HOTARARE   Nr. 1074 din  9 noiembrie 2000

privind stingerea unor obligatii bugetare ale unor agenti economici care au suferit pierderi, datorita blocarii navigatiei in trafic international pe Dunare, in perioada 1 aprilie 1999 - 30 iunie 2000

    In temeiul prevederilor art. 107 din Constitutia Romaniei si ale art. 95 din Ordonanta Guvernului nr. 11/1996 privind executarea creantelor bugetare, aprobata si modificata prin Legea nr. 108/1996, cu modificarile si completarile ulterioare,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    Obligatiile bugetare reprezentand impozite, taxe si contributii, precum si majorarile de intarziere aferente, datorate la bugetul de stat pentru perioada 1 aprilie 1999 - 30 iunie 2000 si neachitate de unii agenti economici care isi desfasoara activitatea in domeniul transportului fluvial si de operare portuara, care au suferit pierderi datorita blocarii navigatiei in trafic international pe Dunare, se anuleaza la data intrarii in vigoare a prezentei hotarari.
    Art. 2
    Obligatiile bugetare reprezentand impozite, taxe si contributii, precum si majorarile de intarziere aferente, datorate la bugetul de stat pentru perioada 1 aprilie 1999 - 30 iunie 2000 si achitate de acesti agenti economici, se compenseaza, in cadrul aceluiasi buget, potrivit legii, cu obligatiile bugetare restante si viitoare, dupa caz, altele decat cele prevazute in anexa care face parte integranta din prezenta hotarare.
    Art. 3
    Agentii economici care beneficiaza de prevederile art. 1 si 2, precum si obligatiile bugetare constand in impozite, taxe si contributii, care se anuleaza sau din care se face compensarea, dupa caz, sunt prevazute in anexa.
    Art. 4
    Nivelul majorarilor de intarziere aferente obligatiilor bugetare prevazute la art. 1 si 2, datorate pana la data intrarii in vigoare a prezentei hotarari, care fac obiectul anularii sau compensarii, dupa caz, este cel stabilit de organele competente prin acte de verificare.
    Art. 5
    Eventualele diferente ale obligatiilor bugetare mentionate in anexa, constatate de organele competente prin acte de verificare si control ulterioare, se platesc in termen de 15 zile de la data constatarii.
    Art. 6
    Organele competente subordonate Ministerului Finantelor vor proceda la intocmirea documentului de anulare a obligatiilor bugetare prevazute la art. 1, pana la data de 15 decembrie 2000, sau vor efectua procedura de stingere, prin compensare, a obligatiilor bugetare prevazute la art. 2.
    Art. 7
    Ministerul Finantelor va elabora normele metodologice de aplicare a prezentei hotarari in termen de 30 de zile de la data intrarii in vigoare a acesteia.
