    In temeiul prevederilor art. 11 alin. (5) din Hotararea Guvernului nr. 28/2001 privind organizarea si functionarea Ministerului Culturii si Cultelor, cu modificarile si completarile ulterioare,
    avand in vedere prevederile art. 40^1 din Ordonanta Guvernului nr. 26/2000 cu privire la asociatii si fundatii, cu modificarile si completarile ulterioare,
    in baza dispozitiilor art. IV din Ordonanta Guvernului nr. 37/2003 pentru modificarea si completarea Ordonantei nr. 26/2000 cu privire la asociatii si fundatii,

    ministrul culturii si cultelor emite urmatorul ordin:

    Art. 1
    Se aproba Criteriile de acordare a statutului de utilitate publica asociatiilor, fundatiilor si federatiilor care desfasoara activitati din sfera de competenta a Ministerului Culturii si Cultelor, prevazute in anexa nr. 1 care face parte integranta din prezentul ordin.
    Art. 2
    Se aproba Lista documentelor solicitate asociatiilor, fundatiilor si federatiilor in vederea recunoasterii ca fiind de utilitate publica, prevazuta in anexa nr. 2 care face parte integranta din prezentul ordin.
    Art. 3
    Se aproba formularul Raportului de activitate pe ultimii 3 ani a asociatiei, fundatiei sau federatiei care solicita acordarea statutului de utilitate publica, prevazut in anexa nr. 3 care face parte integranta din prezentul ordin.
    Art. 4
    (1) Cererile asociatiilor, fundatiilor sau federatiilor care desfasoara activitati in domeniul culturii si cultelor, insotite de documentele justificative, se depun la urmatoarele directii din cadrul Ministerului Culturii si Cultelor:
    - Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, pentru domeniul culturii;
    - Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, pentru domeniul cultelor.
    (2) In termen de 5 zile de la data depunerii dosarului, Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, verifica continutul acestuia si, in cazul in care dosarul nu contine toate documentele justificative, solicita asociatiei, fundatiei sau federatiei completarea lui conform prevederilor prezentului ordin.
    Art. 5
    (1) Dosarele complete sunt examinate de Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv de Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, care verifica indeplinirea de catre asociatia, fundatia sau federatia solicitanta a conditiilor prevazute de lege si a criteriilor aprobate prin prezentul ordin.
    (2) In functie de domeniile de activitate prevazute in statut, pentru care se solicita recunoasterea asociatiei, fundatiei, federatiei ca fiind de utilitate publica, Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, solicita directiei/directiilor de specialitate, precum si Directiei buget, finante, dezvoltare, avizare, din cadrul ministerului, intocmirea referatelor de oportunitate.
    (3) In cazul in care sunt necesare informatii suplimentare referitoare la activitatea asociatiei, fundatiei sau federatiei care solicita acordarea statutului de utilitate publica, Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, poate solicita directiilor pentru cultura, culte si patrimoniul cultural national judetene, respectiv a municipiului Bucuresti, intocmirea unui referat de oportunitate.
    Art. 6
    (1) In cazul in care asociatia, fundatia sau federatia solicitanta indeplineste conditiile prevazute de lege si criteriile aprobate prin prezentul ordin, Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, intocmeste Nota de fundamentare, pe care o inainteaza, impreuna cu documentatia aferenta si referatele de oportunitate, Directiei legislatie, management, sinteze, metodologii, in vederea initierii proiectului de hotarare a Guvernului privind recunoasterea statutului de utilitate publica.
    (2) In cazul in care asociatia, fundatia sau federatia solicitanta nu indeplineste conditiile prevazute de lege si/sau criteriile aprobate prin prezentul ordin, Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate, respectiv Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, comunica acesteia decizia motivata de respingere a cererii de acordare a statutului de utilitate publica si ii restituie dosarul.
    (3) Intocmirea referatelor de oportunitate, verificarea indeplinirii conditiilor si criteriilor de acordare a statutului de utilitate publica si initierea proiectului de hotarare a Guvernului, la nivelul Ministerului Culturii si Cultelor, se efectueaza in termen de 30 de zile de la data depunerii cererii de catre asociatia, fundatia sau federatia solicitanta, respectiv de la data completarii documentatiei, conform prevederilor art. 4 alin. (2).
    Art. 7
    Directia pentru relatia cu Parlamentul, relatia cu societatea civila, sindicate si patronate si Directia asistenta sociala si religioasa, invatamant, O.N.G.-uri, impreuna cu directiile din cadrul Ministerului Culturii si Cultelor, vor lua toate masurile in vederea ducerii la indeplinire a prevederilor prezentului ordin.

    ANEXA 1

                               CRITERII
de acordare a statutului de utilitate publica asociatiilor, fundatiilor si federatiilor care desfasoara activitati din sfera de competenta a Ministerului Culturii si Cultelor

    I. Criterii generale
    In conformitate cu prevederile art. 38 din Ordonanta Guvernului nr. 26/2000 cu privire la asociatii si fundatii, modificata si completata prin Ordonanta Guvernului nr. 37/2003, o asociatie, o fundatie sau o federatie poate fi recunoscuta ca fiind de utilitate publica daca sunt indeplinite cumulativ urmatoarele conditii:
    a) activitatea acesteia se desfasoara in interes general sau comunitar, dupa caz, si functioneaza de cel putin 3 ani, anterior datei depunerii cererii privind recunoasterea statutului de utilitate publica;

    5. Ultimul extras de cont bancar
    6. Dovada privind situatia juridica a sediului asociatiei, al fundatiei sau al federatiei si a sediului sau sediilor unde se desfasoara activitatile pentru care se solicita recunoasterea

    8. Bugetele de venituri si cheltuieli pe ultimii 3 ani, aprobate de organul de conducere

Certificate constatatoare privind indeplinirea obligatiilor exigibile de plata a impozitelor si taxelor catre stat, inclusiv a celor locale, precum si a contributiilor pentru asigurarile sociale de stat, asigurarile sociale de sanatate, asigurarile de somaj (formulare-tip eliberate de autoritatile competente)
    10. Autorizatiile administrative conforme cu legislatia in vigoare si/sau acordurile necesare desfasurarii activitatilor, dupa caz
    11. Raportul comisiei de cenzori pe ultimii 3 ani
    12. Documente care atesta parteneriatul cu alte asociatii, fundatii, institutii publice etc.
    13. Numele si adresa persoanelor fizice, respectiv denumirea si sediul persoanelor juridice cu care asociatia sau fundatia colaboreaza in mod frecvent in vederea realizarii obiectului de activitate pentru care solicita recunoasterea
    14. Declaratie pe propria raspundere a presedintelui, sub sanctiunea prevederilor legale referitoare la falsul in declaratii, privind veridicitatea informatiilor cuprinse in raport, a faptului ca organizatia nu a desfasurat activitati ilicite sau contrare ordinii publice ori bunelor moravuri si nu are sume neachitate la scadenta catre persoane fizice sau juridice
    15. In cazul federatiilor care solicita recunoasterea ca fiind de utilitate publica, dovada ca cel putin doua treimi din numarul asociatiilor si fundatiilor care o alcatuiesc sunt de utilitate publica
    16. Dosarul de presa privind activitatea desfasurata in ultimii 3 ani.
