În temeiul:– art. 6 şi art. 7 alin. (1) pct. 51 din Legea nr. 571/2003 privind Codul fiscal, cu modificările şi completările ulterioare;– art. 5 alin. (2) şi art. 37 alin. (2) din Ordonanţa Guvernului nr. 92/2003 privind Codul de procedură fiscală, republicată, cu modificările şi completările ulterioare;– art. 10 alin. (4) din Hotărârea Guvernului nr. 34/2009 privind organizarea şi funcţionarea Ministerului Finanţelor Publice, cu modificările şi completările ulterioare,ministrul finanţelor publice emite următorul ordin: Articolul 1


(1) Se constituie Comisia fiscală centrală la nivelul Ministerului Finanţelor Publice, pentru aplicarea unitară a prevederilor:a)Legii nr. 571/2003 privind Codul fiscal, cu modificările şi completările ulterioare; b)actelor normative care reglementau taxa pe valoarea adăugată, impozitul pe profit, accizele, impunerea unor venituri realizate din România de persoane fizice şi juridice nerezidente, impozitul pe venit, înainte de intrarea în vigoare a Legii nr. 571/2003; c)Ordonanţei Guvernului nr. 92/2003 privind Codul de procedură fiscală, republicată, cu modificările şi completările ulterioare, precum şi legislaţiei subsecvente acestuia; d)legislaţiei care intră în sfera de aplicare a Agenţiei Naţionale de Administrare Fiscală.
(2) Comisia fiscală centrală soluţionează conflictele de competenţă apărute între organe fiscale care nu sunt subordonate unui organ ierarhic comun.
(3) Comisia fiscală centrală are componenţa prevăzută în anexa nr. 1. Articolul 2Se aprobă Regulamentul de organizare şi funcţionare a Comisiei fiscale centrale, prevăzut în anexa nr. 2. Articolul 3
(1) Documentele aferente lucrărilor Comisiei de proceduri fiscale, arhivate în original de către Direcţia generală juridică din cadrul Agenţiei Naţionale de Administrare Fiscală, vor fi predate în termen de 30 de zile de la intrarea în vigoare a prezentului ordin, în baza unui proces-verbal de predare-primire, direcţiei care asigură secretariatul Comisiei fiscale centrale.
(2) Sesizările adresate Comisiei de proceduri fiscale care intră în sfera de competenţă a Comisiei fiscale centrale conform art. 1 şi nesoluţionate până la data abrogării art. 4 din Ordonanţa Guvernului nr. 92/2003, republicată, cu modificările şi completările ulterioare, vor fi dezbătute în cadrul Comisiei fiscale centrale, după ce în prealabil au fost analizate în ceea ce priveşte îndeplinirea condiţiilor prevăzute în Ordinul preşedintelui Agenţiei Naţionale de Administrare Fiscală nr. 1.995/2007 privind constituirea Comisiei de proceduri fiscale, cu modificările şi completările ulterioare.

Articolul 4La data intrării în vigoare a prezentului ordin se abrogă Ordinul ministrului finanţelor publice nr. 183/2010 privind constituirea şi atribuţiile Comisiei fiscale centrale, publicat în Monitorul Oficial al României, Partea I, nr. 99 din 12 februarie 2010, şi Ordinul preşedintelui Agenţiei Naţionale de Administrare Fiscală nr. 1.995/2007 privind constituirea Comisiei de proceduri fiscale, publicat în Monitorul Oficial al României, Partea I, nr. 725 din 26 octombrie 2007, cu modificările şi completările ulterioare. Articolul 5Anexele nr. 1 şi 2 fac parte integrantă din prezentul ordin. Articolul 6Prezentul ordin se publică în Monitorul Oficial al României, Partea I.
