ORDONANTA   Nr. 26 din 30 ianuarie 2003

pentru modificarea si completarea Ordonantei Guvernului nr. 43/1997 privind regimul drumurilor

ACT EMIS DE: GUVERNUL ROMANIEI

ACT PUBLICAT IN: MONITORUL OFICIAL  NR. 66 din  2 februarie 2003

    In temeiul art. 107 din Constitutie si al art. 1 pct. II.11 din Legea nr. 680/2002 privind abilitarea Guvernului de a emite ordonante,

    Guvernul Romaniei adopta prezenta ordonanta.

    Art. 1
    Ordonanta Guvernului nr. 43/1997 privind regimul drumurilor, republicata in Monitorul Oficial al Romaniei, Partea I, nr. 237 din 29 iunie 1998, cu modificarile si completarile ulterioare, se modifica si se completeaza dupa cum urmeaza:
    1. Alineatul (4) al articolului 40 va avea urmatorul cuprins:
    "(4) Masele si dimensiunile maxime admise prevazute in anexa nr. 2 pot fi majorate prin ordin al ministrului lucrarilor publice, transporturilor si locuintei, pe masura executarii unor lucrari de sporire a capacitatii portante a drumurilor."
    2. Dupa alineatul (4) al articolului 41 se introduce un nou alineat, alineatul (4^1), cu urmatorul cuprins:
    "(4^1) Ansamblul de vehicule cu un numar mai mare de 6 osii si care depaseste limitele de greutate prevazute in anexa nr. 2 va fi considerat atipic si va fi tarifat in conformitate cu prevederile alin. (4)."
    3. La alineatul (1) al articolului 60 se introduc literele c), d) si e) cu urmatorul cuprins:
    "c) nerespectarea autorizatiei speciale de transport pentru mase si/sau dimensiuni de gabarit depasite se sanctioneaza cu amenda de la 5.000.000 lei la 10.000.000 lei;
    d) neoprirea autovehiculelor la semnalizarea personalului cu drept de control privind respectarea prevederilor referitoare la autorizatiile speciale de transport se sanctioneaza cu amenda de la 10.000.000 lei la 15.000.000 lei;
    e) refuzul de a se supune verificarii prin cantarire a autovehiculelor si/sau masurare a dimensiunilor de gabarit ale acestora se sanctioneaza cu amenda de la 15.000.000 lei la 20.000.000 lei."
    4. Anexa nr. 2 se inlocuieste cu anexa la prezenta ordonanta.
    Art. 2
    Pe data intrarii in vigoare a prezentei ordonante punctul 30 al articolului 3 si prevederile literei e) a articolului 4, referitoare la contraventia prevazuta la punctul 30 al articolului 3 din Hotararea Guvernului nr. 36/1996 privind stabilirea si sanctionarea contraventiilor la normele privind exploatarea si mentinerea in buna stare a drumurilor publice, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 28 din 6 februarie 1996, se abroga.
    Art. 3
    Ordonanta Guvernului nr. 43/1997 privind regimul drumurilor, republicata, cu modificarile si completarile ulterioare, precum si cu cele aduse prin prezenta ordonanta, va fi republicata in Monitorul Oficial al Romaniei, Partea I, dandu-se textelor o noua numerotare.

|        |Distanta masurata in plan orizontal intre axa pivotului de cuplare si|
|        |orice punct din partea frontala a semiremorcii nu trebuie sa         |
|        |depaseasca 2,04 m.                                                   |

    *) Plus o limita de 2 tone, atunci cand masa maxima admisa a vehiculului motor este de 18 tone si masa maxima admisa a osiei tandem a semiremorcii este de 20 tone si osia motoare este prevazuta cu roti jumelate si cu suspensie pneumatica sau echivalenta acesteia.
    *) Se aplica in cazul in care osia motoare este prevazuta cu roti jumelate si cu suspensie pneumatica sau echivalenta acesteia, sau in cazul in care fiecare osie motoare este prevazuta cu roti jumelate si masa maxima a fiecarei osii nu depaseste 9,5 tone.
    *) Se aplica in cazul in care osia este prevazuta cu suspensie pneumatica sau echivalenta acesteia.
