    Ministerul lucrarilor publice si amenajarii teritoriului si ministrul apelor, padurilor si protectiei mediului,
    avand in vedere specificul deosebit al lucrarilor hidrotehnice in comparatie cu alte tipuri de constructii si necesitatea abordarii unitare in stabilirea categoriei de importanta si in activitatea de evaluare a starii lor de siguranta in exploatare, inclusiv a constructiilor si instalatiilor-anexa aferente, de catre expertii tehnici certificati si de specialistii avizati pentru efectuarea acestui tip de expertize,
    in conformitate cu prevederile art. 8 si 13 din Legea nr. 10/1995 privind calitatea in constructii si ale art. 48, 62, 64, 68 si 110 din Legea apelor nr. 107/1996,
    in baza Hotararii Guvernului nr. 456/1994 privind organizarea si functionarea Ministerului Lucrarilor Publice si Amenajarii Teritoriului, republicata, si a art. 9 lit. d) din anexa nr. 3 la Hotararea Guvernului nr. 104/1999 privind organizarea si functionarea Ministerului Apelor, Padurilor si Protectiei Mediului,
    in conformitate cu prevederile Hotararii Guvernului nr. 766/1997 pentru aprobarea unor regulamente privind calitatea in constructii,
    avand in vedere propunerea de Metodologie privind stabilirea categoriilor de importanta a lucrarilor hidrotehnice - NTLH-021, analizata si avizata in cadrul sedintei Biroului operativ al Comisiei Nationale pentru Siguranta Barajelor si a Altor Lucrari Hidrotehnice din data de 7 octombrie 1999,
    emit prezentul ordin.

    Art. 1
    Se aproba Metodologia privind stabilirea categoriilor de importanta a lucrarilor hidrotehnice - NTLH-021, prevazuta in anexa care face parte integranta din prezentul ordin.
    Art. 2
    Expertii certificati conform prevederilor Regulamentului privind organizarea si certificarea corpului de experti pentru evaluarea starii de siguranta a barajelor si lucrarilor hidrotehnice speciale - NTLH-014, aprobat prin Ordinul ministrului apelor, padurilor si protectiei mediului nr. 1.096/1999*), specialistii avizati conform prevederilor Procedurii de avizare a specialistilor pentru intocmirea evaluarilor starii de siguranta a barajelor si digurilor din categoriile de importanta C si D - NTLH-015, aprobate prin Ordinul ministrului apelor, padurilor si protectiei mediului nr. 1.097/1999*) si detinatorii/administratorii, cu orice titlu, de lucrari hidrotehnice raspund, in aria lor de autoritate, de evaluarea starii de siguranta in exploatare a lucrarilor hidrotehnice si de aducerea la indeplinire a prevederilor prezentului ordin.

    Art. 3
    Inspectia de stat in constructii, lucrari publice, urbanism si amenajarea teritoriului din cadrul Ministerului Lucrarilor Publice si Amenajarii Teritoriului si Directia generala a apelor din cadrul Ministerului Apelor, Padurilor si Protectiei Mediului vor urmari si vor controla aducerea la indeplinire a prevederilor prezentului ordin.
    Art. 4
    La data intrarii in vigoare a prezentului ordin orice alte dispozitii contrare isi inceteaza aplicabilitatea.

    ANEXA 1

                              METODOLOGIA
privind stabilirea categoriilor de importanta a lucrarilor hidrotehnice - NTLH-021

    CAP. 1
    Obiectul metodologiei

    Art. 1
    Stabilirea categoriilor de importanta a lucrarilor hidrotehnice reprezinta o obligatie legala a detinatorilor/administratorilor, cu orice titlu, indiferent de proiectant, in temeiul prevederilor Hotararii Guvernului nr. 766/1997 pentru aprobarea unor regulamente privind calitatea in constructii, si are consecinte directe asupra nivelului de calitate impus acestora in conformitate cu Legea nr. 10/1995 privind calitatea in constructii, precum si asupra delimitarii obligatiilor care revin persoanelor juridice si fizice.
    Art. 2
    Incadrarea in categorii de importanta a lucrarilor hidrotehnice, realizata in conformitate cu prezenta metodologie, este utilizata in mod expres pentru:
    a) stabilirea tipului de urmarire - speciala sau curenta - care trebuie aplicata unui anumit tip de lucrare;
    b) stabilirea listei cuprinzand lucrarile hidrotehnice care intra sub incidenta reglementarilor privind sistemul de urmarire a sigurantei, inclusiv a competentelor de autorizare si control, in conformitate cu ordinele emise de ministrul lucrarilor publice si amenajarii teritoriului si de ministrul apelor, padurilor si protectiei mediului, in baza avizului Comisiei Nationale pentru Siguranta Barajelor si a Altor Lucrari Hidrotehnice, organism consultativ care functioneaza pe langa Ministerul Apelor, Padurilor si Protectiei Mediului;
    c) ierarhizarea lucrarilor hidrotehnice, in vederea stabilirii programului de evaluare a starii de siguranta in exploatare a acestora.

    CAP. 2
    Principii generale

    Art. 3
    (1) Prezenta metodologie are in vedere o cuantificare a componentelor riscului si a riscului final al barajelor, in vederea incadrarii acestora in categoriile de importanta A, B, C si D, utilizand un sistem de criterii, indici si notari.
    (2) Criteriul de stabilire a categoriei de importanta a barajelor il constituie riscul determinat prin relatia:
    Risc = Indicele de cedare x Consecinta.
    (3) Incadrarea in categorii de importanta a celorlalte lucrari hidrotehnice (diguri, lucrari hidrotehnice speciale, baraje si diguri care realizeaza depozite de deseuri industriale si altele) se efectueaza potrivit prevederilor Hotararii Guvernului nr. 766/1997 si nu face obiectul prezentei metodologii.

    CAP. 3
    Criterii si subcriterii

    Art. 4
    (1) Criteriile utilizate in evaluarea riscului barajelor sunt:
    a) indicele BA este determinat de caracteristicile barajului (dimensiuni, tip, descarcatori, clasa de importanta) si ale amplasamentului acestuia (natura terenului de fundare si zona seismica); punctajele corespunzatoare sunt prevazute in tabelul nr. 1 cuprins in anexa la prezenta metodologie;
    b) indicele CB, de stare a barajului, este operant pentru barajele existente si depinde de sistemul de supraveghere, de lucrarile de intretinere, de principalele date din urmarirea comportarii in timp (UCC) si de conditiile lacului de acumulare si ale uvrajelor-anexa; subcriteriile si punctajele aferente sunt prevazute in tabelul nr. 2 cuprins in anexa la prezenta metodologie;
    c) indicele CA corespunde consecintelor avariei barajului si necesita intocmirea de studii si harti de inundabilitate, inventarul bunurilor inundate in zona aval, estimarea pierderilor de vieti omenesti etc.; criteriile partiale si numarul de puncte corespunzatoare sunt prevazute in tabelul nr. 3 cuprins in anexa la prezenta metodologie.
    (2) Pentru fiecare criteriu sunt stabilite subcriterii si un sistem de puncte atribuit acestora. Punctajul total al unui criteriu este dat de suma aritmetica a punctajelor subcriteriilor. In cazul indicilor BA si CB, situatia cea mai favorabila este exprimata prin punctajul maxim, iar suma punctajelor unui criteriu este plafonata la maximum 100. In cazul indicelui CA, subcriteriile sunt punctate maximal pentru consecintele cele mai grave, iar suma acestora, in situatia cea mai defavorabila, este plafonata la 100.

    CAP. 4
    Incadrarea in categorii de importanta a barajelor

    Art. 5
    Riscul asociat unui baraj se apreciaza printr-un indice de risc (RB) determinat cu relatiile:

    RB = BC x CA;
    PC = 1/SG;
    SG = alfa BA + beta CB,
    in care:
    RB = indicele de risc asociat barajului;
    PC = indicele de cedare a barajului (probabilitatea de rupere);
    SG = indicele de siguranta, determinat ca suma ponderata a criteriilor BA si CB.

    Art. 6
    In functie de valoarea indicelui de risc asociat barajului (RB), care variaza in domeniul 0,005... 10, se determina categoria de importanta dupa cum urmeaza:
    RB > 1          - risc inacceptabil, barajul nu poate fi exploatat;
    0,5 < RB < 1    - baraj de importanta exceptionala (A);
    0,25 < RB < 0,5 - baraj de importanta deosebita (B);
    0,1 < RB < 0,25 - baraj de importanta normala (C);
    RB < 0,1        - baraj de importanta redusa (D).

    CAP. 5
    Dispozitii finale

    Art. 7
    (1) In conformitate cu prevederile legale, utilizarea prezentei metodologii pentru stabilirea categoriei de importanta a barajelor revine proprietarului, respectiv detinatorului, in cazul barajelor existente.
    (2) Stabilirea categoriei de importanta a barajelor se face de comisiile tehnice ale celor direct responsabili, urmand ca rezultatele sa fie validate de comisiile de urmarire a comportarii constructiilor (UCC) ale detinatorilor de baraje. Comisia Nationala pentru Siguranta Barajelor si a Altor Lucrari Hidrotehnice are drept de control asupra stabilirii categoriilor de importanta pentru toate barajele din Romania.
    Art. 8
    Anexa face parte integranta din prezenta metodologie.
