privind concursul public de oferte nr. 27/2001 pentru concesionarea unor activitati miniere de explorare

    Presedintele Agentiei Nationale pentru Resurse Minerale,
    avand in vedere:
    - solicitarile persoanelor juridice pentru concesionarea unor activitati miniere de explorare, adresate Agentiei Nationale pentru Resurse Minerale;
    - prevederile art. 9 si 40 din Legea minelor nr. 61/1998;
    - prevederile art. 6 - 17 din Normele pentru aplicarea Legii minelor nr. 61/1998, aprobate prin Hotararea Guvernului nr. 639/1998,
    in temeiul Hotararii Guvernului nr. 368/1999 privind reorganizarea Agentiei Nationale pentru Resurse Minerale,
    emite urmatorul ordin:

    Art. 1
    Agentia Nationala pentru Resurse Minerale, cu sediul in municipiul Bucuresti, str. Mendeleev nr. 36 - 38, sectorul 1, telefon +(40)1 - 3132204, fax +(40)1 - 2107440, ofera in vederea concesionarii activitatilor miniere de explorare, in conditiile Legii minelor nr. 61/1998, ale Hotararii Guvernului nr. 639/1998, perimetrele de explorare prevazute in anexa care face parte integranta din prezentul ordin.
    Art. 2
    Durata concesionarii activitatilor miniere de explorare din perimetrele de explorare stabilite conform art. 1 este de maximum 5 ani, cu drept de prelungire pentru cel mult 3 ani, cu reducerea corespunzatoare a marimii perimetrului si cu drept de preemtiune la obtinerea licentei de exploatare.
    Art. 3
    In scopul intocmirii ofertelor Agentia Nationala pentru Resurse Minerale asigura accesul la datele specifice, in baza unui acord de confidentialitate, pentru utilizarea datelor si informatiilor geologice, cu plata tarifelor pentru consultare, in conditiile legii.
    Art. 4
    Ofertele pentru concesionarea activitatilor miniere de explorare se depun la Agentia Nationala pentru Resurse Minerale in termen de 60 de zile calendaristice de la data publicarii prezentului ordin in Monitorul Oficial al Romaniei, Partea I.
    Art. 5
    Conditiile de participare, continutul ofertelor si modul de evaluare a acestora sunt reglementate prin Procedura de selectare a ofertelor - Runda 27/2001 - explorare, care se ofera gratuit, la cerere, la sediul Agentiei Nationale pentru Resurse Minerale.
    Art. 6
    Ofertantii raman angajati prin termenii ofertelor lor pentru toata durata de valabilitate a licentei solicitate.
    Art. 7
    Deschiderea ofertelor va avea loc in sedinta publica, la sediul Agentiei Nationale pentru Resurse Minerale. Data si ora sedintei publice de deschidere a plicurilor se anunta la depunerea ofertelor. Nerespectarea continutului plicurilor, stabilit prin Procedura de selectare a ofertelor - Runda 27/2001 - explorare si a coordonatelor perimetrului oferit determina descalificarea ofertantului.
    Art. 8
    Agentia Nationala pentru Resurse Minerale va analiza ofertele in maximum 30 de zile si va comunica rezultatul evaluarii tuturor ofertantilor.
    Art. 9
    In termen de 10 zile calendaristice de la primirea comunicarii de respingere a ofertelor, la solicitarea in scris a ofertantilor respinsi, Agentia Nationala pentru Resurse Minerale va transmite o copie de pe procesul-verbal de evaluare a ofertelor.
    In termen de 5 zile calendaristice de la primirea copiei de pe procesul-verbal de evaluare a ofertelor, ofertantii pot depune la sediul Agentiei Nationale pentru Resurse Minerale contestatii cu privire la modul in care au fost respectate dispozitiile legale care reglementeaza concesionarea prin concurs de oferte publice.
    In termen de 10 zile calendaristice de la primirea contestatiei Agentia Nationala pentru Resurse Minerale este obligata sa solutioneze contestatia si sa comunice raspunsul sau contestatarului.
    Art. 10
    Negocierea licentelor de explorare cu castigatorii concursului incepe dupa finalizarea contestatiilor si dureaza 30 de zile.
