privind cerintele minime pentru navele maritime care transporta marfuri periculoase sau poluante

    Ministrul transporturilor,
    in temeiul art. 11 lit. k), r) si t) din Ordonanta Guvernului nr. 19/1997 privind transporturile, aprobata si modificata prin Legea nr. 197/1998, al art. 7 din Ordonanta Guvernului nr. 42/1997 privind navigatia civila, al art. 3 pct. 15 si 17 si al art. 4 alin. (3) din Hotararea Guvernului nr. 263/1999 privind organizarea si functionarea Ministerului Transporturilor,
    emite urmatorul ordin:

    Art. 1
    (1) Operatorii sau comandantii navelor maritime care intra/ies in/din apele sau porturile romanesti si care transporta marfuri periculoase sau poluante in vrac ori in forma ambalata, precum si expeditorii unor astfel de marfuri sunt obligati sa respecte cerintele minime prevazute in prezentul ordin.
    (2) Prevederile prezentului ordin nu se aplica:
    a) navelor militare si navelor oficiale utilizate in scopuri necomerciale;
    b) buncherelor, proviziilor si echipamentului utilizat la bordul navelor.
    Art. 2
    In sensul prezentului ordin, termenii utilizati au urmatoarele semnificatii:
    a) Conventia SOLAS - Conventia internationala din 1974 pentru ocrotirea vietii omenesti pe mare, incheiata la Londra la 1 noiembrie 1974, modificata si completata prin Protocolul din 1988, cu amendamentele ulterioare, la care Romania a aderat prin Decretul Consiliului de Stat nr. 80/1979;
    b) Conventia MARPOL 73/78 - Conventia internationala din 1973 pentru prevenirea poluarii de catre nave, modificata prin Protocolul din 1978 privind Conventia internationala din 1973 pentru prevenirea poluarii de catre nave, incheiat la Londra la 17 februarie 1978, cu amendamentele ulterioare, la care Romania a aderat prin Legea nr. 6/1993;
    c) Codul IMDG - Codul maritim international de marfuri periculoase, adoptat prin Rezolutia A.716(17) a Organizatiei Maritime Internationale (OMI) la 6 noiembrie 1991, la care face trimitere cap. VII din Conventia SOLAS, cu amendamentele adoptate pana la data intrarii in vigoare a prezentului ordin;
    d) Codul INF - Codul international pentru siguranta transportului de combustibil nuclear iradiat, plutoniu si deseuri puternic radioactive la bordul navelor, adoptat prin Rezolutia MSC.88(71) a CSM al OMI la 27 mai 1999 si introdus in Conventia SOLAS la cap. VII partea D prin Rezolutia MSC.87(71), adoptata la 27 mai 1999;
    e) Codul IBC - Codul international pentru constructia si echiparea navelor care transporta produse chimice periculoase in vrac, adoptat de CSM al OMI prin Rezolutia MSC.4(48) si devenit obligatoriu prin prevederile Conventiei SOLAS, cap. VII, adoptat si de Comitetul pentru Protectia Mediului Marin (CPMM) al OMI prin Rezolutia MEPC.19(22) si devenit obligatoriu prin prevederile Conventiei MARPOL 73/78, anexa nr. II, pentru navele-cisterna care transporta marfuri chimice periculoase, construite la sau dupa 1 iulie 1986, cu amendamentele adoptate pana la data intrarii in vigoare a prezentului ordin;
    f) Codul BCH - Codul pentru constructia si echiparea navelor care transporta produse chimice periculoase in vrac, adoptat de CPMM al OMI prin Rezolutia MEPC.20(22), si de CSM prin Rezolutia MSC.9(53), devenit obligatoriu prin prevederile Conventiei MARPOL 73/78, anexa nr. II, pentru navele-cisterna care transporta marfuri chimice periculoase, construite inainte de 1 iulie 1986, cu amendamentele adoptate pana la data intrarii in vigoare a prezentului ordin;
    g) Codul IGC - Codul international pentru constructia si echiparea navelor care transporta gaze lichefiate in vrac, adoptat de CSM al OMI prin Rezolutia MSC.5(48) si devenit obligatoriu prin prevederile Conventiei SOLAS, cap. VII, pentru navele care transporta gaze, construite la sau dupa 1 iulie 1986, cu amendamentele adoptate pana la data intrarii in vigoare a prezentului ordin;
    h) operator - proprietarii, navlositorii, managerii si agentii de nave;
    i) nava - orice nava maritima pentru transport de marfa, petrolier, nava-cisterna pentru transport de substante chimice sau gaze lichefiate ori nava de pasageri avand ca destinatie un port romanesc sau care iese dintr-un port romanesc si care transporta marfuri periculoase sau poluante in vrac ori sub forma ambalata;
    j) marfuri periculoase - marfurile clasificate in Codul IMDG, inclusiv materialele radioactive cuprinse in Codul INF, marfurile clasificate la cap. 17 al Codului IBC si la cap. 19 al Codului IGC;
    k) marfuri poluante - desemneaza hidrocarburile, substantele lichide nocive si substantele daunatoare, astfel cum sunt definite in Conventia MARPOL 73/78;
    l) expeditor - orice persoana prin care sau in numele careia ori in folosul careia a fost incheiat un contract de transport de marfuri pe mare cu un caraus;
    m) VTS - Port Control - serviciul de urmarire a traficului de nave.
    Art. 3
    (1) Marfurile periculoase sau poluante vor fi oferite pentru transport si vor fi acceptate la bordul navei numai daca sunt insotite de o declaratie scrisa, care se prezinta comandantului sau operatorului navei si care va contine: denumirile tehnice corecte ale marfurilor periculoase sau poluante; numerele conform codificarii Natiunilor Unite (UN), atunci cand ele exista; clasele OMI de periculozitate in conformitate cu codurile IMDG, IBC sau BCH, dupa caz, si IGC si, daca este cazul, clasa navei in conformitate cu Codul INF; cantitatile de astfel de marfuri si, daca acestea sunt incarcate in cisterne sau in containere de marfa, marcile lor de identificare.
    (2) Obligatia de a prezenta comandantului sau operatorului navei declaratia prevazuta la alin. (1) si de a se asigura ca incarcatura oferita pentru transport este aceeasi cu cea declarata revine expeditorului marfurilor periculoase sau poluante.
    Art. 4
    (1) Operatorul sau comandantul unei nave care iese dintr-un port romanesc trebuie sa comunice in scris capitaniei de port, inaintea plecarii navei, toate informatiile prevazute in anexa nr. 1 la prezentul ordin.
    (2) Operatorul sau comandantul unei nave care are ca destinatie un port romanesc sau ancoreaza in apele teritoriale ale Romaniei trebuie, ca o conditie pentru intrarea in port sau pentru ancorare, ca la plecarea din portul de incarcare sa comunice capitaniei primului port romanesc de destinatie sau in care se face ancorarea toate informatiile prevazute in anexa nr. 1.
    (3) Orice modificare fata de momentul in care s-au transmis informatiile prevazute in anexa nr. 1 va fi comunicata imediat capitaniei de port la care au fost transmise informatiile initiale.
    (4) Prevederile alin. (1) si (2) nu se aplica navelor care efectueaza servicii cu program regulat care dureaza mai putin de o ora. Pentru cazuri temeinic justificate, Inspectoratul Navigatiei Civile - I.N.C., denumit in continuare I.N.C., poate extinde aceasta perioada. In toate cazurile aceste nave vor face comunicarile prevazute la alin. (1) si (2) la solicitarea I.N.C.
    (5) Navele care intra sau ies dintr-un port romanesc trebuie:
    a) sa utilizeze VTS - Port Control, acolo unde acesta exista;
    b) sa foloseasca piloti, indiferent de tonajul navelor.
    Art. 5
    In caz de accident sau de incident pe mare, care prezinta un pericol pentru litoralul sau pentru apele teritoriale romanesti, comandantul navei implicate trebuie sa il notifice imediat, transmitand prin statia de radio-coasta, pe cel putin una dintre frecventele alocate comunicatiilor de apel, pericol si salvare, de 500 kHz, 2.182 kHz sau 156,800 MHz, informatii privind caracteristicile incidentului, precum si informatiile prevazute in anexa nr. 1.
    Art. 6
    Notificarile si informatiile ce trebuie furnizate in conformitate cu prevederile art. 4 si 5 nu vor prejudicia cerintele existente, impuse de conventiile internationale la care Romania este parte.
    Art. 7
    (1) Comandantul navei trebuie sa completeze cu date reale si exacte o lista de verificare in conformitate cu anexa nr. 2 la prezentul ordin, pe care o va pune la dispozitie pilotului pentru informare si o va preda capitaniei de port la controlul efectuat la sosire, respectiv la plecare.
    (2) Pilotii angajati pentru acostarea, plecarea de la cheu sau manevrarea navelor trebuie sa informeze imediat capitania de port ori de cate ori constata ca exista deficiente care pot afecta navigatia in siguranta a navei.
    Art. 8
    Operatorul serviciului de comunicatii de apel, pericol si salvare va comunica prin statia de radio-coasta, in cadrul zonelor corespunzatoare, orice incident notificat conform art. 5 si informatii cu privire la orice nava care prezinta un pericol pentru navigatie. Aceste informatii vor fi transmise, in mod obligatoriu, capitaniei de port cea mai apropiata de zona incidentului, precum si I.N.C.
    Art. 9
    (1) Capitania de port care a fost notificata in conformitate cu prevederile art. 4 si 8 trebuie sa comunice aceste informatii I.N.C. si sa verifice daca VTS - Port Control, acolo unde acesta exista, a luat in evidenta navele care transporta marfuri periculoase sau poluante si daca a marcat corespunzator prezenta acestora.
    (2) I.N.C. va furniza institutiilor care au sarcini de interventie in combaterea poluarii si stingerea incendiilor informatiile primite, prevazute in anexa nr. 1, si, prin capitaniile de port, va lua masurile necesare privind siguranta navigatiei la intrarea, iesirea si la manevrarea navelor in porturile romanesti.
    (3) I.N.C. va lua masurile corespunzatoare pentru a furniza informatii la cerere, in orice moment, pentru ratiuni de siguranta, autoritatilor competente ale altor state.
    Art. 10
    I.N.C. va aduce la indeplinire prevederile prezentului ordin.
    Art. 11
    Anexele nr. 1 si 2 fac parte integranta din prezentul ordin.
    Art. 12
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I.
