistrare, certificatul de inregistrare, inclusiv anexa la acesta avand modelul si continutul prevazute in anexele nr. 1 si 2 la Hotararea Guvernului nr. 1.345/2002 pentru stabilirea modelului si continutului cererii de inregistrare si ale certificatului de inregistrare a comerciantului, se vor utiliza de catre oficiile registrului comertului de pe langa tribunale pana la epuizarea stocului existent la Oficiul National al Registrului Comertului.
    Art. 5
    Pe data intrarii in vigoare a prezentei hotarari se abroga Hotararea Guvernului nr. 1.345/2002 pentru stabilirea modelului si continutului cererii de inregistrare si ale certificatului de inregistrare a comerciantului, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 903 din 12 decembrie 2002.
