În temeiul art. 108 din Constituţia României, republicată, şi al art. 30 alin. (2) din Legea nr. 500/2002 privind finanţele publice, cu modificările şi completările ulterioare,Guvernul României adoptă prezenta hotărâre. Articolul 1


(1) Se aprobă suplimentarea bugetului Ministerului Mediului şi Pădurilor din Fondul de rezervă bugetară la dispoziţia Guvernului, prevăzut în bugetul de stat pe anul 2011, cu suma de 2.150 mii lei, la capitolul 74.01 „Protecţia mediului“, titlul 20 „Bunuri şi servicii“, articolul 20.30 „Alte cheltuieli“.
(2) Fondurile prevăzute la alin. (1) se utilizează în regim de urgenţă pentru realizarea lucrărilor de înlăturare a efectelor contaminării istorice cu metale grele şi refacerea terenului afectat din zona convenită, pusă la dispoziţia forţelor armate ale Statelor Unite ale Americii în conformitate cu prevederile Legii nr. 268/2006 pentru ratificarea Acordului dintre România şi Statele Unite ale Americii privind activităţile forţelor Statelor Unite staţionate pe teritoriul României, semnat la Bucureşti la 6 decembrie 2005, în Cazarma nr. 1.288, Mihail Kogălniceanu, judeţul Constanţa, aparţinând Ministerului Apărării Naţionale, denumite în continuare lucrări.

Articolul 2Elaborarea documentaţiilor aferente şi execuţia lucrărilor se contractează de către Ministerul Mediului şi Pădurilor cu respectarea legislaţiei în vigoare. Articolul 3Ministerul Finanţelor Publice este autorizat să introducă, la propunerea Ministerului Mediului şi Pădurilor, modificările corespunzătoare în structura bugetului de stat şi în volumul şi structura bugetului Ministerului Mediului şi Pădurilor pe anul 2011. Articolul 4Ministerul Mediului şi Pădurilor răspunde de modul de utilizare, în conformitate cu dispoziţiile legale, a sumei alocate potrivit prevederilor prezentei hotărâri.
