În temeiul art. 108 din Constituţia României, republicată, al art. 14 alin. (1), art. 15 şi al art. 16 alin. (1) din Legea nr. 213/1998 privind proprietatea publică şi regimul juridic al acesteia, cu modificările şi completările ulterioare,Guvernul României adoptă prezenta hotărâre. Articolul 1Se aprobă închirierea de către Ministerul Justiţiei a unor spaţii aflate în administrarea acestuia, prevăzute în anexa care face parte integrantă din prezenta hotărâre, situate în imobilele proprietate publică a statului în care îşi desfăşoară activitatea instanţele judecătoreşti, în scopul desfăşurării unor activităţi sau al prestării unor servicii necesare personalului instanţelor şi justiţiabililor. Articolul 2(1) Închirierea spaţiilor prevăzute la art. 1 se face prin licitaţie publică, în condiţiile legii.(2) Se împuterniceşte Ministerul Justiţiei să organizeze procedura de licitaţie publică pentru închirierea acestor spaţii, în scopul realizării activităţilor prevăzute la art. 1.(3) Contractul de închiriere se încheie de către Ministerul Justiţiei, în calitate de titular al dreptului de administrare a imobilelor prevăzute la art. 1. Articolul 3Chiria stabilită ca urmare a desfăşurării procedurilor de licitaţie publică se plăteşte de câştigătorul licitaţiei. O cotă-parte de 20% din chiria încasată potrivit contractului prevăzut la art. 2 rămâne la dispoziţia Ministerului Justiţiei pentru întreţinerea imobilelor care fac obiectul închirierii, iar restul de 80% se virează la bugetul de stat.
