    In temeiul art. 8 alin. (1) din Legea audiovizualului nr. 48/1992, comunicatia audiovizuala in domeniile radiodifuziunii si televiziunii se face in baza licentei de emisie care, in conformitate cu art. 12 alin. (2) din lege, se elibereaza de catre Consiliul National al Audiovizualului in urma unui concurs la care pot participa solicitantii care au obtinut avizul tehnic prealabil al Ministerului Comunicatiilor.
    Licenta de emisie se acorda, potrivit art. 14 alin. (1) din Legea nr. 48/1992, pentru o perioada de 7 ani in domeniul televiziunii, cu respectarea criteriilor pentru departajarea participantilor, prevazute la art. 12 alin. (4) din lege.
    Pe de alta parte, la atribuirea licentei de emisie se au in vedere criteriile cuprinse in Decizia Consiliului National al Audiovizualului nr. 3 din 4 august 1992 (anexa nr. 4).
    In urma dezbaterilor publice, desfasurate conform art. 32 alin. (3) din Legea audiovizualului nr. 48/1992, in trimestrul IV/1995, constatand indeplinite conditiile si criteriile prevazute de lege si de deciziile elaborate de C.N.A. in aplicarea legii, Consiliul National al Audiovizualului delibereaza, in baza art. 29 din lege, si, prin vot secret,
