    In temeiul art. 114 alin. (4) din Constitutie,

    Guvernul Romaniei adopta prezenta ordonanta de urgenta.

    Art. 1
    (1) Privatizarea societatilor comerciale prevazute la pozitiile 1 - 24 din anexa care face parte integranta din prezenta ordonanta de urgenta se realizeaza prin licitatie cu strigare, care se desfasoara dupa regula licitatiei cu strigare competitiva sau olandeza, respectiv la un pret in urcare sau in scadere, in functie de raportul dintre cerere si oferta.
    (2) Privatizarea societatii comerciale prevazute la pozitia 25 din anexa se realizeaza prin metoda licitatiei cu strigare competitiva.
    Art. 2
    Oferta de vanzare a actiunilor, elaborata pe baza unei fise de prezentare simplificata, se publica in presa. Termenul de depunere a ofertelor este de 10 zile de la data publicarii.
    Art. 3
    Pretul de oferta al actiunilor se stabileste prin raport de evaluare simplificat, elaborat in conformitate cu Ordinul ministrului privatizarii nr. 60/1998 pentru aplicarea normelor metodologice privind privatizarea societatilor comerciale si vanzarea de active, cu modificarile ulterioare, cu exceptia societatilor comerciale care la data intrarii in vigoare a prezentei ordonante de urgenta au rapoarte de evaluare elaborate si receptionate.
    Art. 4
    Certificatele de obligatii bugetare se acorda de catre creditorii bugetari, la solicitarea societatilor comerciale, in termen de 10 zile de la data solicitarii. Emiterea acestor certificate este gratuita.
    Art. 5
    Asociatiile constituite din salariatii societatilor comerciale vor participa la procesul de privatizare a societatilor comerciale prin cumpararea de pachete de actiuni de pana la 10% din totalul actiunilor emise de acestea. Pretul de vanzare al actiunilor catre asociatii este acelasi cu cel de adjudecare al pachetului majoritar.
    Art. 6
    Privatizarea filialelor se poate face si fara eliberarea avizelor de mediu pentru privatizare.
