HOTARARE Nr. 512 din 7 aprilie 2004
privind modificarea si completarea Hotararii Guvernului nr. 1.197/2002 pentru
aprobarea Normelor privind materialele si obiectele care vin in contact cu
alimentele
ACT EMIS DE: GUVERNUL ROMANIEI
ACT PUBLICAT IN: MONITORUL OFICIAL NR. 375 din 29 aprilie 2004
In temeiul art. 108 din Constitutia Romaniei, republicata,
Guvernul Romaniei adopta prezenta hotarare.
Art. 1
Hotararea Guvernului nr. 1.197/2002 pentru aprobarea Normelor privind
materialele si obiectele care vin in contact cu alimentele, publicata in
Monitorul Oficial al Romaniei, Partea I, nr. 883 din 7 decembrie 2002, se
modifica si se completeaza dupa cum urmeaza:
1. La alineatul (1) al articolului 3, litera b) va avea urmatorul cuprins:
"b) nerespectarea prevederilor art. 12 alin. (1), art. 13 alin. (1) si
(1^1), art. 14, art. 23, art. 30 si ale art. 33 din anexa, cu amenda de la
5.000.000 lei la 30.000.000 lei;"
2. Dupa articolul 5 se introduce un nou articol, articolul 6, cu urmatorul
cuprins:
"Art. 6
Prezenta hotarare transpune Directiva 89/109/CEE referitoare la materialele
si obiectele care vin in contact cu alimentele, Directiva 78/142/CEE
referitoare la materialele si obiectele care contin monomerul clorura de vinil
si care vin in contact cu alimentele, amendata prin Directiva 81/432/CEE,
Directiva 80/766/CEE care stabileste metoda de analiza comunitara pentru
controlul oficial al nivelului monomerului de clorura de vinil in materialele
si obiectele care vin in contact cu alimentele, Directiva 81/432/CEE privind
metodele de analiza a clorurii de vinil eliberate in alimente de materiale si
obiecte, Directiva 82/711/CEE care stabileste regulile fundamentale necesare
pentru testarea migrarii constituentilor materialelor si obiectelor din
material plastic care vin in contact cu alimentele, amendata prin directivele
85/572/CEE, 93/8/CEE si 97/48/CEE, Directiva 85/572/CEE privind stabilirea
listei de simulanti utilizati pentru testarea migrarii constituentilor
materialelor si obiectelor din material plastic care vin in contact cu
alimentele, Directiva 84/500/CEE privind obiectele din ceramica care vin in
contact cu alimentele, Directiva 93/10/CEE privind materialele si articolele in
contact cu alimentul produse din celuloza regenerata, Directiva 93/11/CEE
privind eliberarea de N-nitrozamine, Directiva 80/590/CEE privind determinarea
simbolurilor care pot insoti materialele si obiectele care intra in contact cu
alimentele si Directiva 2002/72/CE privind materialele si obiectele din
material plastic care vin in contact cu alimentele."
3. Alineatul (2) al articolului 10 din anexa va avea urmatorul cuprins:
"(2) In sensul prezentului capitol, materiale plastice inseamna
compusii organici macromoleculari obtinuti prin polimerizare, policondensare,
poliaditie sau prin orice alt proces similar din molecule cu greutate
moleculara redusa sau prin transformare chimica a macromoleculelor naturale. La
astfel de compusi macromoleculari pot fi adaugate alte substante sau
materii."
4. La alineatul (3) al articolului 10 din anexa, dupa litera e) se
introduce litera f) cu urmatorul cuprins:
"f) siliconi."
5. Litera b) a alineatului (2) al articolului 12 din anexa se abroga.
6. Alineatul (1) al articolului 13 din anexa va avea urmatorul cuprins:
"Art. 13
(1) Lista aditivilor care se pot utiliza la fabricarea materialelor si
obiectelor din material plastic, impreuna cu restrictiile aferente utilizarii
acestora, este prevazuta in sectiunile A si B din anexa nr. 3."
7. Dupa alineatul (1) al articolului 13 din anexa se introduce un nou
alineat, alineatul (1^1), cu urmatorul cuprins:
"(1^1) Pentru substantele prevazute in sectiunea B din anexa nr. 3,
limitele de migrare specifica se aplica de la data de 1 ianuarie 2005, cand
verificarea conformitatii se realizeaza cu simulant D sau cand se utilizeaza
media testelor de substituire asa cum este indicat la pct. 2 din anexa nr.
8."
8. Articolul 15 din anexa va avea urmatorul cuprins:
"Art. 15
(1) Specificatiile generale referitoare la materialele si obiectele din
material plastic sunt indicate in partea A din anexa nr. 5. Alte specificatii
referitoare la unele substante prevazute in anexele nr. 2, 3 si 4 sunt prevazute
in partea B din anexa nr. 5.
(2) Semnificatia numerelor din paranteze prevazute in coloana
<<Restrictii si/sau specificatii>> este explicata in anexa nr.
6."
9. Dupa alineatul (3) al articolului 17 din anexa se introduc doua noi
alineate, alineatele (4) si (5), cu urmatorul cuprins:
"(4) Verificarea incadrarii in limitele de migrare specifica prevazuta
la alin. (1) poate fi asigurata prin determinarea cantitatii de substanta in
materialul sau obiectul finit, indicandu-se ca s-a stabilit o relatie intre
cantitatea si valoarea migrarii specifice a substantei, fie printr-o evaluare
experimentala adecvata, fie prin aplicarea unor modele de difuzie general
recunoscute, bazate pe dovezi stiintifice.
(5) Pentru a se demonstra neconformitatea unui material sau obiect, este
obligatorie confirmarea valorii estimate de migrare prin testare
experimentala."
10. Anexele nr. 2, 3, 5 si 6 la normele prevazute in anexa se modifica si
se inlocuiesc cu anexele nr. 1, 2, 3 si 4 care fac parte integranta din
prezenta hotarare.
Art. 2
Hotararea Guvernului nr. 1.197/2002, cu modificarile si completarile aduse
prin prezenta hotarare, se va republica in Monitorul Oficial al Romaniei,
Partea I, dandu-se textelor o noua numerotare.

LISTA
de monomeri si alte materii prime care pot fi folosite la producerea
materialelor si obiectelor din material plastic
Introducere
1. Prezenta anexa contine lista de monomeri sau alte materii prime. Aceasta
lista include:
a) substantele care sufera procese de polimerizare, care includ
policondensarea, poliaditia sau oricare alt proces similar, pentru producerea
macromoleculelor;
b) substante macromoleculare naturale sau sintetice folosite la producerea
macromoleculelor modificate, daca monomerii sau materiile prime necesare pentru
sintetizarea acestora nu sunt incluse pe lista;
c) substante folosite pentru modificarea substantelor macromoleculare
naturale sau sintetice existente.
2. Lista nu include sarurile (inclusiv sarurile duble si sarurile acide) de
aluminiu, amoniu, calciu, fier, magneziu, potasiu, sodiu si zinc ale acizilor
autorizati, fenolii sau alcoolii care sunt, de asemenea, autorizati. Totusi,
denumiri care contin "... acid (acizi), saruri" apar in lista daca nu
sunt mentionati acizii liberi corespondenti. In aceste cazuri intelesul
termenului "saruri" este "saruri de aluminiu, amoniu, calciu,
fier, magneziu, potasiu, sodiu si zinc".
3. Lista nu include nici urmatoarele substante, desi acestea pot fi
prezente:
a) substante care pot fi prezente in produsul finit ca: impuritati in
substantele folosite, intermediari de reactie sau produse de descompunere;
b) oligomeri si substante macromoleculare naturale sau sintetice, precum si
amestecurile lor, daca monomerii sau materiile prime necesare pentru
sintetizarea acestora sunt incluse pe lista;
c) amestecuri ale substantelor autorizate.
Materialele si obiectele care contin substantele indicate la lit. a), b) si
c) vor fi in conformitate cu cerintele stipulate in art. 2 din norme.
4. Substantele trebuie sa corespunda criteriilor de puritate.
5. Lista contine urmatoarele informatii:
- coloana 1 - MA/REF. nr.: numarul de referinta al materialului de ambalare
al CEE de pe lista;
- coloana 2 - CAS nr.: numarul de registru CAS (Chemical Abstracts
Service);
- coloana 3 - Denumirea: denumirea chimica;
- coloana 4 - Restrictii si/sau specificatii. Acestea pot include:
a) limita de migrare specifica (LMS);
b) cantitatea maxima permisa de substanta in materialul sau obiectul final
(CM);
c) cantitatea maxima permisa de substanta in materialul sau obiectul final,
exprimata ca mg per 6 dm^2 din suprafata in contact cu alimentele (CMA);
d) orice alte restrictii mentionate expres;
e) orice tip de specificatii referitoare la substanta sau la polimer.
6. Daca o substanta apare pe lista ca un compus individual, va fi, de
asemenea, exprimata printr-un termen generic, iar restrictiile care se aplica
acestei substante vor fi cele indicate pentru acest compus individual.
7. In cazul in care exista vreo neconcordanta intre numarul CAS si
denumirea chimica, denumirea chimica va avea prioritate fata de numarul CAS.
Daca exista vreo neconcordanta intre numarul CAS raportat in Einecs si
registrul CAS, se va aplica numarul CAS din registrul CAS.
8. In coloana 4 a tabelului sunt folosite abrevieri sau expresii care au
urmatorul inteles:
LD = limita de detectie a metodei de analiza;
PF = materialul sau obiectul in stare finita;
NCO = grupari de izocianati;
ND = nedetectabila. In sensul prezentelor norme, nedetectabila inseamna ca
substanta nu trebuie sa fie detectata prin folosirea unei metode de analiza
validata. Daca in prezent nu exista o astfel de metoda, pentru limita de
detectie se va folosi o metoda analitica cu caracteristici de performanta
adecvate;
CM = cantitatea maxima permisa de substanta "reziduu" in material
sau obiect;
CM(T) = cantitatea maxima permisa de substanta "reziduu" in material
sau obiect, exprimata ca total de grupari sau substanta/substante
indicata/indicate. In sensul prezentelor norme, CM(T) reprezinta cantitatea
maxima permisa de substanta "reziduu" in material sau obiect,
determinata prin folosirea unei metode de analiza validate la limita
specificata. Daca o astfel de metoda nu exista, se va folosi o metoda de
analiza adecvata;
CMA = cantitatea maxima permisa a substantei "reziduale" in
materialul sau obiectul finit, exprimata ca mg per 6 dm^2 de suprafata in contact
cu alimentul. In contextul prezentelor norme, cantitatea de substanta din
suprafata materialului sau obiectului trebuie determinata printr-o metoda
validata de analiza. Daca o astfel de metoda nu este disponibila, va putea fi
folosita o metoda analitica cu caracteristici de performanta adecvate limitei
de detectie, pana cand se va pune la punct o metoda validata;
CMA(T) = cantitatea maxima permisa de substanta "reziduala" din
material sau obiect, exprimata ca mg de total de grupari sau substanta/substante
raportata/raportate la 6 dm^2 din suprafata in contact cu alimentul. In
contextul prezentelor norme, cantitatea de substanta din suprafata materialului
sau obiectului trebuie determinata printr-o metoda validata de analiza. Daca o
astfel de metoda nu este disponibila, va putea fi folosita o metoda analitica
cu caracteristici de performanta adecvate limitei de detectie, pana cand se va
pune la punct o metoda validata;
LMS = limita de migrare specifica in alimente sau simulant alimentar, numai
daca nu este altfel specificat. In sensul prezentelor norme, LMS reprezinta
migrarea specifica a substantei, determinata prin folosirea unei metode de
analiza validate pentru limita specificata. Daca in prezent nu exista o astfel
de metoda, se va folosi o metoda analitica cu caracteristici de performanta
adecvate;
LMS(T) = limita de migrare specifica in alimente sau simulant alimentar,
exprimata ca total de grupari sau substanta/substante indicata/indicate. In
sensul prezentelor norme, LMS(T) reprezinta migrarea specifica a substantelor,
determinata prin folosirea unei metode de analiza validate pentru limita
specificata. Daca in prezent nu exista o astfel de metoda, se va folosi o
metoda analitica cu caracteristici de performanta adecvate.

ANEXA 2
(anexa nr. 3 la norme)
LISTA
de aditivi care pot fi utilizati la producerea materialelor si obiectelor din
material plastic
Introducere
1. Prezenta anexa contine lista:
a) substantelor care sunt incorporate in materialele plastice pentru a se
obtine caracteristicile tehnice in produsul finit si care raman in produsul
finit;
b) substantelor utilizate ca mediu adecvat pentru procesul de polimerizare,
de exemplu: emulgatori, agenti tensioactivi, agenti tampon etc.
Lista nu include substantele care influenteaza in mod direct formarea
polimerilor, de exemplu catalizatorii.
2. Lista nu include sarurile, inclusiv sarurile duble si sarurile acide de
aluminiu, amoniu, calciu, fier, magneziu, potasiu, sodiu si zinc ale acizilor
autorizati, fenolii sau alcoolii care sunt, de asemenea, autorizati. Totusi,
denumiri care contin "...acid (acizi), saruri" apar in lista daca nu
sunt mentionati acizii liberi corespondenti. In aceste cazuri intelesul
termenului "saruri" este "saruri de aluminiu, amoniu, calciu,
fier, magneziu, potasiu, sodiu si zinc".
3. Lista nu include nici urmatoarele substante, desi acestea pot fi
prezente:
a) substante care pot fi prezente in produsul finit ca: impuritati in
substantele folosite, intermediari de reactie sau produse de descompunere;
b) amestecuri ale substantelor autorizate.
Materialele si obiectele care contin substantele indicate la lit. a) si b)
vor fi in conformitate cu cerintele stipulate in art. 2 din norme.
4. Substantele vor avea o calitate tehnica buna in ceea ce priveste
criteriile de puritate.
5. Lista contine urmatoarele informatii:
- coloana 1 - MA/REF. nr.: numarul de referinta al materialului de ambalare
al CEE de pe lista;
- coloana 2 - CAS nr.: numarul de registru CAS (Chemical Abstracts
Service);
- coloana 3 - Denumirea: denumirea chimica;
- coloana 4 - Restrictii si/sau specificatii. Acestea pot include:
a) limita de migrare specifica LMS;
b) cantitatea maxima permisa de substanta in materialul sau obiectul final
CM;
c) cantitatea maxima permisa de substanta in materialul sau obiectul final,
exprimata ca mg per 6 dm^2 din suprafata in contact cu alimentele (CMA);
d) orice alte restrictii mentionate expres;
e) orice tip de specificatii referitoare la substanta sau la polimer.
6. Daca o substanta apare pe lista ca un compus individual, va fi, de
asemenea, exprimata printr-un termen generic, iar restrictiile care se aplica
acestei substante vor fi cele indicate pentru compusul individual.
7. In cazul in care exista vreo neconcordanta intre numarul CAS si
denumirea chimica, denumirea chimica va avea prioritate fata de numarul CAS.
Daca exista vreo neconcordanta intre numarul CAS raportat in Einecs si
registrul CAS, se va aplica numarul CAS din registrul CAS.

SPECIFICATII
Partea A: Specificatii generale
Materialele si obiectele fabricate utilizandu-se izocianati aromatici sau
coloranti obtinuti prin diazoconjugare nu trebuie sa cedeze amine aromatice
primare, exprimate ca anilin intr-o cantitate detectabila LD = 0.02 mg/kg de
aliment sau de simulant alimentar, inclusiv toleranta analitica. Totusi,
valorile de migrare a aminelor aromatice primare listate in aceste norme sunt
excluse de la aceasta restrictie.

| coloniei pe diferite tipuri de geloze la diferite
| temperaturi. Copolimerii sunt izolati din bacteriile
| tratate termic prin digestia controlata a altor
componente
| celulare, spalare si uscare. Acesti copolimeri sunt in
mod
| normal prezenti sub forma de granule formulate, formate
| prin fuziune, care contin aditivi precum agenti de
| cristalizare, plastifianti, substante de umplere,
