pentru aprobarea Normei sanitare veterinare privind conditiile de sanatate a animalelor si modelele de certificate veterinare pentru importul de carne proaspata de pasare din tari terte*)

    In temeiul prevederilor art. 31 alin. 1 din Legea sanitara veterinara nr. 60/1974, republicata, cu modificarile si completarile ulterioare,
    in baza Hotararii Guvernului nr. 362/2002 privind organizarea si functionarea Ministerului Agriculturii, Alimentatiei si Padurilor, cu modificarile si completarile ulterioare,
    vazand Referatul de aprobare nr. 150.737 din 28 ianuarie 2003, intocmit de Agentia Nationala Sanitara Veterinara,

    ministrul agriculturii, alimentatiei si padurilor emite urmatorul ordin:

    Art. 1
    Se aproba Norma sanitara veterinara privind conditiile de sanatate a animalelor si modelele de certificate veterinare pentru importul de carne proaspata de pasare din tari terte, prevazuta in anexa care face parte integranta din prezentul ordin.
    Art. 2
    Agentia Nationala Sanitara Veterinara, institutele centrale de profil si directiile sanitare veterinare judetene si a municipiului Bucuresti vor duce la indeplinire prevederile prezentului ordin.
    Art. 3
    Agentia Nationala Sanitara Veterinara va controla modul de aplicare a prevederilor prezentului ordin.
    Art. 4
    La data intrarii in vigoare a prezentului ordin se abroga orice alta dispozitie contrara.
    Art. 5
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I, si va intra in vigoare la 90 de zile de la data publicarii.

                           NORMA SANITARA VETERINARA
privind conditiile de sanatate a animalelor si modelele de certificate veterinare pentru importul de carne proaspata de pasare din tari terte

    Art. 1
    (1) Autoritatea veterinara centrala din Romania autorizeaza importul de carne proaspata de pasare din tari terte sau din parti ale tarilor terte prevazute in anexa nr. 1, cu conditia ca aceasta sa intruneasca cerintele certificatului de sanatate animala, din anexa nr. 2 si sa fie insotita de un astfel de certificat, completat corect si semnat. Certificatul trebuie sa includa partea generala in conformitate cu anexa nr. 2, Partea 1 si atestarea de sanatate specifica potrivit anexei nr. 2, Partea a 2-a, in conformitate cu prevederile cuprinse in anexa nr. 1.
    (2) Carnea proaspata de pasare, destinata exportului in Romania si care indeplineste cerintele prezentei norme sanitare veterinare, trebuie sa fie marcata cu o marca de sanatate care raspunde criteriilor mentionate de anexa nr. 3.
    Art. 2
    (1) Autoritatea veterinara centrala a Romaniei prin Ministerul Agriculturii, Alimentatiei si Padurilor poate adopta acte normative sau prevederi administrative suplimentare necesare prezentei norme sanitare veterinare, pentru a se asigura implementarea si conformitatea cu prevederile acesteia.
    (2) Autoritatea veterinara centrala a Romaniei va dispune masurile necesare si va sanctiona, potrivit legii, orice incalcare a prevederilor prezentei norme sanitare veterinare.
    (3) Atunci cand autoritatea veterinara centrala a Romaniei adopta cele mentionate la alineatele precedente, trebuie sa faca o referire expresa la prezenta norma sanitara veterinara.
    Art. 3
    Modelele de certificate pentru Statele Unite ale Americii si Canada vor intra in vigoare in momentul intrarii Romaniei in Uniunea Europeana.
    Art. 4
    Punctul 5 al anexei nr. 2 (modelul A si B) - certificarea de sanatate publica va intra in vigoare la data de 9 iunie 2003.
    Art. 5
    Anexele nr. 1, 2 si 3 fac parte integranta din prezenta norma sanitara veterinara.

    *1) Carne proaspata de pasare inseamna orice parti de pasari domestice, de curcani, de bibilici, de gaste si rate care sunt proprii pentru consum uman si care nu au fost supuse vreunui tratament, altul decat tratamentul prin frig, pentru a se asigura conservarea acesteia: carnea ambalata sub vacuum sau carnea ambalata intr-o atmosfera controlata trebuie, de asemenea, sa fie insotita de un certificat in concordanta cu acest model.
    *1) Fresh poultrymeat means any parts of domestic fowl, turkeys, guinea fowl, geese and ducks, which are fit for human consumption and which have not undergone any treatment to ensure its preservation: vacuum-wrapped meat or meat wrapped in a controlled atmosphere must also be accompanied by a certificate according to this model.

    I, the undersigned, official veterinarian, hereby certify in accordance with provisions of *Directive 91/494/CEE:

    (c) has not been slaughtered in the context of any animal health scheme for the control or eradication of poultry diseases;
    (d) in timpul transportului spre abator nu au venit in contact cu pasari infectate cu influenta aviara sau cu boala de Newcastle;
    (d) during transport to the slaughterhouse, did not come into contact with poultry infected with avian influenza or Newcastle disease;

    II. Certificarea de sanatate publica
    Public health certification

    Subsemnatul, medic veterinar oficial, in conformitate cu prevederile "Normei sanitare veterinare privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare" certific urmatoarele:
    I, the undersigned, official veterinarian, hereby certify in accordance with provisions of Sanitary Veterinary Norme on health problems affecting the production and placing on the market of fresh poultrymeat:
    1. carnea descrisa mai sus indeplineste cerintele Capitolului II si orice conditii suplimentare ale "Normei sanitare veterinare privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare" si a fost gasita apta pentru consum uman ca urmare a inspectiei ante si post-mortem efectuata in conformitate cu conditiile din prezenta norma sanitara veterinara;
    1. that the meat described above fulfils the requirements of Chapter II and any additional conditions of Sanitary Veterinary Norme on health problems affecting the production and placing on the market of fresh poultrymeat: Directive 71/118/CEE, and has been found fit for human consumption following ante- and post-mortem inspection carried out in application of this Directive;
    2. Carnea descrisa mai sus a fost/nu a fost*4) supusa unui proces de racire prin imersie;
    2. that the meat described above has/has not been subjected to an immersion chilling process;

    3. that the meat described above has been marked according to Article 1(2) of Decision 94/984/CE;
    4. carnea descrisa mai sus indeplineste cerintele legislatiei comunitare specifice ce stabileste regulile pentru testarea microbiologica pentru salmonella prin prelevarea de probe de carne de pasare destinata Finlandei si Suediei;
    4. that the meat described above fulfils the requirements of Decision 95/411/CE*5);
    5. Carnea provine dintr-o unitate ce implementeaza controale cu privire la igiena generala, in conformitate cu prevederile legislatiei comunitare specifice ce stabileste reguli pentru controalele periodice privind igiena generala, efectuate de operatori in intreprinderi in concordanta cu "Norma sanitara veterinara care stabileste conditiile de sanatate pentru producerea si comercializarea carnii proaspete" si cu "Norma sanitara veterinara privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare";
    5. That the meat comes from an establishment implementing checks on the general hygiene in accordance with the provisions of Commision Decision 2001/471/CE*6).

    III. Atestarea pentru protectia animalelor

    1. cunosc si mi-am insusit prevederile "Normei sanitare veterinare privind protectia animalelor in timpul taierii sau uciderii;

    (b) has undergone at slaughter, on the basis of a random sample of cloacal swabs of at least 60 birds of each flock concerned, a virus isolation test for Newcastle disease, carried out in an official laboratory, in which no avian paramyxoviruses with an intracerebral pathogenicity index (ICPI) of more than 0,4 have been found; and

    (c) has not been in contact during the period of 30 days preceding slaughter with poultry which do not fulfil the guarantees mentioned under (a) and (b);
    4. Carnea descrisa mai sus:

    (a) provine din abatoare autorizate care, in momentul taierii, nu sunt sub restrictii, datorita unui focar suspectat sau confirmat de influenta aviara sau de boala de Newcastle si in jurul carora pe o raza de 10 km, nu au existat focare de influenta aviara sau de boala de Newcastle in ultimele 30 de zile;

    II. Certificarea de sanatate publica
        Public health certification

    Subsemnatul, medic veterinar oficial, in conformitate cu prevederile "Normei sanitare veterinare privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare" certific urmatoarele:
    I, the undersigned, official veterinarian, hereby certify in accordance with provisions of Directive 71/118/CEE:
    1. carnea descrisa mai sus indeplineste cerintele Capitolului II si orice conditii suplimentare ale "Normei sanitare veterinare privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare" si a fost gasita apta pentru consumul uman ca urmare a inspectiei ante si post-mortem efectuate in aplicarea normei sanitare veterinare mentionate;
    1. that the meat described above fulfils the requirements of Chapter II and any additional conditions of Council Directive 71/118/CEE, and has been found fit for human consumption following ante- and post-mortem inspection carried out in application of this Directive;
    2. carnea descrisa mai sus a fost*4)/nu a fost supusa unui proces de racire prin imersie;
    2. that the meat described above has/has not been subjected to an immersion chilling process;
    3. carnea descrisa mai sus a fost marcata in concordanta cu articolul 1(2) al prezentei norme sanitare veterinare;
    3. that the meat described above has been marked according to Article 1(2) of Decision 94/984/CE;
    4. carnea descrisa mai sus indeplineste cerintele legislatiei comunitare specifice ce stabileste regulile pentru testarea microbiologica pentru salmonella prin prelevarea de probe de carne de pasare destinata Finlandei si Suediei;
    4. that the meat described above fulfils the requirements of Decision 95/411/CE*4);
    5. carnea provine de la o unitate care implementeaza controale cu privire la igiena generala, in concordanta cu prevederile legislatiei comunitare specifice ce stabileste reguli pentru controalele periodice privind igiena generala, efectuate de operatori in intreprinderi in concordanta cu "Norma sanitara veterinara care stabileste conditiile de sanatate pentru producerea si comercializarea carnii proaspete" si cu "Norma sanitara veterinara privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare";
    5. that the meat comes from an establishment implementing checks on the general hygiene in accordance with the provisions of Commision Decision 2001/471/CE*5)

    III. Atestarea cu privire la protectia animalelor

    1. Cunosc si am inteles prevederile "Normei sanitare veterinare privind protectia animalelor in timpul taierii sau uciderii";

    MARCA DE SANATATE PENTRU CARNEA PROASPATA DE PASARE

    Marca de sanatate la care se refera articolul 1(2) al prezentei norme sanitare veterinare trebuie sa includa:
    (a) pentru carnea ambalata in piese individuale sau pentru ambalaje mici:
    - in partea superioara codul de referinta al tarii de origine;
    - la mijloc numarul de autorizare veterinara al abatorului sau unitatii de transare sau al centrului de reambalare, literele si cifrele trebuie sa fie de 0,2 cm inaltime;
    (b) pentru ambalajele mari, o marca ovala de 6,5 cm latime cu 4,5 cm inaltime ce contine numele tarii, codul ISO al acesteia si numarul de autorizare veterinara al abatorului, unitatii de transare sau al centrului de reambalare; literele trebuie sa fie de cel putin 0,8 cm inaltime si cifrele de cel putin 1 cm inaltime; marca de sanatate poate, in plus, sa includa o indicatie care sa permita identificarea medicului veterinar care a efectuat inspectia de sanatate a carnii.
    2. Materialul utilizat pentru marcare trebuie sa intruneasca toate cerintele de igiena iar informatiile vor aparea pe acesta intr o forma perfect lizibila.
    3. Prevederile punctelor 65, 67 si 68 ale Capitolului XII al anexei nr. 1 al "Normei sanitare veterinare privind problemele de sanatate care reglementeaza producerea si comertul cu carne proaspata de pasare" se aplica la marcarea carnii de pasare si pentru ambalajele mari, dupa cum este necesar.
