În conformitate cu prevederile art. 35 alin. (1) şi art. 36 alin. (1), (5) şi (6) din Legea nr. 334/2006 privind finanţarea activităţii partidelor politice şi a campaniilor electorale, republicată, cu completările ulterioare, şi cu Planul de control pe anul 2011, aprobat de preşedintele Autorităţii Electorale Permanente, precum şi cu notificarea misiunii de control, în perioada 6-17 iunie 2011 s-a efectuat controlul finanţării Uniunii Naţionale pentru Progresul României - Organizaţia Judeţeană Bacău pentru anul 2010.I. Constatări:Ca urmare a verificărilor efectuate asupra documentelor contabile puse la dispoziţia echipei de control s-a constatat că veniturile Uniunii Naţionale pentru Progresul României - Organizaţia Judeţeană Bacău au fost obţinute din cotizaţii în sumă de 972 lei, donaţii primite de la persoane fizice în valoare de 49.417,30 lei.În urma controlului s-a constatat faptul că au fost încălcate prevederile art. 9 alin. (1) din Legea nr. 334/2006 privind finanţarea activităţii partidelor politice şi a campaniilor electorale, republicată, cu completările ulterioare.Încălcarea prevederilor art. 9 alin. (1) din Legea nr. 334/2006, republicată, cu completările ulterioare, constituie contravenţie şi se sancţionează conform art. 41 alin. (1) şi art. 42 alin. (1) din aceeaşi lege, coroborate cu dispoziţiile Ordonanţei Guvernului nr. 2/2001 privind regimul juridic al contravenţiilor, aprobată cu modificări şi completări prin Legea nr. 180/2002, cu modificările şi completările ulterioare, cu vărsarea la bugetul de stat a sumelor de bani ce constituie obiectul contravenţiei.În urma controlului, controlorul financiar a propus sancţionarea Uniunii Naţionale pentru Progresul României - Organizaţia Judeţeană Bacău cu avertisment şi cu confiscarea sumei care face obiectul contravenţiei.II. Recomandări:Având în vedere cele constatate şi prezentate mai sus, se recomandă Uniunii Naţionale pentru Progresul României - Organizaţia Judeţeană Bacău următoarele:– actualizarea în mod permanent a procedurilor financiar-contabile în conformitate cu prevederile legale în vigoare;

– publicarea în Monitorul Oficial al României, Partea I, a listei persoanelor fizice şi juridice care au făcut într-un an fiscal donaţii a căror valoare cumulată depăşeşte 10 salarii de bază brute pe ţară - termen 31 martie a anului următor;– întocmirea situaţiilor ce trebuie înaintate Autorităţii Electorale Permanente, conform Legii nr. 334/2006, republicată, cu completările ulterioare.
