pentru incadrarea vehiculelor rutiere care efectueaza transporturi internationale de marfuri in categorii de poluare si de siguranta a circulatiei

     In temeiul prevederilor art. 12 lit. b) si ale art. 13 alin. (1) din Ordonanta Guvernului nr. 19/1997 privind transporturile, republicata, cu modificarile si completarile ulterioare, ale art. 5 alin. (3) lit. o) din Ordonanta de urgenta a Guvernului nr. 109/2005 privind transporturile rutiere, in baza art. 5 alin. (4) din Hotararea Guvernului nr. 412/2004 privind organizarea si functionarea Ministerului Transporturilor, Constructiilor si Turismului, cu modificarile si completarile ulterioare,

     in conformitate cu normele si conditiile tehnice privind siguranta rutiera si protectia mediului, prevazute in directivele europene si in regulamentele CEE/ONU, precum si in acord cu rezolutiile Conferintei Europene a Ministrilor Transporturilor (CEMT),

     ministrul transporturilor, constructiilor si turismului emite urmatorul ordin:

     Art. 1. - (1) Vehiculele rutiere cu masa maxima autorizata mai mare de 3,5 tone, destinate transportului international de marfuri, se clasifica in categoriile de poluare si de siguranta a circulatiei, prevazute in anexa nr. 1*).

     (2) Clasificarea prevazuta la alin. (1) se face conform nivelurilor maxime admise de poluare chimica si sonora, prevazute in anexa nr. 2a)*), si prescriptiilor tehnice si de siguranta activa/pasiva, prevazute in anexa nr. 2b).

     (3) Autovehiculele incadrate in categoriile de poluare "A_E4" - "F", potrivit clasificarii prevazute in anexa nr. 1, primesc copia conforma a licentei de transport pentru transporturi internationale de marfuri.

     Art. 2. - (1) Regia Autonoma "Registrul Auto Roman", denumita in continuare R.A.R., certifica incadrarea autovehiculelor in categoriile de poluare "A_E4" - "F" si elibereaza dovezi de certificare corespunzatoare, avand forma si continutul conform modelelor prevazute in anexele nr. 3a) - 3j)*).

     (2) Certificarea incadrarii autovehiculelor, prevazuta la alin. (1), se face in baza certificatelor de conformitate eliberate de fabricantul autovehiculului sau de reprezentanta acestuia pentru Romania, conform prevederilor Rezolutiei CEMT/CM(2005)/9 Final, a documentelor de omologare de tip ale autovehiculului si a verificarilor tehnice efectuate conform anexelor nr. 2a) si 2b).

     (3) Opacitatea gazelor de evacuare se va masura doar in cazul in care vechimea autovehiculului depaseste un an de la data fabricatiei sau daca se sesizeaza vizual un grad ridicat al opacitatii gazelor de evacuare.

     Art. 3. - (1) Dovezile de certificare pentru autovehiculele incadrate in categoriile "C" - "F" au valabilitatea de maximum un an de la data eliberarii, aceasta fiind insa corelata cu data la care s-a masurat opacitatea gazelor.

     (2) Dovezile de certificare pentru autovehiculele incadrate in categoria de poluare "B" au valabilitatea de maximum un an de la data eliberarii, aceasta fiind insa corelata cu valabilitatea documentului ce atesta insonorizarea autovehiculului (certificatul austriac de zgomot).

     (3) Dovezile de certificare pentru autovehiculele incadrate in categoriile de poluare "A_E4" - "A" se elibereaza atat pentru autovehicul, cat si pentru (semi)remorca tractata de acesta si au valabilitatea de maximum un an de la data eliberarii, aceasta fiind insa corelata cu valabilitatea certificatului ce atesta insonorizarea autovehiculului (certificatul austriac de zgomot).

     (4) Pentru autovehiculele ce nu prezinta certificatul austriac de zgomot, verificarea insonorizarii se face o data la 2 ani de catre R.A.R. prin verificarea conformitatii cu documentele de omologare.

     Art. 4. - (1) Dovezile de certificare pentru autovehiculele incadrate in categoriile "A_E4" - "B" sunt eliberate de R.A.R. in conformitate cu prevederile art. 2 alin. (1).

     (2) Certificatele de conformitate eliberate de fabricantul autovehiculului sau de reprezentantul acestuia pentru Romania sunt redactate in limbile engleza, franceza si germana.

     Art. 5. - Certificatele ce atesta controlul tehnic pentru vehiculele incadrate in categoriile "A_E4" - "A" conform Rezolutiei CEMT/(2005)/9 Final sunt eliberate de R.A.R. in limbile romana, engleza si germana, conform anexelor nr. 4a) - 4c)*).

     Art. 6. - Pentru verificarea compatibilitatii sistemului de franare pentru vehiculele incadrate conform Ordinului ministrului lucrarilor publice, transporturilor si locuintei nr. 211/2003 pentru aprobarea Reglementarilor privind conditiile tehnice pe care trebuie sa le indeplineasca vehiculele rutiere in vederea admiterii in circulatie pe drumurile publice din Romania - RNTR 2, cu modificarile si completarile ulterioare, categoria BC (autotractoare cu sa) si DA (semiremorci), certificatele de poluare se elibereaza doar in ansamblu.

     Art. 7. - In cazul in care vehiculele fac obiectul unui contract de inchiriere sau de leasing pentru vehiculele ce circula cu autorizatie multipla CEMT, este obligatorie prezentarea copiei legalizate dupa contractul de inchiriere/leasing, din care sa rezulte legatura dintre proprietarul vehiculului si utilizatorul sau (detinatorul de autorizatie CEMT). Aceste contracte trebuie sa contina numele proprietarului si al utilizatorului, data semnarii contractului, durata contractului si numarul de identificare al vehiculului.

     Art. 8. - (1) Este obligatoriu ca la utilizarea unei autorizatii multiple CEMT aceasta sa fie insotita de dovezile de certificare prevazute in prezentul ordin si de certificatele de conformitate eliberate de fabricantul vehiculului sau de reprezentanta fabricantului vehiculului in Romania.

     (2) Pe toata durata valabilitatii dovezilor de certificare este obligatorie respectarea tuturor conditiilor tehnice initiale ce au stat la baza eliberarii lor.

     (3) In cazul nerespectarii prevederilor alin. (1) sau (2), autorizatia multipla CEMT se considera invalida.

     Art. 9. - La efectuarea transportului international de marfuri nu trebuie omisa prezentarea celorlalte documente (inspectie tehnica periodica internationala, agreere ADR, ATP, autorizatie pentru transport agabaritic etc.).

     Art. 10. - In cazul in care un operator de transport a fost sanctionat pentru abateri repetate pentru nerespectarea conditiilor tehnice initiale ce au stat la baza obtinerii dovezilor de certificare si/sau pentru neprezentarea in trafic a dovezilor de certificare si a celorlalte documente conform Rezolutiei CEMT/CM (2005)/9 Final, acestuia i se va retrage dreptul de a mai obtine/utiliza autorizatii CEMT pe o perioada de 2 ani.

     Art. 11. - Dovezile de certificare pentru autovehiculele incadrate in categoriile de poluare "A_E3" - "F", eliberate in conformitate cu prevederile Ordinului ministrului lucrarilor publice, transporturilor si locuintei nr. 1.105/2002 pentru incadrarea vehiculelor rutiere care efectueaza transporturi internationale de marfuri in categorii de poluare si de siguranta a circulatiei, sunt considerate valabile daca au fost eliberate pana la data de 1 ianuarie 2006.

     Art. 12. - Directia generala infrastructura si transport rutier din cadrul Ministerului Transporturilor, Constructiilor si Turismului impreuna cu R.A.R. si Autoritatea Rutiera Romana - A.R.R. vor duce la indeplinire prevederile prezentului ordin.

     Art. 13. - Anexele nr. 1 - 4 fac parte integranta din prezentul ordin.

     Art. 14. - Cu data prezentului ordin, Ordinul ministrului lucrarilor publice, transporturilor si locuintei nr. 1.105/2002 pentru incadrarea vehiculelor rutiere care efectueaza transporturi internationale de marfuri in categorii de poluare si de siguranta a circulatiei, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 689 din 19 septembrie 2002, se abroga.

     Art. 15. - Prezentul ordin se publica in Monitorul Oficial al Romaniei, Partea I.

     ANEXA 2b)

     PRESCRIPTII TEHNICE SI DE SIGURANTA ACTIVA/PASIVA

pentru autovehiculele TIR ("A", "A_E3" si "A_E4") in vederea asigurarii sigurantei circulatiei

     In conformitate cu Ordinul ministrului transporturilor, constructiilor si turismului nr. 2.133/2005 (publicat in Monitorul Oficial al Romaniei, Partea I, nr. 1.160 din 21 decembrie 2005) pentru aprobarea Reglementarilor privind certificarea incadrarii vehiculelor rutiere inmatriculate in normele tehnice privind siguranta circulatiei rutiere, protectia mediului si in categoria de folosinta conform destinatiei, prin inspectia tehnica periodica - RNTR 1, care transpune Directiva Consiliului 96/96/CE, modificata prin Directiva Comisiei 1999/52/CE (pentru certificate "A" si "A_E3"), cu ultimul amendament dat prin Directiva Comisiei 2003/27/CE (pentru categoriile "A_E4") privind controlul tehnic al autovehiculelor, cu amendamentul CEE/ONU din 13 noiembrie 1997 privind unificarea prescriptiilor tehnice si conditii pentru recunoasterea reciproca a acestor verificari, completat la 13 noiembrie 2001 prin Rezolutia CEE/ONU (TRANS/SC1/294/Rev. 5), amendata prin (TRANS/WP1/2001/25), in acord cu Rezolutia CEMT/CM (2005)/9 Final, vehiculele din categoriile "A", "A_E3" si "A_E4" trebuie sa indeplineasca urmatoarele cerinte tehnice*1):

     1. Vehiculele si (semi)remorcile trebuie sa aiba adancimea profilului anvelopei de minimum 2 mm, in concordanta cu Regulamentul CEE/ONU R54 sau cu Directiva Consiliului 92/23/CEE, cu ultimul amendament dat prin Directiva Comisiei 2005/11/CE, iar in caz de utilizare a anvelopelor resapate, in concordanta cu Regulamentul CEE/ONU R109.

     2. Vehiculele si semiremorcile trebuie sa fie dotate cu dispozitive antiincastrare spate, in conformitate cu Regulamentul CEE/ONU R58 sau cu Directiva Consiliului 70/221/CEE, amendata prin Directiva 2000/8/CE.

     3. Vehiculele si semiremorcile trebuie sa fie dotate cu dispozitive antiincastrare lateral, in conformitate cu Regulamentul CEE/ONU R73 sau cu Directiva Consiliului 89/297/CEE.

     4. Pentru dovezile de certificare "A_E3" si "A_E4" autovehiculele trebuie sa aiba oglinzi pentru vedere in spate, in concordanta cu Regulamentul CEE/ONU R46 sau cu Directiva Consiliului 71/127/CEE, modificata prin Directiva Comisiei 88/321/CEE sau prin Directiva Comisiei 2003/97/CE.

     5. Vehiculele trebuie sa aiba sistemul de iluminare si cel de semnalizare in concordanta cu Regulamentul CEE/ONU R48 sau cu Directiva Consiliului 76/756/CEE, amendata prin Directiva Comisiei 97/28/CE.

     6. Vehiculele trebuie sa aiba triunghiuri de semnalizare, in concordanta cu Regulamentul CEE/ONU R27.

     7. Vehiculele trebuie sa utilizeze un tahograf, in concordanta cu Normele AETR sau cu Regulamentul Consiliului (CEE) nr. 3.821/85, cu ultimul amendament dat prin Regulamentul Comisiei (CE) nr. 1.056/97 sau Regulamentul Consiliului (CE) nr. 2.135/98.

     Pentru vehiculele ce se incadreaza in categoria "A_E4" tahograful trebuie sa fie in concordanta cu Normele AETR revizuite sau cu Regulamentul Consiliului (CEE) nr. 3.821/85, cu ultimul amendament dat prin Regulamentul Comisiei (CE) nr. 1.056/97 sau Regulamentul Consiliului (CE) nr. 2.135/98 si prin regulamentele Comisiei (CE) nr. 1.360/2002 si nr. 432/2004.

     8. Vehiculele trebuie sa aiba limitator de viteza, in concordanta cu Regulamentul CEE/ONU R89 sau cu Directiva Consiliului 92/24/CEE, pentru autovehiculele din categoriile "A_E3" si "A_E4", cerintele tehnice fiind in concordanta cu amendamentul dat prin Directiva Parlamentului European si a Consiliului 2004/11/CE.

     9. Placutele reflectorizante spate pentru vehiculele grele si lungi trebuie sa fie in concordanta cu Regulamentul CEE/ONU R70.

     10. Vehiculele trebuie sa fie prevazute cu sistem de franare de tip antiblocare (ABS), in concordanta cu Regulamentul CEE/ONU R13 sau cu Directiva Consiliului 71/320/CEE, cu ultimul amendament dat prin Directiva Comisiei 98/12/CE. Sistemele de franare ale autovehiculelor si (semi)remorcii trebuie sa fie compatibile.

     11. Sistemul de directie trebuie sa fie in concordanta cu Regulamentul CEE/ONU R79 sau cu Directiva 70/311 CEE, modificata prin Directiva Consiliului 92/62/CEE (doar pentru categoria "A"), cu amendamentele prevazute in Directiva Comisiei 1999/7/CE.

     *1) Prevederile privind cerintele tehnice la care se face referire in regulamentele si directivele mentionate la pct. 1 - 11 din prezenta anexa au fost transpuse in legislatia nationala prin Ordinul ministrului lucrarilor publice, transporturilor si locuintei nr. 211/2003 pentru aprobarea Reglementarilor privind conditiile tehnice pe care trebuie sa le indeplineasca vehiculele rutiere in vederea admiterii in circulatie pe drumurile publice din Romania - RNTR 2, cu modificarile si completarile ulterioare.
