În temeiul art. 108 din Constituţia României, republicată, al art. 42 alin. (1) lit. a) din Legea nr. 500/2002 privind finanţele publice, cu modificările şi completările ulterioare, şi al art. 25 alin. (1) din Ordonanţa Guvernului nr. 19/1997 privind transporturile, republicată, cu modificările şi completările ulterioare,Guvernul României adoptă prezenta hotărâre. Articolul 1Se aprobă indicatorii tehnico-economici ai obiectivului de investiţii de interes naţional şi de utilitate publică „Dezvoltarea capacităţii feroviare în sectorul fluvio-maritim al Portului Constanţa (danele 86-103)“, prevăzuţi în anexa care face parte integrantă din prezenta hotărâre. Articolul 2Finanţarea obiectivului de investiţii prevăzut la art. 1 se face de la bugetul de stat, prin bugetul Ministerului Transporturilor şi Infrastructurii, în limita sumelor aprobate anual cu această destinaţie, de la titlul 56 „Proiecte cu finanţare din fonduri externe nerambursabile postaderare“, poziţia „Fondul European de Dezvoltare Regională (FEDR)“, în conformitate cu prevederile Programului operaţional sectorial „Transport“ 2007-2013 şi ale legislaţiei comunitare în vigoare, conform programelor de investiţii publice aprobate potrivit legii. Articolul 3Ministerul Transporturilor şi Infrastructurii răspunde de modul de utilizare a sumei prevăzute în anexă, în conformitate cu prevederile legale în vigoare. (în preţuri în luna februarie 2012, 1 euro = 4,35 lei),
din care:
• Construcţii-montaj (inclusiv TVA): mii lei 74.887
- Eşalonarea investiţiei:

- Durata de realizare a investiţiei: 36 de luni

* Valoarea se va actualiza potrivit evoluţiei ulterioare a preţurilor. Factori de risc Construcţiile realizate în cadrul obiectivului de investiţii se vor proteja antiseismic în conformitate cu prevederile Normativului P 100-1/2006, cu modificările şi completările ulterioare. Finanţarea investiţiei Finanţarea obiectivului de investiţii se face de la bugetul de stat, prin bugetul Ministerului Transporturilor şi Infrastructurii, în limita sumelor aprobate anual cu această destinaţie, de la titlul 56 „Proiecte cu finanţare din fonduri externe nerambursabile postaderare“, poziţia „Fondul European de Dezvoltare Regională (FEDR)“, în conformitate cu prevederile Programului operaţional sectorial „Transport“ 2007-2013 şi ale legislaţiei comunitare în vigoare, conform programelor de investiţii publice aprobate potrivit legii.
