    In baza prevederilor art. 3 si 10, precum si ale anexei B(b) la Protocolul aditional la Acordul european instituind o asociere intre Romania, pe de o parte, si Comunitatile Europene si statele membre ale acestora, pe de alta parte, pentru a tine cont de aderarea Republicii Cehe, Republicii Estonia, Republicii Cipru, Republicii Letonia, Republicii Lituania, Republicii Ungare, Republicii Malta, Republicii Polone, Republicii Slovenia si Republicii Slovace la Uniunea Europeana, semnat la Bruxelles la 4 mai 2005, ratificat prin Legea nr. 220/2005,
    in temeiul prevederilor art. 5 alin. (6) din Hotararea Guvernului nr. 738/2003 privind organizarea si functionarea Ministerului Economiei si Comertului, cu modificarile si completarile ulterioare,
    luand in considerare prevederile Ordinului ministrului economiei si comertului nr. 892/2004 privind deschiderea unor contingente tarifare la importul in Romania al unor produse agricole originare din Uniunea Europeana (UE) si modul de administrare a acestor contingente in anul 2005, cu modificarile si completarile ulterioare,

    ministrul economiei si comertului emite urmatorul ordin:

    Art. 1
    Prevederile Ordinului ministrului economiei si comertului nr. 892/2004 privind deschiderea unor contingente tarifare la importul in Romania al unor produse agricole originare din Uniunea Europeana (UE) si modul de administrare a acestor contingente in anul 2005, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 1.272 din 30 decembrie 2004, modificat si completat prin Ordinul ministrului economiei si comertului nr. 405/2005, se modifica si se completeaza dupa cum urmeaza:
    1. Dupa litera d) a alineatului (1) al articolului 4 se introduce o noua litera, litera e), cu urmatorul cuprins:
    "e) operatorii economici care solicita certificate de import pentru oua pentru incubatie, corespunzatoare codurilor tarifare 0407.00.11 si 0407.00.19, vor prezenta suplimentar fotocopie de pe autorizatia sanitara veterinara eliberata de directia sanitar-veterinara si pentru siguranta alimentelor judeteana sau a municipiului Bucuresti."
    2. Alineatul (3) al articolului 5 va avea urmatorul cuprins:
    "(3) Operatorii economici traditionali sunt considerati cei care fac dovada, la data solicitarii, ca au importat produsul respectiv in cadrul contingentului tarifar preferential pe anul 2004 si/sau in anul 2005 cu respectarea prevederilor Ordinului ministrului economiei si comertului nr. 345/2003 si ale prezentului ordin."
    3. Articolul 6 va avea urmatorul cuprins:
    "Art. 6
    Operatorii economici care nu au respectat prevederile Ordinului ministrului economiei si comertului nr. 345/2003 si cele ale prezentului ordin privind deschiderea de contingente tarifare la importul in Romania al unor produse agricole originare din UE si modul de administrare a acestor contingente in anul 2004 si, respectiv, anul 2005, nu au acces la contingentele tarifare in anul 2005."
    4. Anexa nr. 1 "Lista contingentelor tarifare pentru importul in Romania al unor produse agricole originare din Uniunea Europeana (UE)" se inlocuieste cu anexa la prezentul ordin.
    Art. 2
    Prezentul ordin intra in vigoare la data de 1 august 2005 si se aplica pana la data de 31 decembrie 2005 inclusiv.
