În temeiul art. 108 din Constituţia României, republicată, al art. 867 alin. (1) din Legea nr. 287/2009 privind codul civil, republicată, cu modificările ulterioare, al art. 21 alin. (2) din Ordonanţa Guvernului nr. 43/1997 privind regimul drumurilor, republicată, cu modificările şi completările ulterioare, şi al art. 1 alin. (6) din Ordonanţa de urgenţă a Guvernului nr. 84/2003 pentru înfiinţarea Companiei Naţionale de Autostrăzi şi Drumuri Naţionale din România - S.A. prin reorganizarea Regiei Autonome „Administraţia Naţională a Drumurilor din România“, aprobată cu modificări şi completări prin Legea nr. 47/2004, cu modificările şi completările ulterioare,Guvernul României adoptă prezenta hotărâre. Articolul 1Se aprobă transmiterea unor sectoare de drum naţional, aflate în proprietatea publică a statului, identificate potrivit anexei care face parte integrantă din prezenta hotărâre, din administrarea Ministerului Transporturilor şi Infrastructurii şi concesiunea Companiei Naţionale de Autostrăzi şi Drumuri Naţionale din România - S.A. în administrarea Consiliului Local al Municipiului Oradea, judeţul Bihor, potrivit legii. Contractul de concesiune având ca obiect sectoarele de drum naţional respective se modifică în mod corespunzător în condiţiile legii. Articolul 2Predarea-preluarea sectoarelor de drum naţional prevăzute la art. 1 se face pe bază de protocol încheiat între părţile interesate, în termen de 30 de zile de la data intrării în vigoare a prezentei hotărâri.
