În temeiul dispoziţiilor art. 67 din Constituţia României, republicată,Senatul adoptă prezenta hotărâre. Articolul 1În cadrul mecanismului exercitării de către parlamentele naţionale ale statelor membre a controlului parlamentar privind respectarea principiilor de subsidiaritate şi proporţionalitate, Senatul a fost sesizat (conform Protocolului nr. 2 - anexă la Tratatul de la Lisabona) cu propunerea de directivă a Consiliului privind gestionarea combustibilului nuclear uzat şi a deşeurilor radioactive COM (2010) 618 final. Articolul 2


(1) Comisia economică, industrii şi servicii şi Comisia pentru administraţia publică, organizarea teritoriului şi protecţia mediului au constatat că, din motive legate de caracterul său transfrontalier, propunerea de directivă respectă principiul de subsidiaritate.
(2) Cu privire la respectarea principiului de proporţionalitate, membrii celor două comisii au considerat că dispoziţiile art. 4 alin. (3), care impun depozitarea definitivă a deşeurilor radioactive pe teritoriul propriu sau pe teritoriul unui alt stat membru, cât şi existenţa unor acorduri bilaterale notificate în conformitate cu legislaţia comunitară privind depozitarea deşeurilor radioactive rezultate în urma reprocesării combustibilului uzat provenit de la reactoarele de cercetare pe teritoriul statului terţ UE, sunt prea restrictive pentru România. Cele două comisii au hotărât să recomande modificarea textului astfel încât directiva să nu impună interzicerea importului sau exportului de deşeuri radioactive, criteriul principal fiind depozitarea în siguranţă a acestora, fie în Uniunea Europeană, fie în afara Uniunii Europene, ţinând cont şi de criteriile tehnico-economice.

Articolul 3Senatul aprobă Raportul comun al Comisiei economice, industrii şi servicii şi al Comisiei pentru administraţia publică, organizarea teritoriului şi protecţia mediului şi transmiterea către instituţiile europene interesate a unei opinii privind respectarea principiilor de subsidiaritate şi proporţionalitate în cadrul COM (2010) 618 final. Această hotărâre a fost adoptată de Senat în şedinţa din 7 martie 2011, cu respectarea prevederilor art. 76 alin. (2) din Constituţia României, republicată. PREŞEDINTELE SENATULUI MIRCEA-DAN GEOANĂ
