de venituri si cheltuieli rectificat pe anul 2010 al Societatii Nationale de
Transport Feroviar de Marfa „C.F.R. - Marfa" - S.A., aflata sub
autoritatea Ministerului Transporturilor si Infrastructurii
ACT EMIS DE:
GUVERNUL ROMANIEI
ACT PUBLICAT IN:
MONITORUL OFICIAL NR. 841 din 15 decembrie 2010
In temeiul art. 108 din Constitutia României,
republicata, si al Ordonantei de urgenta a Guvernului nr. 55/2010 privind unele
masuri de reducere a cheltuielilor publice, cu modificarile ulterioare,
Guvernul României adopta
prezenta hotarâre.
Art. 1. - Se aproba bugetul de venituri si cheltuieli
rectificat pe anul 2010 al Societatii Nationale de Transport Feroviar de Marfa
„C.F.R. - Marfa" - S.A., aflata sub autoritatea Ministerului
Transporturilor si Infrastructurii, prevazut în anexa care face parte integranta
din prezenta hotarâre.
Art. 2. - (1) Cheltuielile totale aferente veniturilor
totale înscrise în bugetul de venituri si cheltuieli reprezinta limite maxime,
care nu pot fi depasite decât în cazuri justificate si numai cu aprobarea
Guvernului, la propunerea Ministerului Transporturilor si Infrastructurii.
(2) In cazul în care în executie se înregistreaza
depasiri sau nerealizari ale veniturilor totale aprobate, operatorul economic
poate efectua cheltuieli totale proportional cu gradul de realizare a veniturilor
totale.
Art. 3. - (1) Nerespectarea prevederilor art. 2
constituie contraventie si se sanctioneaza cu amenda de la 1.000 lei la 5.000
lei.
(2) Contraventia se constata de catre organele de
control financiar ale statului, împuternicite conform legii, iar amenda se
aplica persoanelor vinovate de nerespectarea prevederilor prezentei hotarâri.
(3) Contraventiei prevazute la alin. (1) i se aplica
dispozitiile Ordonantei Guvernului nr. 2/2001 privind regimul juridic al
contraventiilor, aprobata cu modificari si completari prin Legea nr. 180/2002,
cu modificarile si completarile ulterioare.
