privind alocarea sumelor în
vederea compensarii cresterilor neprevizionate ale preturilor combustibililor
utilizati pentru producerea energiei termice furnizate populatiei în sistem
centralizat, conform Ordonantei Guvernului nr. 36/2006 privind instituirea
preturilor locale de referinta pentru energia termica furnizata populatiei prin
sisteme centralizate

Având în vedere prevederile art. 4 alin. (1)-(3) şi ale
art. 5 din Ordonanţa Guvernului nr. 36/2006 privind instituirea preţurilor
locale de referinţă pentru energia termică furnizată populaţiei prin sisteme
centralizate, aprobată cu modificări şi completări prin Legea nr. 483/2006, ale
Legii bugetului de stat pe anul 2009 nr. 18/2009, cu modificările şi
completările ulterioare,
în temeiul art. 19 alin. (2) din Ordonanţa de urgenţă a
Guvernului nr. 221/2008 pentru stabilirea unor măsuri de reorganizare în cadrul
administraţiei publice centrale, aprobată prin Legea nr. 186/2009, cu
modificările ulterioare, şi, respectiv, al Ordonanţei de urgenţă a Guvernului
nr. 30/2007 privind organizarea şi funcţionarea Ministerului Administraţiei şi
Internelor, aprobată cu modificări prin Legea nr. 15/2008, cu modificările
ulterioare,
viceprim-ministrul, ministrul administraţiei şi
internelor, emite următorul ordin:
Art. 1. - Se aprobă alocarea unor sume pentru
compensarea creşterilor neprevizionate ale preţurilor la combustibili
corespunzător semestrului I al anului 2009 (tranşa IV-iulie 2009), conform
anexei care face parte integrantă din prezentul ordin.
Art. 2. - Sumele prevăzute la art. 1 se transferă
bugetelor locale de la bugetul de stat, prin bugetul Ministerului
Administraţiei şi Internelor, pentru furnizorii de energie termică destinată
populaţiei.
Art. 3. - Calculul cuantumurilor sumelor se face în
baza ordinelor şi deciziilor privind tarifele şi preţurile locale de referinţă
emise de autorităţile de reglementare competente, respectiv Autoritatea
Naţională de Reglementare în Domeniul Energiei şi Autoritatea Naţională de
Reglementare pentru Serviciile Comunitare de Utilităţi Publice.
Art. 4. -Alocarea sumelor se va face cu respectarea
prevederilor Ordinului ministrului administraţiei şi internelor nr. 125/2007
privind aprobarea Schemei de ajutor de stat pentru compensarea pierderilor
înregistrate ca urmare a prestării serviciilor de interes economic general de
către societăţile care produc, transportă, distribuie şi furnizează energie
termică, conţinută de Ordonanţa Guvernului nr. 36/2006 privind instituirea
preţurilor locale de referinţă pentru energia termică furnizată populaţiei prin
sisteme centralizate, cu modificările ulterioare.
Art. 5. - Prezentul ordin se publică în Monitorul
Oficial al României, Partea I.
