În temeiul art. 143 din Hotărârea Guvernului nr. 780/2006 privind stabilirea schemei de comercializare a certificatelor de emisii de gaze cu efect de seră, cu modificările şi completările ulterioare, şi al art. 15 alin. (4) din Hotărârea Guvernului nr. 1.635/2009 privind organizarea şi funcţionarea Ministerului Mediului şi Pădurilor, cu modificările şi completările ulterioare,ministrul mediului şi pădurilor emite următorul ordin: Articolul 1(1) Se aprobă numărul total de certificate de emisii de gaze cu efect de seră alocate pentru perioada 1 ianuarie-31 decembrie 2012 fiecărui operator de aeronave care efectuează o activitate de aviaţie prevăzută în anexa nr. 1 la Hotărârea Guvernului nr. 780/2006 privind stabilirea schemei de comercializare a certificatelor de emisii de gaze cu efect de seră, cu modificările şi completările ulterioare, a cărui solicitare a fost transmisă Comisiei Europene până la data de 30 iunie 2011, prevăzut în anexa nr. 1.(2) Se aprobă numărul de certificate de emisii de gaze cu efect de seră alocate pentru fiecare an al perioadei 1 ianuarie 2013-31 decembrie 2020 fiecărui operator de aeronave care efectuează o activitate de aviaţie prevăzută în anexa nr. 1 la Hotărârea Guvernului nr. 780/2006, cu modificările şi completările ulterioare, a cărui solicitare a fost transmisă Comisiei Europene până la data de 30 iunie 2011, prevăzut în anexa nr. 2. Articolul 2(1) Indicatorul utilizat pentru determinarea numărului de certificate de emisii de gaze cu efect de seră alocate fiecărui operator de aeronave pentru perioada 1 ianuarie-31 decembrie 2012 este de 0,000679695907431681 de certificate per tonă-kilometru, determinat în conformitate cu prevederile Deciziei Comisiei 2011/638/UE din 26 septembrie 2011 privind indicatorii pentru alocarea cu titlu gratuit a cotelor de emisii de gaze cu efect de seră operatorilor de aeronave, în conformitate cu articolul 3e din Directiva 2003/87/CE a Parlamentului European şi a Consiliului.(2) Indicatorul utilizat pentru determinarea numărului de certificate de emisii de gaze cu efect de seră alocate fiecărui operator de aeronave pentru perioada 1 ianuarie 2013 - 31 decembrie 2020 este de 0,000642186914222035 de certificate per tonă-kilometru, determinat în conformitate cu prevederile Deciziei Comisiei 2011/638/UE. Articolul 3Anexele nr. 1 şi 2 fac parte integrantă din prezentul ordin. Articolul 4Prezentul ordin se publică în Monitorul Oficial al României, Partea I.
