Având în vedere Regulamentul (UE) nr. 722/2012 al Comisiei din 8 august 2012 privind cerinţe speciale în ceea ce priveşte cerinţele prevăzute în directivele 90/385/CEE şi 93/42/CEE ale Consiliului cu privire la dispozitivele medicale implantabile active şi la dispozitivele medicale fabricate utilizând ţesuturi de origine animală,în temeiul art. 108 din Constituţia României, republicată,Guvernul României adoptă prezenta hotărâre. Articolul 1Hotărârea Guvernului nr. 382/2005 privind introducerea specificaţiilor detaliate pentru dispozitivele medicale produse prin utilizarea ţesuturilor de origine animală, publicată în Monitorul Oficial al României, Partea I, nr. 412 din 16 mai 2005, cu modificările ulterioare, se abrogă. Articolul 2Ministerul Sănătăţii, în calitate de autoritate competentă conform prevederilor art. 9 din Legea nr. 176/2000 privind dispozitivele medicale, republicată, cu modificările ulterioare, exercită atribuţiile autorităţii competente prevăzute în Regulamentul (UE) nr. 722/2012 al Comisiei din 8 august 2012 privind cerinţe speciale în ceea ce priveşte cerinţele prevăzute în Directivele 90/385/CEE şi 93/42/CEE ale Consiliului cu privire la dispozitivele medicale implantabile active şi la dispozitivele medicale fabricate utilizând ţesuturi de origine animală.
