    Ministrul lucrarilor publice, transporturilor si locuintei,
    in temeiul prevederilor art. 12 lit. b) din Ordonanta Guvernului nr. 19/1997 privind transporturile, aprobata cu modificari si completari prin Legea nr. 197/1998, republicata, cu modificarile si completarile ulterioare, ale art. 4 alin. (3) lit. c) si g) din Ordonanta Guvernului nr. 44/1997 privind transporturile rutiere, aprobata cu modificari si completari prin Legea nr. 105/2000, precum si ale art. 4 alin. (3) din Hotararea Guvernului nr. 3/2000 privind organizarea si functionarea Ministerului Lucrarilor Publice, Transporturilor si Locuintei,
    in conformitate cu normele si conditiile tehnice privind siguranta rutiera si protectia mediului, prevazute in directivele europene si in regulamentele CEE/ONU, precum si in acord cu rezolutiile Conferintei Europene a Ministrilor Transporturilor (CEMT),
    emite urmatorul ordin:

    Art. 1
    (1) Vehiculele rutiere cu masa maxima autorizata mai mare de 3,5 tone, destinate transportului international de marfuri, se clasifica in categoriile de poluare si de siguranta a circulatiei prevazute in anexa nr. 1.
    (2) Clasificarea prevazuta la alin. (1) se face conform nivelurilor maxime admise de poluare chimica si sonora, prevazute in anexa nr. 2a), si prescriptiilor tehnice si de siguranta activa/pasiva, prevazute in anexa nr. 2b).
    (3) Autovehiculele incadrate in categoriile de poluare "AE3" - "F", potrivit clasificarii prevazute in anexa nr. 1, primesc licenta de executie pentru transporturi internationale de marfuri.
    Art. 2
    (1) Regia Autonoma "Registrul Auto Roman", denumita in continuare R.A.R., certifica incadrarea autovehiculelor in categoriile de poluare "AE3" - "F" si elibereaza dovezi de certificare corespunzatoare, avand forma si continutul conform modelelor prezentate in anexele nr. 3a) - 3i).
    (2) Certificarea incadrarii autovehiculelor, prevazuta la alin. (1), se face in baza certificatelor de conformitate eliberate de fabricantul autovehiculului sau de reprezentanta acestuia pentru Romania, conform prevederilor Rezolutiei CEMT/CM2001/9 Final, a documentelor de omologare de tip ale autovehiculului si a verificarilor tehnice efectuate conform anexelor nr. 2a) si 2b).
    (3) Opacitatea gazelor de evacuare se va masura doar in cazul in care vechimea autovehiculului depaseste un an de la data fabricatiei sau daca se sesizeaza vizual un grad ridicat al opacitatii gazelor de evacuare.
    Art. 3
    (1) Dovezile de certificare pentru autovehiculele incadrate in categoriile "C" - "F" au valabilitatea de maximum un an de la data eliberarii, aceasta fiind insa corelata cu data la care s-a masurat opacitatea gazelor.
    (2) Dovezile de certificare pentru autovehiculele incadrate in categoria de poluare "B" au valabilitatea de maximum 2 ani de la data eliberarii, aceasta fiind insa corelata cu valabilitatea documentului ce atesta insonorizarea autovehiculului (certificatul austriac de zgomot).
    (3) Dovezile de certificare pentru autovehiculele incadrate in categoriile de poluare "AE3" si "A" se elibereaza atat pentru autovehicul, cat si pentru (semi)remorca tractata de acesta si au valabilitatea de maximum un an de la data eliberarii, aceasta fiind insa corelata cu valabilitatea certificatului ce atesta insonorizarea autovehiculului (certificatul austriac de zgomot).
    Art. 4
    (1) Dovezile de certificare pentru autovehiculele incadrate in categoriile "AE3", "A" si "B" sunt eliberate de R.A.R. in conformitate cu prevederile art. 2 alin. (1).
    (2) Certificatele de conformitate eliberate de fabricantul autovehiculului sau de reprezentantul acestuia pentru Romania sunt redactate in limba engleza sau franceza, fiind insotite si de o traducere in limba germana.
    (3) Pentru categoria de poluare "AE3" originalul dovezii de certificare (exemplarul in limba romana) se pastreaza la dosarul CEMT pana la solutionarea completa a dosarului.
    Art. 5
    Dovezile de certificare pentru autovehiculele incadrate in categoriile de poluare "AE3" - "F", eliberate in conformitate cu prevederile Ordinului ministrului transporturilor nr. 353/1996, cu modificarile si completarile ulterioare, sunt considerate valabile daca au fost eliberate pana la data intrarii in vigoare a prezentului ordin.
    Art. 6
    Pentru autovehiculele incadrate in categoria de poluare "AE3", in urma transformarii din "EURO 2" in "EURO 3" prin perfectionarea tehnica a motoarelor, dovezile de certificare in limba romana, conform modelului prezentat in anexa nr. 3a), se vor evidentia prin taierea coltului din dreapta sus.
    Art. 7
    Directia generala de reglementari si calitatea serviciilor in transporturile rutiere din cadrul Ministerului Lucrarilor Publice, Transporturilor si Locuintei, impreuna cu R.A.R. si Autoritatea Rutiera Romana - A.R.R. vor duce la indeplinire prevederile prezentului ordin.
    Art. 8
    Anexele nr. 1 - 3*) fac parte integranta din prezentul ordin.

    Art. 9
    La data prezentului ordin, Ordinul ministrului transporturilor nr. 353/1996, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 301 din 21 noiembrie 1996, cu modificarile si completarile ulterioare, se abroga.
    Art. 10
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I.

    ANEXA 2b

    Prescriptii tehnice si de siguranta activa/pasiva pentru autovehiculele TIR ("A" si "AE3") in vederea asigurarii sigurantei circulatiei

    In conformitate cu R.N.T.R.-1, cu Directiva 96/96/CE privind controlul tehnic al autovehiculelor si in acord cu rezolutia CEMT/CM(2001)/9 Final, autovehiculele TIR si (semi)remorcile acestora trebuie sa indeplineasca urmatoarele cerinte tehnice:
    - sistemul de franare trebuie sa fie prevazut cu "ABS" (sistem antiblocare) conform Regulamentului CEE/ONU R13/09 sau conform Directivei 71/320 CEE modificata prin Directiva 98/12 CE. Sistemele de franare ale autovehiculului si (semi)remorcii trebuie sa fie compatibile;
    - sistemul de directie trebuie sa fie in concordanta cu Regulamentul CEE/ONU R79/01 sau cu Directiva 70/311 CEE modificata prin Directiva 92/62 CEE sau Directiva 1999/7 CE;
    - dispozitivul antiincastrare spate in conformitate cu Regulamentul CEE/ONU R58/01 sau Directiva 70/221 CEE, amendata cu Directiva 2000/8 CE;
    - dispozitivul antiincastrare lateral in conformitate cu Regulamentul CEE/ONU R73/00 sau cu Directiva 89/297 CEE;
    - tahograful sa fie in concordanta cu Regulamentul CEE nr. 3821/85 cu ultimele amendamente din Regulamentul CE nr. 1056/97 sau Regulamentul CE nr. 2135/98;
    - limitarea de viteza a autovehiculelor sa fie in conformitate cu Regulamentul CEE/ONU R89 sau cu Directiva 92/24 CEE;
    - placutele reflectorizante spate pentru vehiculele grele si lungi sa fie in concordanta cu Regulamentul CEE/ONU R70/01;
    - vizibilitatea: farurile, semnalizatoarele si echipamentele electrice; puntile, rotile, anvelopele si suspensiile, inclusiv adancimea profilului anvelopelor; sasiul si punctele de fixare la sasiu, trebuie sa respecte prescriptiile tehnice din R.N.T.R.-1 si a Directivei nr. 96/96/CEE;
    - prezenta unui triunghi rosu de avertizare conform Regulamentului CEE/ONU R27/03.
