    In vederea aplicarii unitare a dispozitiilor art. 102 alin. (2) din Legea nr. 70/1991*), republicata, referitor la modul in care voteaza persoanele detinute in baza unui mandat de arestare preventiva sau aflate in executarea unei sanctiuni contraventionale privative de libertate,

    HOTARASTE:
    Cu majoritate de voturi:
    Persoanele detinute in baza unui mandat de arestare preventiva sau aflate in executarea unei sanctiuni contraventionale privative de libertate isi exercita dreptul de vot in conditiile art. 69 din lege, deci in masura in care sunt cuprinse in listele electorale ale localitatilor sau ale diviziunilor administrativ-teritoriale in care se afla locul de detentie. Cu opinia separata a judecatorilor Dumitru Gazetovici, Emil Ghergut si Gheorghe Toader, in sensul ca persoanele din categoria sus-aratata isi exercita dreptul de vot la sediul locului de detinere, pe baza listelor speciale intocmite de comandantul acestuia, in conditiile prevazute de art. 69 din lege privind urna speciala, si voteaza pentru consiliul local, consiliul judetean si pentru primarul localitatii in care se afla locul de detinere.

    Prezenta hotarare va fi publicata in Monitorul Oficial al Romaniei, conform art. 30 alin. (5) din Legea nr. 70/1991.
    Pronuntata astazi, 28 mai 1996.
