privind accesul la resursele acvatice vii in vederea practicarii pescuitului

ACT EMIS DE: MINISTERUL AGRICULTURII, PADURILOR SI DEZVOLTARII RURALE

    In baza:
    - Referatului de aprobare nr. 2.259 din 20 octombrie 2005;
    - prevederilor art. 7^3 lit. e), art. 8 alin. (1), art. 12^1, art. 14, art. 16 alin. (1), (2), (4) si (5), ale art. 21 alin. (1) si (2) din Legea nr. 192/2001 privind resursele acvatice vii, pescuitul si acvacultura, republicata, cu modificarile si completarile ulterioare;
    - prevederilor Hotararii Guvernului nr. 155/2005 privind organizarea si functionarea Ministerului Agriculturii, Padurilor si Dezvoltarii Rurale, cu modificarile si completarile ulterioare,

    ministrul agriculturii, padurilor si dezvoltarii rurale emite prezentul ordin.

    Art. 1
    Accesul la resursele acvatice vii in vederea practicarii pescuitului se face in baza permisului de pescuit in zona solicitata.
    Art. 2
    Permisul de pescuit este un document cu regim special, tiparit de Compania Nationala de Administrare a Fondului Piscicol si eliberat de gestionarii resurselor acvatice vii.
    Art. 3
    Permisul de pescuit este nominal si netransmisibil.
    Art. 4
    (1) Permisul de pescuit poate fi:
    a) permis de pescuit comercial pentru pescar profesionist - valabil 10 ani;
    b) permis de pescuit recreativ/sportiv pentru pescar sportiv - valabil un an.
    (2) Modelul si continutul permiselor de pescuit sunt prezentate in anexa nr. 1.
    Art. 5
    Pentru dobandirea permisului de pescuit comercial sunt necesare urmatoarele documente:
    - cerere-tip, conform modelului prevazut in anexa nr. 2;
    - copie de pe actul de identitate;
    - cazier judiciar/declaratie pe propria raspundere din care sa rezulte ca solicitantul nu a fost condamnat pentru infractiuni prevazute in Legea nr. 192/2001, cu modificarile si completarile ulterioare;
    - certificatul de inregistrare/dovada de membru al asociatiei/organizatiei/documentul de atestare profesionala.
    Art. 6
    (1) Pentru dobandirea permisului de pescuit recreativ/sportiv este necesara dovada calitatii de membru al unei asociatii de pescari sportivi legal constituite.
    (2) Eliberarea permisului de pescuit recreativ/sportiv se face de catre asociatia de pescari sportivi, in baza contractului incheiat cu gestionarii resurselor acvatice vii.
    Art. 7
    (1) Detinatorii de permis de pescuit pot pescui in scop recreativ/sportiv in orice bazin piscicol natural de pe teritoriul Romaniei in baza unei viniete speciale emise de Compania Nationala de Administrare a Fondului Piscicol, aplicata pe permis.
    (2) Modelul si continutul vinietei sunt prezentate in anexa nr. 3.
    Art. 8
    (1) Gestionarul resursei acvatice vii poate suspenda permisul de pescuit pe o perioada de 30 de zile in cazul in care exista un litigiu declarat.
    (2) Agentia Nationala pentru Pescuit si Acvacultura poate anula permisul de pescuit la propunerea personalului propriu cu drept de control, a gestionarilor, precum si a altor institutii abilitate cu drept de control.
    Art. 9
    La data intrarii in vigoare a prezentului ordin se abroga:
    - anexele nr. 6 si 7 la Ordinul ministrului agriculturii, alimentatiei si padurilor nr. 350/2001 pentru aprobarea continutului si modelelor autorizatiilor de pescuit in scop comercial, recreativ/sportiv si stiintific, precum si a permiselor de pescuit individuale, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 617 din 1 octombrie 2001;
    - art. 6 si anexa nr. 2 la Ordinul ministrului agriculturii, padurilor si dezvoltarii rurale nr. 430/2005 privind acordarea dreptului de pescuit in scop recreativ/sportiv in bazinele piscicole naturale, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 506 din 15 iunie 2005, precum si orice alte prevederi contrare prezentului ordin.
    Art. 10
    Anexele nr. 1 - 3 fac parte integranta din prezentul ordin.
    Art. 11
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I.
