energetica pentru introducerea pe piata a aparatelor de climatizare de uz
casnic

In temeiul art. 107 din Constitutie si al art. 9 din Legea nr. 199/2000
privind utilizarea eficienta a energiei, republicata,
in aplicarea prevederilor art. 69, 70 si 79 din Acordul european instituind
o asociere intre Romania, pe de o parte, si Comunitatile Europene si statele
membre ale acestora, pe de alta parte, semnat la Bruxelles la 1 februarie 1993,
ratificat prin Legea nr. 20/1993,
Guvernul Romaniei adopta prezenta hotarare.
Art. 1
(1) Prezenta hotarare stabileste cerintele referitoare la etichetarea si
eficienta energetica pentru introducerea pe piata a aparatelor de climatizare
de uz casnic, denumite in continuare aparate.
(2) Sunt supuse prevederilor prezentei hotarari aparatele alimentate de la
reteaua electrica, asa cum sunt definite in standardele romane care adopta
standardele europene EN 255-1, EN 814-1 si standardele europene armonizate,
adoptate de Comitetul European de Standardizare (CEN), ale caror numere de
referinta se publica in Jurnalul Oficial al Comunitatilor Europene.
(3) Prezenta hotarare se aplica si aparatelor care fac obiectul unui
contract de furnizare la distanta incheiat in conditiile legii, adica acelora
care sunt oferite la vanzare, inchiriere sau vanzare in rate printr-o
comunicare scrisa, prin corespondenta, prin oferte scrise, prin anunturi
publicitare pe Internet sau prin alte mijloace pe suport electronic. Oferta de
vanzare a unor astfel de aparate trebuie sa contina informatiile cuprinse in
fisa prevazuta in anexa nr. 2.
Art. 2
Prevederile prezentei hotarari nu se aplica:
a) aparatelor care pot folosi alte surse de energie;
b) aparatelor tip aer-apa si apa-apa;
c) unitatilor cu puterea frigorifica mai mare de 12 kW.
Art. 3
In sensul prezentei hotarari, urmatorii termeni se definesc astfel:
a) furnizor - producatorul, reprezentantul sau autorizat stabilit pe
teritoriul Romaniei sau pe teritoriul unui stat membru al Uniunii Europene ori
persoana responsabila cu introducerea pe piata a aparatului;
b) distribuitor - agentul economic care vinde en detail, inclusiv in rate,
inchiriaza sau expune aparate utilizatorilor finali, in vederea
comercializarii;
c) fisa - un tabel standard cu informatii tehnice privind aparatul.
Art. 4
(1) Se admite introducerea pe piata numai a aparatelor care indeplinesc
urmatoarele conditii:
a) au aplicata, intr-un loc vizibil, in exterior, pe partea frontala sau de
sus a aparatului, o eticheta indicand consumul de energie, clasa de eficienta
energetica si alte caracteristici, dupa caz, conform precizarilor prevazute in
anexa nr. 1;
b) sunt insotite de o fisa al carei continut este prevazut in anexa nr. 2.
(2) Informatiile incluse in eticheta si in fisa sunt stabilite in
conformitate cu procedurile de incercare prevazute in standardele romane care
adopta standardele europene armonizate mentionate la art. 1 alin. (2).
(3) Pana la data intrarii in vigoare a prezentei hotarari Ministerul Industriei
si Resurselor si Asociatia de Standardizare din Romania vor asigura adoptarea
standardelor prevazute la art. 1 alin. (2) ca standarde nationale de eficienta
energetica.
(4) Clasa de eficienta energetica a unui aparat, specificata in eticheta si
in fisa, este prevazuta in anexa nr. 3.
(5) Termenii utilizati in eticheta si in fisa sunt prevazuti in anexa nr.
4.
Art. 5
(1) Furnizorul raspunde pentru corectitudinea informatiilor inscrise in
eticheta si in fisa.
(2) Consimtamantul furnizorului pentru publicarea informatiilor inscrise in
eticheta sau in fisa este prezumat.
(3) Obligatia de aplicare a etichetei revine distribuitorului. Furnizorul
are obligatia sa transmita gratuit distribuitorului etichetele necesare. In
acest sens alegerea sistemului de livrare a etichetelor ramane la latitudinea
furnizorului. Totusi, atunci cand un distribuitor solicita transmiterea
etichetelor, furnizorii trebuie sa asigure livrarea prompta a acestora.
(4) Informatiile incluse in eticheta si in fisa se redacteaza in limba
romana, fara a se exclude posibilitatea furnizarii informatiei si in alte
limbi.
(5) Se interzice aplicarea de alte etichete, marci, simboluri, inscriptii
referitoare la consumul electric de energie, care nu corespund cerintelor
prezentei hotarari, cu exceptia etichetelor ecologice.
Art. 6
(1) Producatorul sau reprezentantul sau autorizat intocmeste si detine,
timp de 5 ani de la data fabricarii ultimului aparat din seria respectiva de
fabricatie, documentatia care atesta conformitatea acestuia cu cerintele
prezentei hotarari.
(2) Documentatia va fi prezentata spre examinare, la cerere, autoritatilor
cu atributii de control in domeniu si va contine:
a) denumirea si sediul furnizorului;
b) descrierea generala a modelului de aparat, pentru a permite
identificarea acestuia;
c) informatii, incluzand eventual si desene relevante, privind principalele
caracteristici tehnice ale modelului de fabricatie, in special cele care
afecteaza in mod esential consumul de energie;
d) rapoarte de incercari si masuratori privind consumul electric al
cuptorului, efectuate in conditiile prevazute la art. 4 alin. (2);
e) instructiuni de utilizare.
(3) Atunci cand informatiile se refera la o combinatie specifica de modele,
bazata pe calcule de proiectare si/sau o extrapolare de combinatii,
documentatia trebuie sa contina detalii ale acestor calcule si/sau extrapolari
si privind incercarile efectuate pentru verificarea acuratetei calculelor
efectuate, detalii ale modelului matematic pentru calculul performantei
sistemelor split si masuratorile efectuate pentru verificarea modelului.
Art. 7
In cazul in care producatorul sau reprezentantul sau autorizat nu are
sediul in Romania, obligatia de a detine documentatia prevazuta la art. 6 alin.
(2) si de a o prezenta spre examinare, la cerere, autoritatilor cu atributii de
control in domeniu revine persoanei responsabile cu introducerea pe piata a
aparatului.
Art. 8
(1) Constituie contraventii urmatoarele fapte si se sanctioneaza dupa cum
urmeaza:
a) nerespectarea prevederilor art. 4 alin. (1) si ale art. 5 alin. (5), cu
amenda de la 25.000.000 lei la 50.000.000 lei, retragerea de pe piata si/sau
interzicerea introducerii pe piata a aparatelor neconforme;
b) nerespectarea prevederilor art. 4 alin. (2), ale art. 6 si 7, cu amenda
de la 50.000.000 lei la 100.000.000 lei, interzicerea comercializarii pana la o
data stabilita de organul de control al autoritatii competente pentru
eliminarea neconformitatilor.
(2) Constatarea contraventiilor si aplicarea sanctiunilor se fac de catre
personalul anume imputernicit din cadrul Agentiei Romane pentru Conservarea
Energiei.
(3) Prevederile referitoare la contraventiile prevazute la alin. (1) si (2)
se completeaza cu dispozitiile Ordonantei Guvernului nr. 2/2001 privind regimul
juridic al contraventiilor, aprobata cu modificari si completari prin Legea nr.
180/2002, cu modificarile ulterioare.
Art. 9
Agentia Romana pentru Conservarea Energiei va promova masuri pentru
informarea si educarea consumatorului, in scopul utilizarii eficiente a
energiei.
Art. 10
Anexele nr. 1 - 4 fac parte integranta din prezenta hotarare.
Art. 11
Prezenta hotarare intra in vigoare la 12 luni de la data publicarii in
Monitorul Oficial al Romaniei, Partea I.

ANEXA 1
PRECIZARI PRIVIND ETICHETA
Definirea informatiilor ce trebuie incluse in eticheta:
1. Denumirea furnizorului sau marca de fabricatie
2. Elementele de identificare a modelului de aparat stabilit de furnizor
Pentru sistemele split si multisplit, identificarea elementelor interioare
si exterioare ale combinatiei de modele la care corespund cifrele indicate
alaturat
3. Clasa de eficienta energetica a modelului sau a combinatiei de modele,
determinata in conformitate cu prevederile anexei nr. 3
Varful sagetii continand litera indicatoare a clasei de eficienta
energetica reala a aparatului trebuie plasat la acelasi nivel cu varful sagetii
de eficienta energetica corespondente.
Inaltimea sagetii continand litera indicatoare trebuie sa fie mai mare
decat inaltimea sagetilor in dreptul carora este plasata, dar nu mai mare decat
dublul inaltimii acestora.
4. Fara a se aduce atingere sistemului privind etichetarea ecologica,
pentru aparatul la care s-a obtinut dreptul de aplicare a ecoetichetei conform
Hotararii Guvernului nr. 189/2002 privind stabilirea procedurii de acordare a
etichetei ecologice se poate aplica pe eticheta o copie de pe marcajul
ecologic.
5. Consumul anual de energie, estimat, calculat cu puterea totala definita
de standardele prevazute la art. 4 alin. (2) din hotarare, multiplicata cu o
medie de 500 ore/an in regim de racire la sarcina maxima, determinata in
conformitate cu procedurile de incercare din standardele prevazute la art. 4
alin. (2) din hotarare (conditii T1 "moderate")
6. Puterea frigorifica definita drept capacitate frigorifica, in kW, a
aparatului in regim de racire, la sarcina maxima, determinata in conformitate
cu procedurile de incercare din standardele prevazute la art. 4 alin. (2) din
hotarare (conditii T1 "moderate")
7. Eficienta frigorifica a aparatului (EER) in regim de racire, la sarcina
maxima, determinata in conformitate cu procedurile de incercare din standardele
prevazute la art. 4 alin. (2) din hotarare (conditii T1 "moderate")
8. Tipul aparatului: numai racire, incalzire si racire
Sageata indicatoare trebuie sa fie plasata la acelasi nivel cu tipul
aparatului corespondent.
9. Modul de racire: racire cu aer, racire cu apa
Sageata indicatoare trebuie sa fie plasata la acelasi nivel cu tipul
aparatului corespondent.
10. Numai pentru aparate cu posibilitate de incalzire (eticheta 2), puterea
calorica definita drept capacitate de incalzire, in kW, a aparatului in regim
de incalzire la sarcina maxima, determinata in conformitate cu procedurile de
incercare din standardele prevazute la art. 4 alin. (2) din hotarare (conditii
T1 + 7 grade C)
11. Numai pentru aparate cu posibilitate de incalzire (eticheta 2), clasa
de eficienta conform anexei nr. 3, exprimata pe o scara de la A (eficient) la G
(putin eficient), determinata in conformitate cu procedurile de incercare din
standardele prevazute la art. 4 alin. (2) din hotarare (conditii T1 + 7 grade
C). In cazul in care caldura este produsa de o rezistenta electrica, COP
(coeficient de performanta) trebuie sa aiba valoarea 1.
12. Atunci cand este aplicabil, nivelul de zgomot masurat in timpul
functionarii in conditiile standard pentru determinarea eficientei energetice
este determinat conform prevederilor Hotararii Guvernului nr. 672/2001 privind
stabilirea conditiilor de introducere pe piata a aparatelor electrocasnice in
functie de nivelul zgomotului transmis prin aer.
Explicatia inscriptionarilor ce figureaza pe eticheta:
Culori utilizate: CMGN - cian, magenta, galben, negru
De exemplu: 07X0: 0% cian, 70% magenta, 100% galben, 0% negru
Sageti:
A: X0X0
B: 70X0
C: 30X0
D: 00X0
E: 03X0
F: 07X0
G: 0XX0
Culoarea conturului: X070
Textul se tipareste integral in negru pe fond alb. Culoarea de fond a
sagetii care indica clasa de eficienta energetica este neagra.
ANEXA 2
FISA
Fisa trebuie sa contina informatiile prevazute mai jos, care pot fi prezentate:
1. sub forma unui tabel regrupand diferite aparate furnizate de acelasi
furnizor;
2. alaturi/impreuna cu instructiunile de utilizare.
Daca se opteaza pentru modul de prezentare prevazut la pct. 1, informatiile
se prezinta in ordinea urmatoare:
1. Denumirea furnizorului sau marca de fabricatie
2. Elemente de identificare a modelului de aparat stabilit de furnizor
Pentru sistemele split si multisplit, identificarea elementelor interioare
si exterioare ale combinatiei de modele la care corespund cifrele indicate
alaturat
3. Clasa de eficienta energetica a modelului, determinata conform
prevederilor anexei nr. 3 si exprimata astfel "Clasa de eficienta
energetica pe scara de la A (eficient) la G (putin eficient)". Daca aceasta
informatie este specificata intr-un tabel, poate sa fie exprimata in alta
forma, cu conditia sa apara clar clasamentul de la A (eficient) la G (putin
eficient).
4. Daca informatia este specificata intr-un tabel si unele dintre aparatele
mentionate in tabel au primit eticheta ecologica conform prevederilor Hotararii
Guvernului nr. 189/2002 privind stabilirea procedurii de acordare a etichetei
ecologice, aceasta informatie poate fi inclusa in tabel. In acest caz antetul
tabelului va include mentiunea "Eticheta ecologica europeana", iar
coloana corespunzatoare va contine o copie a ecoetichetei. Aceasta prevedere nu
prejudiciaza nici o cerinta a sistemului privind etichetarea ecologica.
5. Consumul anual de energie estimat, calculat pe baza unui consum mediu de
500 ore/an si determinat in conformitate cu procedurile de incercare din
standardele prevazute la art. 4 alin. (2) din hotarare (conditii T1
"moderate"). Consumul este definit conform anexei nr. 1, pct. 5.
6. Puterea frigorifica definita drept capacitate frigorifica, in kW, a
aparatului in regim de racire, la sarcina maxima, determinata in conformitate
cu procedurile de incercare din standardele prevazute la art. 4 alin. (2) din
hotarare (conditii T1 "moderate"), definita conform anexei nr. 1.
7. Eficienta frigorifica a aparatului (EER) in regim de racire, la sarcina
maxima, determinata in conformitate cu procedurile de incercare din standardele
prevazute la art. 4 alin. (2) din hotarare (conditii T1 "moderate").
8. Tipul aparatului: numai racire, incalzire si racire
9. Modul de racire: racire cu aer, racire cu apa
10. Numai pentru aparate cu posibilitate de incalzire (eticheta 2), puterea
calorica definita drept capacitate de incalzire, in kW, a aparatului in regim
de incalzire la sarcina maxima, determinata in conformitate cu procedurile de
incercare din standardele prevazute la art. 4 alin. (2) din hotarare (conditii
T1 + 7 grade C) si conform anexei nr. 1, pct. 10
11. Numai pentru aparate cu posibilitate de incalzire (eticheta 2), clasa
de eficienta conform anexei nr. 3, exprimata pe o scara de la A (eficient) la G
(putin eficient), determinata in conformitate cu procedurile de incercare din
standardele prevazute la art. 4 alin. (2) din hotarare (conditii T1 + 7 grade
C) si conform anexei nr. 1, pct. 11. In cazul in care caldura este produsa de o
rezistenta electrica, coeficientul de performanta (COP) trebuie sa aiba
valoarea 1.
12. Atunci cand este aplicabil, nivelul de zgomot masurat in timpul
functionarii in conditiile standard pentru determinarea eficientei energetice
este determinat conform prevederilor Hotararii Guvernului nr. 672/2001 privind
stabilirea conditiilor de introducere pe piata a aparatelor electrocasnice in
functie de nivelul zgomotului transmis prin aer.
13. Furnizorii pot include informatii suplimentare la pct. 5 si 8 daca au
efectuat incercari pentru alte conditii determinate in conformitate cu
procedurile de incercare din standardele prevazute la art. 4 alin. (2) din
hotarare.
