privind reglementarea la intern a problemelor financiare rezultate din Legea nr. 496/2001 pentru ratificarea Protocolului dintre Guvernul Romaniei si Guvernul Republicii Populare Chineze privind rezolvarea problemelor restante la conturile instituite in baza acordurilor interguvernamentale, semnat la Bucuresti la 27 februarie 2001

    In temeiul prevederilor art. 107 din Constitutia Romaniei si ale art. 2 din Legea nr. 496/2001 pentru ratificarea Protocolului dintre Guvernul Romaniei si Guvernul Republicii Populare Chineze privind rezolvarea problemelor restante la conturile instituite in baza acordurilor interguvernamentale, semnat la Bucuresti la 27 februarie 2001,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    Se aproba restituirea de la bugetul de stat pe anul 2002, aprobat prin Legea bugetului de stat pe anul 2002 nr. 743/2001, cu modificarile ulterioare, prin bugetul Ministerului Industriei si Resurselor, de la capitolul 66.01 "Industrie", titlul 38 "Transferuri", articolul 40.51 "Cooperare economica internationala", a sumelor retinute cu titlu de penalizari de 2% pentru nerealizarea parametrilor garantati si de 5%, reprezentand garantii de buna executie, pentru blocul energetic nr. 1 de la Centrala termoelectrica 2 x 330 MW Pucheng, Republica Populara Chineza, prevazute in anexele nr. 1 si 2 care fac parte integranta din prezenta hotarare.
    Art. 2
    Se aproba restituirea de la bugetul de stat pe anul 2002, prin bugetul Ministerului Industriei si Resurselor, de la capitolul 66.01 "Industrie", titlul 38 "Transferuri", articolul 40.51 "Cooperare economica internationala", a contravalorii in lei a sumei de 460.325 franci elvetieni, reprezentand dobanda de 3% pe an calculata in contul 4 HA pentru livrarile de echipamente efectuate la blocurile energetice nr. 1 si 2 de la Centrala termoelectrica de 3 x 12 MW Cao-Cun, Republica Populara Chineza, finantate in perioada 1990 - 1994 de catre Societatea Comerciala "Romenergo" - S.A.
    Art. 3
    Sumele prevazute la art. 1 si 2 se vor plati la cursul de schimb leu/franc elvetian comunicat de Banca Nationala a Romaniei, in vigoare la data la care se face decontarea.
    Art. 4
    (1) Penalizarile pentru intarzieri in livrare de 8%, in suma de 17.629.621 franci elvetieni, retinute de la agentii economici furnizori pentru livrarile efectuate la Centrala termoelectrica 2 x 330 MW Pucheng, raman cu titlu de penalizari, in conformitate cu contractele interne.
    (2) Penalizarile prevazute la alin. (1) se retin in contul carbunelui cocsificabil nepreluat de partea romana la Centrala termoelectrica de 3 x 12 MW Cao-Cun, in suma de 17.334.565 franci elvetieni.
    (3) Dobanda, in valoare de 1.904.807 franci elvetieni, aferenta exportului de echipamente la Centrala termoelectrica de 3 x 12 MW Cao-Cun, se acopera din soldul contului 70, in valoare de 2.434.629 franci elvetieni, care nu se mai plateste de partea romana.
    Art. 5
    Se aproba restituirea din disponibilitatile in lei, rezultate din derularea operatiunilor de cliring, barter si cooperare economica internationala in cadrul acordurilor comerciale si de plati guvernamentale, a contravalorii in lei a sumei de 406.276 dolari S.U.A., cuvenita Societatii Comerciale "Masinexportimport" - S.A. Bucuresti pentru livrarea de tractoare si piese de schimb aferente, fabricate de Societatea Comerciala "Tractorul - UTB" - S.A. Brasov, la cursul de schimb leu/dolar S.U.A. comunicat de Banca Nationala a Romaniei, in vigoare la data la care se face decontarea.
    Art. 6
    Contravaloarea in lei a sumei de 521.570 franci elvetieni, reprezentand export pentru obiectivul Cao-Cun, inregistrata in contul 4H, ramane cheltuiala definitiva a contului de disponibilitati in lei din operatiuni de cliring, barter si cooperare economica internationala si se suporta din resursele alocate de la bugetul de stat in anii precedenti pentru actiuni de cooperare economica internationala.
