privind reglementarea drepturilor de natura salariala ale functionarilor publici

    In temeiul art. 114 alin. (4) din Constitutie,

    Guvernul Romaniei adopta prezenta ordonanta de urgenta.

    CAP. 1
    Dispozitii generale

    Art. 1
    Dispozitiile prezentei ordonante de urgenta se aplica in anul 2003 functionarilor publici din autoritatile si institutiile publice finantate integral sau partial de la bugetul de stat, bugetul asigurarilor sociale de stat, bugetele locale si bugetele fondurilor speciale.
    Art. 2
    (1) Din fondurile bugetare alocate prin bugetul de stat, bugetul asigurarilor sociale de stat, bugetele locale si bugetele fondurilor speciale ordonatorii principali de credite repartizeaza pentru aparatul propriu si pentru unitatile subordonate sumele destinate cheltuielilor cu salariile, in vederea realizarii atributiilor autoritatii sau institutiei publice.
    (2) Gestiunea sistemului de salarizare a functionarilor publici se asigura de fiecare ordonator principal de credite, cu incadrarea in resursele financiare alocate anual si in numarul de posturi aprobate potrivit legii.
    Art. 3
    Monitorizarea si controlul aplicarii prevederilor legale privind salarizarea functionarilor publici se realizeaza de catre Ministerul Administratiei Publice prin Agentia Nationala a Functionarilor Publici, Ministerul Muncii si Solidaritatii Sociale si Ministerul Finantelor Publice, potrivit atributiilor din domeniul de activitate al acestor institutii, cu exceptia autoritatilor prevazute la art. 101 din Legea nr. 188/1999 privind Statutul functionarilor publici, cu modificarile si completarile ulterioare.

    CAP. 2
    Elementele sistemului de salarizare

    Art. 4
    (1) Sistemul de salarizare a functionarilor publici, stabilit conform prezentei ordonante de urgenta, are in vedere urmatoarele:
    a) crearea unui sistem unitar de salarizare aplicabil tuturor functionarilor publici;
    b) crearea unei ierarhizari a sistemului de salarizare pe categorii, clase si grade;
    c) salarizarea functionarilor publici in raport cu activitatea depusa si cu importanta acesteia.
    (2) Sistemul de salarizare cuprinde salariile de baza, sporurile, premiile, stimulentele si alte drepturi.

    Salarii de baza
    Art. 5
    (1) Salariile de baza se stabilesc in mod diferentiat, avandu-se in vedere realizarea unei ierarhii juste si motivate in sistem de cariera, in raport cu natura competentelor, cu activitatea desfasurata si cu importanta ei, corespunzator cerintelor categoriei, clasei si gradului functiei publice.
    (2) In cadrul fiecarei categorii salariile de baza se diferentiaza pe 3 clase, iar in cadrul acestora pe 3 grade, astfel incat sa se asigure posibilitatea diferentierii salariilor de baza individuale in raport cu nivelul pregatirii profesionale a fiecarei persoane si cu experienta acesteia in activitate.
    (3) In cadrul fiecarei clase diferentierea salariilor de baza se face pe un numar de 3 grade, asigurandu-se diferentierea salariilor de baza individuale atat in raport cu conditiile prevazute de lege pentru avansarea in grad, cat si cu calitatile personale dovedite in activitate.
    (4) Pentru functiile cu acelasi nivel de studii, specifice diferitelor domenii de activitate bugetara, salariile de baza se diferentiaza in raport cu raspunderea si importanta sociala a domeniului de activitate, cu prioritatile de dezvoltare sau de crestere a calitatii serviciilor in anumite domenii, precum si cu necesitatile de atragere a personalului de specialitate spre anumite activitati.
    (5) Salariile de baza se diferentiaza si in raport cu nivelul la care se presteaza activitatea, respectiv la nivel central sau la nivel local.
    (6) Functionarii publici care ocupa functii publice specifice, aprobate potrivit legii, sunt salarizati prin asimilare cu functiile publice prevazute in anexele la prezenta ordonanta de urgenta. Stabilirea asimilarii salarizarii functionarilor publici care ocupa functii publice specifice se face in raport cu categoria, clasa si gradul functiei publice respective, prin ordin sau dispozitie a conducatorului autoritatii sau institutiei publice.
    Art. 6
    (1) Salariile de baza si indemnizatiile de conducere pentru functiile publice din aparatul Administratiei Prezidentiale, Parlamentului, Guvernului, Curtii Supreme de Justitie, Parchetului de pe langa Curtea Suprema de Justitie, Curtii Constitutionale, Consiliului Legislativ, Consiliului Concurentei, Avocatului Poporului, Curtii de Conturi, Consiliului National pentru Studierea Arhivelor Securitatii si Consiliului National al Audiovizualului sunt prevazute in anexa nr. I.
    (2) Salariile de baza si indemnizatiile de conducere pentru functiile publice din aparatul propriu al ministerelor, celorlalte organe de specialitate ale administratiei publice centrale, al Casei Nationale de Pensii si Alte Drepturi de Asigurari Sociale, al Inspectiei Muncii, al Casei Nationale de Asigurari de Sanatate si al Agentiei Nationale pentru Ocuparea Fortei de Munca sunt prevazute in anexa nr. II.
    (3) Salariile de baza si indemnizatiile de conducere pentru functiile publice din aparatul propriu al prefecturilor, al institutiilor subordonate autoritatilor sau institutiilor publice centrale, al serviciilor publice descentralizate ale ministerelor si ale altor organe de specialitate ale administratiei publice centrale din unitatile administrativ-teritoriale, inspectoratelor teritoriale de munca, caselor de asigurari de sanatate judetene si a municipiului Bucuresti, al Casei de Asigurari de Sanatate a Apararii, Ordinii Publice, Sigurantei Nationale si Autoritatii Judecatoresti, al Casei Asigurarilor de Sanatate a Ministerului Lucrarilor Publice, Transporturilor si Locuintei, al caselor judetene de pensii si a municipiului Bucuresti, al agentiilor judetene pentru ocuparea fortei de munca si a municipiului Bucuresti, precum si din aparatul propriu al consiliilor judetene si al Consiliului General al Municipiului Bucuresti sunt prevazute in anexa nr. III.
    (4) Salariile de baza si indemnizatiile de conducere pentru functiile publice din aparatul propriu al consiliilor locale si al institutiilor din subordinea consiliilor judetene sau consiliilor locale sunt prevazute in anexa nr. IV.
    Art. 7
    (1) Pentru functionarii publici care ocupa o functie de conducere salariul de baza este cel corespunzator functiei de executie in care acesta este incadrat, la care se adauga o indemnizatie de conducere, care face parte din salariul de baza si care constituie baza de calcul pentru sporuri si alte drepturi care se acorda in raport cu salariul de baza, diferentiata in raport cu raspunderea functiei de conducere, cu marimea compartimentului condus, precum si cu ponderea activitatii de conducere fata de cea de executie.
    (2) Indemnizatia de conducere se stabileste la incadrarea in functie de catre ordonatorul de credite si este stabilita in procent fix din salariul de baza corespunzator functiei de executie, cu exceptia functiilor publice de conducere prevazute in anexele nr. I - IV, ale caror salarii de baza cuprind si indemnizatia de conducere.
    (3) Indemnizatia de conducere se acorda si functionarilor publici care conduc sau coordoneaza programe/proiecte, pe perioada de derulare a acestora, prevazute in programul de activitate al institutiei, stabilita de ordonatorul de credite, in raport de complexitatea programului/proiectului condus sau coordonat.
    Art. 8
    (1) Pentru rezultate deosebite obtinute in activitatea desfasurata ordonatorul de credite poate acorda, in limita a 20% din numarul total al functionarilor publici, prevazut in statul de functii, un salariu de merit lunar de pana la 15% din salariul de baza, care face parte din acesta si care constituie baza de calcul pentru sporuri si alte drepturi care se acorda in raport cu salariul de baza. Salariile de merit se vor acorda functionarilor publici incadrati pe functii de executie in proportie de doua treimi din numarul total stabilit in conditiile prezentului alineat. Ordonatorii principali de credite care au in subordine unitati bugetare cu un numar redus de posturi pot aproba ca incadrarea in numarul maxim de beneficiari de salariu de merit si in proportiile stabilite pentru functiile de executie sa se faca la nivelul unitatilor respective luate impreuna; repartizarea numarului de beneficiari de salariu de merit pe unitatile luate in calcul, in acest caz, se face de catre ordonatorul principal de credite.
    (2) Functionarii publici care beneficiaza de salariu de merit se stabilesc in fiecare an, dupa aprobarea bugetelor anuale, pe baza rezultatelor obtinute in activitatea desfasurata in perioada anterioara.
    (3) Pot beneficia de salarii de merit functionarii publici care nu au fost sanctionati disciplinar. Ordonatorii de credite pot stabili, cu avizul consultativ al comisiei paritare, criterii suplimentare pentru acordarea salariilor de merit.
    (4) Pentru functionarii publici nou-angajati salariul de merit se poate acorda dupa o perioada de cel putin 6 luni de la angajare.
    (5) Functionarii publici debutanti nu pot beneficia de salariu de merit pe perioada respectiva.
    Art. 9
    (1) Incadrarea pe o functie publica de executie sau de conducere, precum si avansarea in grad, clasa sau categorie, dupa caz, se fac potrivit prevederilor Legii nr. 188/1999, cu modificarile si completarile ulterioare, salariile de baza fiind cele din prezenta ordonanta de urgenta.
    (2) Pentru indeplinirea atributiilor ce revin unor posturi pe care sunt incadrati functionari publici si care devin temporar vacante, potrivit legii, pot fi angajate cu contract individual de munca, pe perioada determinata, alte persoane care indeplinesc conditiile prevazute de fisa postului.
    (3) Promovarea in conditiile legii a persoanelor incadrate pe functia de debutant, precum si a celor care au absolvit studii de nivel superior in specialitatea in care isi desfasoara activitatea se face prin transformarea postului pe care acestea sunt incadrate intr-un post de nivel superior.
    (4) Absolventii invatamantului superior de lunga sau de scurta durata, care, la data trecerii pe functia corespunzatoare studiilor absolvite, erau incadrati pe functii cu nivel de studii inferior, se incadreaza pe functia si categoria corespunzatoare studiilor absolvite, la clasa si gradul care sa asigure o crestere de pana la 20% a salariului de baza avut.
    (5) Posturile vacante aferente functiilor publice pot fi transformate in posturi de nivel inferior cu avizul Ministerului Administratiei Publice, prin Agentia Nationala a Functionarilor Publici, si al Ministerului Finantelor Publice. Fac exceptie de la aviz autoritatile prevazute la art. 101 din Legea nr. 188/1999 privind Statutul functionarilor publici, cu modificarile si completarile ulterioare.

    CAP. 3
    Sporuri

    Art. 10
    (1) Functionarii publici salarizati potrivit prezentei ordonante de urgenta beneficiaza, la functia de baza, de un spor de vechime in munca de pana la 25%, calculat la salariul de baza, corespunzator timpului lucrat in program normal de lucru, astfel:

    (2) Sporul corespunzator vechimii in munca se plateste cu incepere de la data de intai a lunii urmatoare celei in care s-a implinit vechimea in munca, prevazuta la transa respectiva.
    Art. 11
    Functionarii publici care, potrivit programului normal de lucru, isi desfasoara activitatea in timpul noptii, intre orele 22,00 si 6,00, beneficiaza, pentru orele lucrate in acest interval, de un spor pentru munca prestata in timpul noptii de 25% din salariul de baza, daca timpul astfel lucrat reprezinta cel putin jumatate din programul normal lunar de lucru.
    Art. 12
    (1) Orele prestate peste durata normala a timpului de lucru de functionarii publici incadrati in functii de executie se vor plati cu un spor din salariul de baza, astfel:
    a) 50% din salariul de baza pentru primele doua ore de depasire a duratei normale a zilei de lucru;
    b) 100% din salariul de baza pentru orele urmatoare. Cu spor de 100% se platesc si orele lucrate in zilele de repaus saptamanal sau in celelalte zile in care, in conformitate cu reglementarile in vigoare, nu se lucreaza.
    (2) Munca prestata potrivit alin. (1) poate fi compensata cu timp liber corespunzator, la cererea functionarului public, in conditiile in care orele nu au fost platite.
    (3) Munca peste durata normala a timpului de lucru poate fi prestata si sporurile prevazute la alin. (1) se pot plati numai daca efectuarea orelor suplimentare a fost dispusa in scris de seful ierarhic, fara a se depasi 120 de ore anual. In cazuri cu totul deosebite se poate aproba efectuarea orelor suplimentare si peste acest plafon, dar nu mai mult de 360 de ore anual, cu aprobarea ordonatorului de credite si cu avizul organizatiilor sindicale reprezentative la nivel de unitate sau, dupa caz, cu avizul reprezentantilor functionarilor publici, acolo unde nu sunt astfel de organizatii sindicale.
    Art. 13
    Functionarii publici care poseda titlul stiintific de "doctor" beneficiaza de un spor pentru titlul stiintific de 15% din salariul de baza, daca isi desfasoara activitatea in domeniul pentru care poseda titlul stiintific respectiv.
    Art. 14
    (1) De la data intrarii in vigoare a prezentei ordonante de urgenta sporul de confidentialitate prevazut de reglementarile in vigoare se acorda numai pentru personalul din cadrul Administratiei Prezidentiale, Oficiului Registrului National al Informatiilor Secrete de Stat, Consiliului National pentru Studierea Arhivelor Securitatii, Ministerului Afacerilor Externe si Departamentului de Comert Exterior.
    (2) Categoriile de personal, cuantumurile sporului de confidentialitate, in limitele prevazute de lege si conditiile de acordare se stabilesc, cu incadrarea in cheltuielile de personal prevazute in bugetul aprobat, prin ordin al ordonatorului principal de credite.

    CAP. 4
    Premii

    Art. 15
    (1) Ordonatorii de credite pot acorda premii lunare in limita a 10% din cheltuielile cu salariile aferente functiilor publice, cu incadrarea in fondurile aprobate anual prin buget cu aceasta destinatie. Premiile se pot acorda in cursul anului functionarilor publici care au realizat sau au participat direct la obtinerea unor rezultate in activitate, apreciate ca valoroase. Sumele neconsumate pot fi utilizate in lunile urmatoare, in cadrul aceluiasi an bugetar.
    (2) In cazurile in care se realizeaza economii prin reducerea cheltuielilor cu salariile, ordonatorii principali de credite pot aproba acordarea de premii in cursul anului din economiile realizate, in limita a 5% din cheltuielile cu salariile aferente functiilor publice prevazute in bugetul aprobat, pentru functionarii publici din aparatul propriu si din unitatile subordonate, fara a depasi valoarea economiilor realizate.
    (3) Premiile individuale se stabilesc de catre ordonatorii de credite, in limita sumelor alocate cu aceasta destinatie de catre ordonatorii principali de credite, cu avizul organizatiilor sindicale reprezentative la nivel de unitate sau, dupa caz, cu avizul reprezentantilor functionarilor publici, acolo unde nu sunt astfel de organizatii sindicale.
    Art. 16
    (1) Pentru activitatea desfasurata functionarii publici beneficiaza de un premiu anual egal cu salariul mediu lunar de baza, realizat in anul pentru care se face premierea.
    (2) Pentru functionarii publici care nu au lucrat tot timpul anului premiul se acorda proportional cu perioada in care au lucrat, luandu-se in calcul media salariilor de baza lunare, realizate in perioada in care au desfasurat activitate, raportata la perioada intregului an.
    (3) Plata premiului anual se va face pentru toti functionarii publici salarizati potrivit prezentei ordonante de urgenta, incepand cu luna ianuarie a anului urmator.
    (4) Ordonatorii de credite pot reduce sau anula premiul anual in cazul functionarilor publici care in cursul anului au fost sanctionati disciplinar.
    Art. 17
    Autoritatile si institutiile publice care, potrivit legii, au dreptul sa procedeze la confiscarea si valorificarea de bunuri sau sa aplice si sa incaseze penalitati pot constitui un fond de stimulare a functionarilor publici in limitele prevazute de dispozitiile legale in vigoare. Modul de constituire din fiecare sursa si conditiile de utilizare a fondului se stabilesc prin hotarare a Guvernului. Stabilirea stimulentelor individuale se va face cu avizul organizatiilor sindicale reprezentative la nivel de unitate sau, dupa caz, cu avizul reprezentantilor functionarilor publici, acolo unde nu sunt astfel de organizatii sindicale.

    CAP. 5
    Alte drepturi

    Art. 18
    Pe perioada in care functionarii publici sunt trimisi in delegare in alte localitati decat cea in care isi desfasoara activitatea, autoritatile sau institutiile publice le acorda indemnizatii de delegare si le deconteaza cheltuielile de transport si de cazare, in conditiile stabilite pentru personalul din institutiile publice.
    Art. 19
    (1) Functionarii publici numiti temporar intr-o functie publica de conducere pe o perioada mai mare de 30 de zile calendaristice primesc pe langa salariul de baza al functiei de executie in care sunt incadrati si indemnizatia corespunzatoare functiei publice de conducere pe care o preiau.
    (2) Functionarii publici pot fi numiti temporar intr-o functie publica de conducere, potrivit alin. (1), numai pana la ocuparea acesteia prin concurs, potrivit legii.
    (3) Prevederile prezentului articol se aplica, in mod corespunzator, persoanelor angajate cu contract individual de munca potrivit art. 9 alin. (2).
    Art. 20
    (1) Pe durata delegarii, detasarii sau trecerii temporare intr-o alta activitate functionarii publici in cauza isi pastreaza functia, clasa si gradul avute anterior.
    (2) Cand detasarea sau trecerea temporara in alta activitate se face pe o functie publica la care este stabilit un salariu de baza mai mare, functionarii publici detasati sau trecuti temporar in alta activitate au dreptul la acest salariu in conditiile prevazute de lege.
    (3) Pe perioada detasarii sau trecerii temporare in alta activitate functionarii publici primesc, pe langa salariul de baza stabilit potrivit alin. (1) si (2), si celelalte drepturi ce se acorda personalului din autoritatea sau institutia publica respectiva.
    (4) Drepturile ce se acorda pe timpul detasarii sau trecerii temporare in alta activitate se suporta de catre autoritatea, institutia publica sau unitatea unde functionarul public respectiv isi desfasoara activitatea.
    Art. 21
    (1) Functionarul public mutat, in cadrul aceleiasi autoritati, institutii publice sau unitati, in alta localitate are dreptul la:
    a) rambursarea costului transportului pentru el si membrii familiei sale, precum si pentru bunurile din gospodaria sa;
    b) plata unei indemnizatii egale cu salariul de baza net din ultima luna;
    c) un concediu platit de 5 zile lucratoare, in vederea mutarii efective, acordat la cererea sa.
    (2) Mutarea in alta localitate se va putea face, in toate cazurile, numai cu asigurarea unei locuinte de serviciu, in conditiile legii.
    (3) De drepturile prevazute la alin. (1) beneficiaza si functionarii publici care solicita sa fie transferati in alta unitate situata intr-o localitate diferita decat cea de domiciliu, daca in cererea de transfer s-a facut aceasta mentiune.
    (4) Plata drepturilor respective se suporta de catre autoritatea sau institutia publica la care se face transferul.
    Art. 22
    (1) La incadrarea intr-o autoritate, institutie publica sau unitate din alta localitate decat cea de domiciliu, in primul an de activitate dupa absolvirea studiilor functionarii publici beneficiaza de o indemnizatie de instalare egala cu un salariu de baza corespunzator functiei de debutant in care urmeaza sa fie incadrati.
    (2) Indemnizatia de instalare poate fi egala cu doua salarii de baza pentru acele localitati unde atragerea specialistilor se face cu mare greutate. Lista localitatilor respective se aproba prin hotarare a Guvernului, la propunerea Ministerului Administratiei Publice, dupa consultarea organizatiilor sindicale din administratia publica.
    (3) Functionarii publici care au beneficiat de indemnizatia de instalare si care ulterior au demisionat sau au incetat raporturile de munca din motive imputabile lor inainte de implinirea unui an de la instalare vor restitui, in conditiile legii, indemnizatia primita, calculata proportional cu perioada ramasa pana la expirarea termenului de un an.
    Art. 23
    Functionarii publici au dreptul la concediu de odihna si la alte concedii, in conditiile legii.
    Art. 24
    (1) In cazul in care conducatorul autoritatii sau institutiei publice apreciaza ca studiile sunt utile autoritatii sau institutiei publice in care functionarul public isi desfasoara activitatea, pe perioada concediului de studii acordat, in limita a 30 de zile lucratoare anual din acesta, functionarului public respectiv i se platesc salariul de baza corespunzator functiei indeplinite si, dupa caz, sporul de vechime.
    (2) Functionarii publici care urmeaza o forma de specializare sau perfectionare pe o durata mai mare de 1 luna, dar nu mai mult de 1 an, si primesc pe aceasta perioada drepturile salariale, sunt obligati sa se angajeze in scris ca vor lucra de la 1 la 5 ani in autoritatea sau institutia publica respectiva. In cazul nerespectarii angajamentului acestia vor restitui autoritatii sau institutiei publice drepturile salariale primite pe perioada cursurilor de specializare sau perfectionare, proportional cu timpul ramas pana la implinirea termenului, precum si celelalte drepturi acordate, pe aceeasi perioada, de autoritatea sau institutia publica trimitatoare, cu exceptia cazului in care functionarii publici respectivi nu mai detin functiile publice din motive neimputabile acestora sau in cazul transferului in interesul serviciului. Prevederile prezentului alineat se aplica si in situatia prevazuta la alin. (1).
    (3) In afara concediului de odihna functionarii publici au dreptul, in conditiile legii, la zile de concediu platit in cazul urmatoarelor evenimente familiale deosebite:
    a) casatoria functionarului public - 5 zile lucratoare;
    b) nasterea sau casatoria unui copil - 3 zile lucratoare;
    c) decesul sotului sau al unei rude ori afin pana la gradul III inclusiv al functionarului public - 3 zile lucratoare.

    CAP. 6
    Dispozitii tranzitorii si finale

    Art. 25
    (1) In anul 2003 salariile de baza pentru functionarii publici incadrati pe functii, categorii, clase si grade sunt cele prevazute in anexele la prezenta ordonanta de urgenta.
    (2) Nivelurile salariilor de baza prevazute in anexe sunt cele corespunzatoare pentru lunile octombrie - decembrie 2003. In perioada ianuarie - septembrie 2003 functionarii publici vor beneficia de 38% din suma aferenta cresterii totale a salariilor de baza, calculata ca diferenta intre salariile de baza cuvenite incepand cu luna octombrie 2003, stabilite potrivit alin. (1), si salariile de baza avute in luna decembrie 2002. In situatia in care pentru luna ianuarie 2003 suma astfel determinata conduce la un salariu de baza mai mic decat salariul de baza minim brut pe tara, se va acorda valoarea acestuia.
    (3) Salariile de baza calculate pentru prima etapa de majorare potrivit prevederilor alin. (2) vor fi rotunjite din 1.000 in 1.000 de lei in favoarea salariatului.
    (4) Functionarii publici care in luna decembrie 2002 au un salariu de baza mai mare decat cel stabilit potrivit alin. (1) isi mentin in continuare salariile de baza avute.
    (5) Pentru functionarii publici care se incadreaza in autoritati sau institutii publice in perioada 1 ianuarie 2003 - 30 septembrie 2003 salariile de baza se vor stabili astfel: procentul de crestere de 38% se aplica asupra diferentei dintre salariul de baza pentru functia respectiva, prevazut in anexele la prezenta ordonanta de urgenta, si salariul de baza, la limita maxima, pentru aceeasi functie, stabilit potrivit reglementarilor in vigoare, pentru luna decembrie 2002.
    Art. 26
    (1) Solutionarea contestatiilor in legatura cu stabilirea salariilor de baza, sporurilor, premiilor si a altor drepturi care se acorda potrivit prevederilor prezentei ordonante de urgenta este de competenta ordonatorilor de credite.
    (2) Contestatiile vor fi depuse in termen de 5 zile de la data luarii la cunostinta de actul administrativ de stabilire a salariului.
    (3) Ordonatorii de credite vor solutiona contestatiile in termen de 10 zile, cu avizul organizatiilor sindicale reprezentative la nivel de unitate sau, dupa caz, cu avizul reprezentantilor functionarilor publici, acolo unde nu sunt astfel de organizatii sindicale.
    (4) Impotriva masurilor dispuse potrivit prevederilor alin. (1) functionarul public se poate adresa instantei de contencios administrativ, potrivit legii, in termen de 30 de zile de la data comunicarii solutionarii contestatiei.
    Art. 27
    Salariile de baza prevazute in prezenta ordonanta de urgenta sunt brute, impozabile, potrivit legii, si includ majorarea de pana la 8,29%, acordata potrivit Hotararii Guvernului nr. 403/2001 pentru aprobarea Normelor metodologice de aplicare a prevederilor art. 183 din Legea nr. 19/2000 privind sistemul public de pensii si alte drepturi de asigurari sociale.
    Art. 28
    Anexele nr. I - IV*) fac parte integranta din prezenta ordonanta de urgenta.

    Art. 29
    (1) Prevederile prezentei ordonante de urgenta intra in vigoare la data de 1 ianuarie 2003.
    (2) Dispozitiile Ordonantei de urgenta a Guvernului nr. 291/2000 privind organizarea si functionarea unor ministere, aprobata cu modificari prin Legea nr. 308/2001, referitoare la salarizarea personalului din aparatul propriu al unor ministere se aplica, in mod corespunzator, si in anul 2003.
    (3) Pana la intrarea in vigoare a hotararii Guvernului prevazute la art. 17 raman aplicabile reglementarile existente privind constituirea si conditiile de utilizare a fondurilor pentru stimularea personalului.

    NOTA:
    1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de salariile prevazute la punctele 1, 3, 6 si 7 la cap. B din prezenta anexa.
    2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, cu modificarile si completarile ulterioare, beneficiaza si de sporurile si alte drepturi specifice reglementate prin Statutul personalului vamal si alte dispozitii legale in vigoare.

    ANEXA 3

    NOTA:

    2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, cu modificarile si completarile ulterioare, beneficiaza si de sporurile si alte drepturi specifice reglementate prin Statutul personalului vamal si alte dispozitii legale in vigoare.
    3. Personalul de executie din trezorerii beneficiaza de un spor pentru conditii deosebite de munca de 10% din salariul de baza.
