privind infiintarea Universitatii "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi

    Parlamentul Romaniei adopta prezenta lege.

    Art. 1
    Se infiinteaza Universitatea "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi, ca institutie de invatamant superior, persoana juridica de drept privat si de utilitate publica, parte a sistemului national de invatamant, cu sediul in municipiul Iasi, str. Balusescu nr. 2, judetul Iasi.
    Art. 2
    Universitatea "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi, se infiinteaza cu urmatoarea facultate si specializare acreditate: Facultatea de Drept, specializarea Drept, cu predare in limba romana.
    Art. 3
    Dupa intrarea in vigoare a prezentei legi, in structura universitatii infiintate potrivit art. 1 intra si facultatile si specializarile, altele decat cele mentionate la art. 2, acreditate sau autorizate sa functioneze provizoriu prin hotarare a Guvernului, conform legii.
    Art. 4
    Personalul didactic si nedidactic din institutia care a fost autorizata sa functioneze provizoriu se preia prin transfer in interesul serviciului la institutia nou-infiintata, incepand cu data intrarii in vigoare a prezentei legi.
    Art. 5
    (1) Universitatea infiintata potrivit art. 1 dispune de patrimoniu propriu, inscris in anexa care face parte integranta din prezenta lege.
    (2) Patrimoniul prevazut in anexa este proprietatea Universitatii "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi, prin efectul legii.
    Art. 6
    (1) Patrimoniul Universitatii "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi, ramane si va fi utilizat numai in cadrul sistemului national de invatamant. In cazul nerespectarii acestei prevederi, Ministerul Educatiei si Cercetarii va propune incetarea activitatii de invatamant si desfiintarea prin lege a universitatii.
    (2) In cazul desfiintarii Universitatii "Mihail Kogalniceanu" din municipiul Iasi, judetul Iasi, destinatia patrimoniului se stabileste prin lege, numai in interesul invatamantului.
    Art. 7
    Cheltuielile privind functionarea universitatii se suporta din veniturile proprii, dobandite in conditiile legii, precum si din alte surse legale.
    Art. 8
    Pentru a se asigura respectarea standardelor legale de calitate, specifice invatamantului superior, institutia prevazuta la art. 1 este special monitorizata, pe o perioada de 3 ani, conform metodologiei elaborate de Ministerul Educatiei si Cercetarii si publicate in Monitorul Oficial al Romaniei, Partea I.

    Aceasta lege a fost adoptata de Parlamentul Romaniei, cu respectarea prevederilor art. 75 si ale art. 76 alin. (2) din Constitutia Romaniei, republicata.
