Având în vedere prevederile art. 49 alin. (2) din Legea nr. 571/2003 privind Codul fiscal, cu modificările şi completările ulterioare, şi ale Hotărârii Guvernului nr. 656/1997 privind aprobarea Clasificării activităţilor din economia naţională - CAEN, cu modificările ulterioare,în temeiul art. 10 alin. (4) din Hotărârea Guvernului nr. 34/2009 privind organizarea şi funcţionarea Ministerului Finanţelor Publice, cu modificările şi completările ulterioare,ministrul finanţelor publice emite următorul ordin: Articolul I În Nomenclatorul activităţilor independente pentru care venitul net se poate determina pe baza normelor anuale de venit, activităţi desfăşurate de contribuabilii care realizează venituri comerciale, aprobat prin Ordinul ministrului finanţelor publice nr. 2.875/2011, publicat în Monitorul Oficial al României, Partea I, nr. 871 din 9 decembrie 2011, după poziţia 119 se introduce o nouă poziţie, poziţia 1191 , cu următorul cuprins:

„1191 Servicii executate în domeniul informaticii, altele decât cele care generează drepturi de autor sau drepturi conexe drepturilor de autor - 6202: Activităţi de consultanţă în tehnologia informaţiei - 6203: Activităţi de management (gestiune şi exploatare) al mijloacelor de calcul“

Articolul IIPentru activitatea care generează venituri comerciale din executarea unor servicii în domeniul informaticii, venitul net se poate determina pe baza normelor anuale de venit. Articolul IIIDirecţiile generale ale finanţelor publice judeţene, respectiv a municipiului Bucureşti vor lua măsuri pentru ducerea la îndeplinire a prezentului ordin, vor stabili nivelul normelor de venit şi vor asigura publicarea acestora anual, în cursul trimestrului IV al anului anterior celui în care urmează a se aplica. Articolul IVPrezentul ordin se publică în Monitorul Oficial al României, Partea I. Ministrul finanţelor publice, Gheorghe Ialomiţianu
