privind aprobarea criteriilor specifice de acordare a statutului de utilitate publica asociatiilor, fundatiilor si federatiilor care desfasoara activitati din sfera de competenta a Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie, a listei documentelor solicitate acestora in vederea recunoasterii ca fiind de utilitate publica si a formularului raportului de activitate pe ultimii 3 ani al acestora

    Avand in vedere prevederile art. 17 alin. (2) lit. d), art. 40^1 si ale art. 51 alin. (1) din Ordonanta Guvernului nr. 26/2000 cu privire la asociatii si fundatii, cu modificarile si completarile ulterioare,
    in baza prevederilor art. IV din Ordonanta Guvernului nr. 37/2003 pentru modificarea si completarea Ordonantei Guvernului nr. 26/2000 cu privire la asociatii si fundatii,
    in temeiul art. 5 alin. (4) din Hotararea Guvernului nr. 753/2003 privind organizarea si functionarea Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie,

    presedintele Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie emite prezentul ordin.

    Art. 1
    Se aproba criteriile specifice de acordare a statutului de utilitate publica asociatiilor, fundatiilor si federatiilor care desfasoara activitati din sfera de competenta a Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie, prevazute in anexa nr. 1.
    Art. 2
    Se aproba lista documentelor solicitate asociatiilor, fundatiilor si federatiilor mentionate la art. 1, in vederea recunoasterii ca fiind de utilitate publica, prevazuta in anexa nr. 2.
    Art. 3
    Se aproba formularul raportului de activitate pe ultimii 3 ani al asociatiei, fundatiei sau federatiei mentionate la art. 1, care solicita acordarea statutului de utilitate publica, prevazut in anexa nr. 3.
    Art. 4
    (1) In termen de 5 zile de la data depunerii dosarului, Structura pentru relatia cu mediul asociativ verifica continutul acestuia si, in cazul in care dosarul nu contine toate documentele justificative, solicita asociatiei, fundatiei sau federatiei mentionate la art. 1 completarea lui conform prevederilor prezentului ordin.
    (2) Se infiinteaza Comisia de examinare a cererilor de acordare a statutului de utilitate publica, a carei componenta se va stabili prin ordin al presedintelui Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie.
    (3) In vederea recunoasterii statutului de utilitate publica, Comisia de examinare a cererilor de acordare a statutului de utilitate publica analizeaza cererea si documentatia prezentate de asociatia, fundatia sau federatia care isi desfasoara activitatea in sfera de competenta a Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie si urmareste respectarea cumulativa a conditiilor prevazute de lege si a criteriilor specifice prevazute in anexa nr. 1.
    (4) In cazul in care se constata indeplinirea conditiilor si criteriilor prevazute la alin. (1), in termen de cel mult 60 de zile de la primirea cererii, Structura pentru relatia cu mediul asociativ inainteaza presedintelui Agentiei Nationale pentru Intreprinderi Mici si Mijlocii si Cooperatie propunerea pentru recunoasterea statutului de utilitate publica si intocmeste proiectul de hotarare a Guvernului privind recunoasterea ca fiind de utilitate publica, pe care il supune avizului compartimentului juridic.
    (5) In cazul in care se constata neindeplinirea conditiilor legale si a criteriilor specifice, se va transmite persoanelor solicitante un raspuns motivat, in termen de 30 de zile de la data luarii deciziei.
    Art. 5
    Anexele nr. 1 - 3*) fac parte integranta din prezentul ordin.

    Art. 6
    La intrarea in vigoare a prezentului ordin se abroga art. 3 din Ordinul ministrului pentru intreprinderile mici si mijlocii si cooperatie nr. 75/2003 si art. 12 - 22 din anexa la acelasi ordin.
    Art. 7
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I.

    Criterii specifice de acordare a statutului de utilitate publica

    In conformitate cu prevederile art. 38 din Ordonanta Guvernului nr. 26/2000 cu privire la asociatii si fundatii modificata si completata prin Ordonanta Guvernului nr. 37/2003, o asociatie, o fundatie sau o federatie poate fi recunoscuta ca fiind de utilitate publica daca sunt indeplinite cumulativ urmatoarele conditii:

    a) activitatea acesteia se desfasoara in interes general sau comunitar, dupa caz

    ANEXA 2

    Lista documentelor solicitate asociatiilor, fundatiilor si federatiilor in vederea recunoasterii ca fiind de utilitate publica

    1. Raportul de activitate pe ultimii 3 ani, in conformitate cu modelul prezentat, obligatoriu in 2 exemplare dactilografiate;
    2. Actul constitutiv, statutul asociatiei/fundatiei/federatiei si, dupa caz, actele aditionale la acestea;
    3. Dovada dobandirii personalitatii juridice si, dupa caz, a inregistrarii modificarilor actului constitutiv si/sau statutului in Registrul asociatiilor si fundatiilor sau in Registrul federatiilor;
    4. Dovada privind bonitatea asociatiei, a fundatiei sau a federatiei emisa de banca la care are deschis contul;
    5. Ultimul extras de cont bancar;
    6. Dovada privind situatia juridica a sediului asociatiei, al fundatiei sau al federatiei si a sediului sau sediilor unde se desfasoara activitatile pentru care se solicita recunoasterea;
    7. Situatiile financiare anuale depuse la administratia financiara pe ultimii 3 ani;
    8. Bugetele de venituri si cheltuieli pe ultimii 3 ani, aprobate de organul de conducere;
    9. Certificate constatatoare privind indeplinirea obligatiilor exigibile de plata a impozitelor si taxelor catre stat, inclusiv a celor locale, precum si a contributiilor pentru asigurarile sociale de stat, asigurarile sociale de sanatate, asigurarile de somaj (formulare-tip eliberate de autoritatile competente);
    10. Autorizatiile administrative conforme cu legislatia in vigoare si/sau acordurile necesare desfasurarii activitatilor;
    11. Regulamentul intern de functionare;
    12. Raportul comisiei de cenzori, pe ultimii 3 ani;
    13. Documente care atesta parteneriatul cu alte asociatii, fundatii, institutii publice etc.;
    14. Situatia privind numele si adresa persoanelor fizice, respectiv denumirea si sediul persoanelor juridice cu care asociatia sau fundatia colaboreaza in mod frecvent in vederea realizarii obiectului sau de activitate pentru care solicita recunoasterea;
    15. Contractele incheiate pentru activitatile dedicate sectorului intreprinderilor mici si mijlocii sau sectorului cooperatist;
    16. Situatiile financiare anuale la data de 31 decembrie a anului precedent, inregistrate la directia generala a finantelor publice judeteana, respectiv la administratiile finantelor publice ale sectoarelor municipiului Bucuresti;
    17. Recomandari de la cel putin 10 beneficiari ai programelor/actiunilor asociatiei/fundatiei/federatiei;
    18. Documentatia prevazuta de legislatia speciala, atunci cand este cazul. (Legea patronatelor nr. 356/2001, Legea nr. 109/1996 privind organizarea si functionarea cooperatiei de consum, Decretul-lege nr. 66/1990 privind organizarea si functionarea cooperatiei mestesugaresti);
    19. Declaratie pe proprie raspundere a presedintelui, sub sanctiunile prevazute de art. 292 din Codul penal cu privire la falsul in declaratii, privind veridicitatea informatiilor cuprinse in raport, a faptului ca organizatia nu a desfasurat activitati ilicite sau contrare ordinii publice sau bunelor moravuri si nu are sume neachitate la scadenta catre persoane fizice sau juridice;
    20. In cazul federatiilor care solicita recunoasterea ca fiind de utilitate publica, dovada ca cel putin doua treimi din numarul asociatiilor si fundatiilor care o alcatuiesc sunt de utilitate publica.
