Decizie a Consiliului de Asociere Romania - Uniunea Europeana privind imbunatatirea regimului comertului cu produse agricole transformate, prevazute in Protocolul nr. 3 la Acordul european*)

    Consiliul de Asociere Romania - Uniunea Europeana,
    avand in vedere Acordul european instituind o asociere intre Romania, pe de o parte, si Comunitatile Europene si statele membre ale acestora, pe de alta parte*1), si, in special, art. 1 alin. (2) din Protocolul nr. 3 la acesta,
    avand in vedere ca:
    1. Protocolul nr. 3 prevede preferintele comerciale pentru produsele agricole transformate dintre Romania si Uniunea Europeana. Protocolul nr. 3 a fost modificat ultima data prin Protocolul de adaptare a aspectelor comerciale din Acordul european*2);

    2. recent au fost negociate noi imbunatatiri ale schimburilor comerciale, in scopul facilitarii convergentei economice in perspectiva aderarii, fiind stabilite concesii sub forma liberalizarii complete a comertului pentru unele produse agricole transformate, respectiv fiind convenite reduceri de taxe vamale sau contingente tarifare pentru altele;
    3. in conformitate cu prevederile art. 2 paragraful (1) alin. 2 din Protocolul nr. 3, Consiliul de asociere poate decide reducerea taxelor vamale aplicate ca urmare a concesiilor reciproce convenite pentru unele produse agricole transformate;
    4. pentru produsele agricole transformate, cuprinse in Protocolul nr. 3, care nu se regasesc in prezenta decizie sau pentru care contingentele tarifare sunt epuizate, se aplica in continuare prevederile comerciale in vigoare stabilite prin Protocolul nr. 3;
    5. produsele agricole transformate care nu sunt incluse in anexa nr. I la Tratatul instituind Comunitatea Europeana nu pot beneficia de restitutii la export in conformitate cu prevederile Regulamentului (CE) nr. 1.520/2000 al Comisiei din 13 iulie 2000 privind regulile comune pentru aplicarea sistemului de acordare a restitutiilor la export pentru unele produse agricole exportate sub forma marfurilor care nu sunt incluse in anexa nr. I la tratat, precum si criteriile pentru stabilirea nivelului acestor restitutii*3);

    6. produsele agricole transformate, originare din Romania si exportate in Comunitatea Europeana, nu pot beneficia de restitutii la export;
    7. contingentele tarifare anuale prevazute in anexele nr. III si IV la prezenta decizie se vor deschide conform conditiilor prevazute de anexele mentionate. Pentru anul 2005, avand in vedere ca aceste contingente anuale pot fi deschise doar dupa 1 ianuarie 2005, la o data ce va fi ulterior fixata, contingentele tarifare vor fi reduse proportional cu numarul de luni care au trecut din acel an,
    decide:

    Art. 1
    Incepand cu data intrarii in vigoare a prezentei decizii, la importul in Comunitatea Europeana al bunurilor originare din Romania, prevazute in anexa nr. I, se aplica taxele vamale indicate in anexa respectiva.
    Incepand cu data intrarii in vigoare a prezentei decizii, la importul in Romania al bunurilor originare din Comunitatea Europeana, prevazute in anexa nr. II, se aplica taxele vamale indicate in anexa respectiva.
    Art. 2
    Produsele agricole transformate care nu sunt mentionate in anexa nr. I la Tratatul instituind Comunitatea Europeana, originare din Comunitate si exportate in Romania, nu beneficiaza de restitutii la export acordate in temeiul Regulamentului (CE) nr. 1.520/2000.
    Produsele agricole transformate care nu sunt mentionate in anexa nr. I la tratatul mentionat, originare din Romania si exportate in Comunitatea Europeana, nu beneficiaza in Romania de restitutii la export.
    Art. 3
    Contingentele tarifare mentionate in anexele nr. III si IV sunt deschise in conditiile prevazute in respectivele anexe. Pentru anul 2005 volumul contingentelor tarifare se reduce proportional cu numarul de luni care au trecut.
    Art. 4
    Pentru produsele agricole transformate care nu sunt cuprinse in anexele nr. I - IV*) sau pentru care contingentele prevazute in anexele nr. III si IV sunt epuizate, continua sa se aplice prevederile Protocolului nr. 3, cu exceptia cazului in care se dispune altfel.

    Art. 5
    Prezenta decizie intra in vigoare in prima zi a primei luni care urmeaza notificarii de catre ambele parti a incheierii procedurilor lor interne de ratificare, de acceptare sau de aprobare.
