    In temeiul prevederilor art. 17 din Hotararea Guvernului nr. 737/2003 privind organizarea si functionarea Ministerului Muncii, Solidaritatii Sociale si Familiei, cu modificarile si completarile ulterioare,
    avand in vedere prevederile art. 21 din Legea nr. 76/2002 privind sistemul asigurarilor pentru somaj si stimularea ocuparii fortei de munca, cu modificarile si completarile ulterioare, ale art. 9 din Normele metodologice de aplicare a Legii nr. 76/2002 privind sistemul asigurarilor pentru somaj si stimularea ocuparii fortei de munca, aprobate prin Hotararea Guvernului nr. 174/2002, cu modificarile si completarile ulterioare, si prevederile Ordonantei Guvernului nr. 86/2003 privind unele reglementari in domeniul financiar, aprobata cu modificari si completari prin Legea nr. 609/2003,

    ministrul muncii, solidaritatii sociale si familiei emite urmatorul ordin:

    Art. 1
    Se aproba Procedura privind declararea lunara de catre angajatori a evidentei nominale a asiguratilor si a obligatiilor de plata la bugetul asigurarilor pentru somaj, prevazuta in anexa care face parte integranta din prezentul ordin.
    Art. 2
    Pe data intrarii in vigoare a prezentului ordin, Ordinul ministrului muncii si solidaritatii sociale nr. 110/2002 pentru aprobarea Procedurii privind declararea lunara de catre angajatori a obligatiilor de plata la bugetul asigurarilor pentru somaj, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 181 din 18 martie 2002, se abroga.
    Art. 3
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I.

    ANEXA 1

                                 PROCEDURA
privind declararea lunara de catre angajatori a evidentei nominale a asiguratilor si a obligatiilor de plata la bugetul asigurarilor pentru somaj

    I. Organizarea depunerii/transmiterii de catre angajatori a declaratiei lunare privind evidenta nominala a asiguratilor si a obligatiilor de plata la bugetul asigurarilor pentru somaj

    Art. 1
    Obligatia depunerii/transmiterii de catre angajatori a declaratiei lunare prevazute la art. 21 din Legea nr. 76/2002 privind sistemul asigurarilor pentru somaj si stimularea ocuparii fortei de munca, cu modificarile si completarile ulterioare, se realizeaza prin completarea documentelor prezentate in anexele nr. 1 si 2, care cuprind evidenta nominala a asiguratilor si a obligatiilor de plata la bugetul asigurarilor pentru somaj, denumita in continuare declaratie lunara.
    Art. 2
    (1) Incepand cu data de 1 ianuarie 2004, declaratia lunara se depune/transmite, pana la data de 25 inclusiv a lunii urmatoare celei pentru care se datoreaza drepturile salariale si/sau veniturile de natura acestora, la agentia pentru ocuparea fortei de munca in a carei raza teritoriala se afla sediul angajatorului persoana juridica sau domiciliul angajatorului persoana fizica.
    (2) In cazul in care angajatorii persoane juridice au sucursale si/sau puncte de lucru, acestia depun/transmit declaratia lunara, cumulat, atat pentru activitatea proprie, cat si pentru activitatea sucursalelor si/sau punctelor de lucru, dupa caz, la agentia pentru ocuparea fortei de munca in a carei raza teritoriala isi are sediul angajatorul persoana juridica.
    (3) Angajatorii depun/transmit declaratia, in mod obligatoriu, in format electronic (suport magnetic/e-mail).
    (4) In cazuri temeinic justificate directorul executiv al agentiei judetene pentru ocuparea fortei de munca, respectiv a municipiului Bucuresti, poate aproba pentru angajatorii cu mai putin de 5 salariati depunerea declaratiei lunare pe suport hartie.
    (5) In termen de 15 zile de la publicarea prezentului ordin in Monitorul Oficial al Romaniei, Partea I, agentiile judetene pentru ocuparea fortei de munca, respectiv a municipiului Bucuresti, vor publica pe site-ul propriu procedura electronica prin care angajatorii au acces la formularul declaratiei. Acest formular va putea fi vizualizat, completat si transmis prin mijloace electronice.
    Art. 3
    Directorul executiv al fiecarei agentii judetene pentru ocuparea fortei de munca, respectiv al Agentiei Municipale pentru Ocuparea Fortei de Munca Bucuresti, va stabili, prin decizie, arondarea angajatorilor pe agentii locale in functie de sediul sau domiciliul acestora, pentru depunerea/transmiterea declaratiei lunare, precum si competentele de prelucrare a datelor inscrise in aceasta. Centralizarea bazei de date se asigura la nivelul agentiilor judetene pentru ocuparea fortei de munca, respectiv a municipiului Bucuresti.

    II. Modul de completare a declaratiei

    Art. 4
    Capitolul 1 "Evidenta nominala a asiguratilor si a obligatiilor de plata la bugetul asigurarilor pentru somaj" prevazut in anexa nr. 1 care face parte integranta din prezenta procedura se completeaza dupa cum urmeaza:
    1. La rubrica "CUI (Cod fiscal)" se inscrie numai partea numerica a acestuia.
    2. Rubrica "Cod numeric personal" reprezinta codul numeric personal al angajatorului care nu are cod fiscal sau care nu este inregistrat la oficiul registrului comertului (de exemplu, persoane fizice care angajeaza personal casnic conform legii).
    3. La rubrica "Denumire angajator" se inscrie denumirea completa a angajatorului, asa cum este inregistrat la oficiul registrului comertului.
    4. Evidenta nominala a asiguratilor are in vedere persoanele care se afla in urmatoarele situatii prevazute de lege:
    a) persoanele care desfasoara activitati pe baza de contract individual de munca;
    b) functionarii publici si alte persoane care desfasoara activitati pe baza actului de numire;
    c) persoanele care isi desfasoara activitatea in functii elective sau care sunt numite in cadrul autoritatii executive, legislative ori judecatoresti, pe durata mandatului;
    d) militarii angajati pe baza de contract;
    e) persoanele care au raport de munca in calitate de membru cooperator;
    f) alte persoane care realizeaza venituri din activitati desfasurate potrivit legii si care nu se regasesc in una dintre situatiile de mai sus.
    5. Rubrica "Tip contract" se completeaza cu "Tn" pentru toate raporturile de munca/serviciu cu durata normala a timpului de munca/lucru de 8 ore/zi si cu "Tp" pentru contractul individual de munca cu timp partial de lucru.
    6. Rubrica "Numar ore norma in zi" se completeaza cu numarul de ore de lucru normate in zi conform tipului de contract.
    7. Rubrica "Numar zile contributive in luna" se completeaza cu numarul de zile lucratoare normate in luna, conform tipului de contract.
    8. Rubrica "Baza de calcul" se completeaza cu drepturile banesti determinate in conformitate cu prevederile art. 14 alin. (3) din Normele metodologice de aplicare a Legii nr. 76/2002 privind sistemul asigurarilor pentru somaj si stimularea ocuparii fortei de munca, aprobate prin Hotararea Guvernului nr. 174/2002, cu modificarile si completarile ulterioare, pentru asiguratii prevazuti la art. 19 lit. a) - d) sau, dupa caz, pentru asiguratii prevazuti la art. 19 lit. e) si f) din Legea nr. 76/2002, cu modificarile ulterioare asupra veniturilor brute lunare realizate. Pentru persoanele care au stagiu de cotizare partial, ca urmare a inceperii/incetarii raporturilor de munca/serviciu in cadrul lunii de raportare, baza de calcul se considera in functie de numarul de ore efectiv lucrate in luna. In cazul concediilor de sarcina si lauzie, precum si al concediilor medicale pentru incapacitate temporara de munca aceasta rubrica se va completa ca pentru program normal de lucru.
    9. Rubrica "Contributie individuala datorata" se completeaza cu suma rezultata prin aplicarea cotei de 1% asupra bazei de calcul determinate conform pct. 8.
    10. Rubrica "Contributie individuala virata" se completeaza cu suma inscrisa pe ordinul de plata cu care s-a efectuat viramentul.
    Art. 5
    Capitolul 2 "Date despre angajator; deduceri si reduceri" prevazut in anexa nr. 2 care face parte integranta din prezenta procedura se completeaza dupa cum urmeaza:
    1. Rubrica "Total fond salarii brute realizate" se completeaza cu fondul de salarii determinat in conformitate cu prevederile art. 13 din Normele metodologice de aplicare a Legii nr. 76/2002 privind sistemul asigurarilor pentru somaj si stimularea ocuparii fortei de munca, aprobate prin Hotararea Guvernului nr. 174/2002, cu modificarile si completarile ulterioare.
    2. Deducerile si reducerile se completeaza doar de catre angajatorii care beneficiaza de ele.
    3. Rubrica "Rectificativa" se completeaza cu litera "X" numai daca este cazul.
    Art. 6
    Nedepunerea declaratiei lunare pana la termenul stabilit, precum si completarea acesteia altfel decat conform modelelor prevazute in anexele nr. 1 si 2 sau cu date eronate se sanctioneaza potrivit legii.

    III. Modalitatea de transmitere in format electronic a declaratiei lunare si conditiile tehnice standard pentru formatul electronic

    Art. 7
    Declaratiile lunare in format electronic se vor transmite prin e-mail ca fisiere atasate la un mesaj semnat de persoana autorizata sa faca depunerea declaratiei lunare, iar cele pe suport magnetic se depun pe discheta FD 3,5" sau CD in dublu exemplar. Dischetele/CD-urile vor fi etichetate cu informatiile urmatoare:
    1. denumirea fisierului;
    2. denumirea angajatorului;
    3. codul fiscal al angajatorului;
    4. anul si luna pentru care se depune declaratia (aaaa.II);
    5. numarul dischetei/CD-ului, daca sunt mai multe (de exemplu: 1/3, 2/3, 3/3 pentru 3 dischete/CD-uri).
    Art. 8
    Declaratia electronica va contine doua fisiere de tip DBF sau TXT (inregistrari de lungime fixa) pentru fiecare capitol, care vor avea in mod obligatoriu urmatoarele denumiri si continut:
    1. Cap1. DBF sau Cap1. TXT - anexa nr. 1
    2. Cap2. DBF sau Cap2. TXT - anexa nr. 2
    3. Campurile din structura fisierelor sunt de lungime fixa, iar ordinea lor este obligatorie, indiferent daca se completeaza sau nu.
    4. In descrierea de mai jos, rubrica "Tip camp" are urmatoarea semnificatie
    N - numeric, aliniat la dreapta;
    C - caracter (alfanumeric), aliniat la stanga, fara diacritice.
    5. In situatia transmiterii fisierelor tip DBF se va respecta in mod obligatoriu denumirea campurilor date in structurile de fisier.
    6. Descrierea fisierelor aferente anexelor nr. 1 si 2 este urmatoarea:
    Fisierul Cap1. DBF sau Cap1. TXT (anexa nr. 1) contine cate o inregistrare pentru fiecare asigurat si are urmatoarea structura*).

    Toate campurile numerice din anexele nr. 1 si 2 sunt pozitive.
    In cap. 1 (anexa nr. 1):
    - completarea tuturor campurilor este obligatorie.
    In cap. 2 (anexa nr. 2):
    - campurile obligatorii sunt: LD, AD, DEN, CUI(CF/CNPA), LOC, JUD, FS, NUMEA, PREA, FUNCT, MOD, NRD;
    - campurile care se completeaza numai daca este cazul sunt: STR, NRA, BL, SC, ET, AP, SECT, TEL, FAX, MAIL, DED80REC, DED80RES, DED85REC, DED85RES, DED116REC, DED116RES, RED9394REC, RED9394RES, REC.

    IV. Metoda de stabilire a stagiului de cotizare

    Art. 9
    (1) Pentru stabilirea stagiului de cotizare se va utiliza o tabela care va contine numarul de zile lucratoare corespunzator fiecarei luni din an.
    (2) Din calculul: NON x NZN/8 rezulta echivalentul in numar de zile normale (8 ore) lucrate in luna respectiva. Calculul stagiului de cotizare pentru asiguratii cu contract de munca cu timp partial de lucru se face adunand echivalentul in numar de zile normale (8 ore) lucrate, coreland rezultatul obtinut cu tabela care contine numarul de zile lucratoare corespunzator fiecarei luni.
    (3) Se va calcula suma contributiilor individuale datorate, grupata dupa CF/CNPA, LD si AD. Aceasta suma se va corela cu tabela primita de la Ministerul Finantelor Publice referitoare la sumele platite de angajator reprezentand contributia individuala de asigurari pentru somaj retinuta de la asigurati, determinandu-se astfel daca angajatorul a achitat integral aceasta obligatie bugetara; in caz contrar se va proceda conform legii.
    (4) Se va calcula procentul de 3% din total fond salarii brute realizate de asiguratii mentionati la art. 19 din Legea nr. 76/2002, cu modificarile si completarile ulterioare. Aceasta suma se va corela cu tabela primita de la Ministerul Finantelor Publice referitoare la sumele platite de angajator reprezentand contributia pentru somaj datorata de angajator, determinandu-se astfel daca angajatorul a achitat integral aceasta obligatie bugetara; in caz contrar se va proceda conform legii.
