amplasamentul lucrarii de utilitate publica „Constructia autostrazii
Bucuresti-Brasov, tronsonul Bucuresti-Ploiesti, pe teritoriul localitatilor
Dascalu, Stefanestii de Jos si Nuci, judetul Ilfov"
ACT EMIS DE:

ACT PUBLICAT IN:
MONITORUL OFICIAL NR. 329 din 25 aprilie 2008
In temeiul art. 108 din Constituţia României,
republicată, şi al art. 4 alin. (1) din Legea nr. 198/2004 privind unele măsuri
prealabile lucrărilor de construcţie de autostrăzi şi drumuri naţionale, cu
modificările ulterioare,
Guvernul României adoptă
prezenta hotărâre.
Art. 1. - Se aprobă amplasamentul lucrării de utilitate
publică „Construcţia autostrăzii Bucureşti-Braşov, tronsonul
Bucureşti-Ploieşti, pe teritoriul localităţilor Dascălu, Ştefăneştii de Jos şi
Nuci, judeţul Ilfov", potrivit hărţii topografice prevăzute în anexa nr.
1*).
Art. 2. - (1) Se aprobă declanşarea procedurilor de
expropriere a imobilelor proprietate privată, situate pe amplasamentul lucrării
prevăzute la art. 1, expropriator fiind statul român, prin Compania Naţională
de Autostrăzi şi Drumuri Naţionale din România - S.A, aflată sub autoritatea
Ministerului Transporturilor.
(2) Imobilele supuse exproprierii sunt menţionate în
tabelul prevăzut în anexa nr. 2.
Art. 3. - Se aprobă ca justă despăgubire pentru
imobilele ce constituie amplasamentul lucrării de utilitate publică prevăzut la
art. 1 suma globală estimată de 7.145 mii lei, alocată prin bugetul
Ministerului Transporturilor în limita prevederilor anuale aprobate pentru anul
2008 prin Legea bugetului de stat pe anul 2008 nr. 388/2007, cu modificările şi
completările ulterioare, cu destinaţia cheltuieli aferente obiectivelor de
investiţii cu finanţare de la bugetul de stat, la capitolul 84.01
„Transporturi", titlul „Alte transferuri", poziţia „Investiţii ale
agenţilor economici cu capital de stat", pentru obiectivul de investiţii în continuare
„Autostrada Bucureşti-Braşov, km 0+000-173+300".
Art. 4. - Suma prevăzută la art. 3 se virează de către
Ministerul Transporturilor, în termen de 15 zile de la intrarea în vigoare a
prezentei hotărâri, într-un cont bancar deschis pe numele Companiei Naţionale
de Autostrăzi şi Drumuri Naţionale din România - S.A., pentru lucrarea de
utilitate publică prevăzută la art. 1, în vederea efectuării despăgubirilor în
cadrul procedurilor de expropriere, în condiţiile legii.
Art. 5. - (1) Planul cu amplasamentul lucrării,
delimitarea suprafeţelor şi a construcţiilor supuse exproprierii, precum şi
tabelul prevăzut în anexa nr. 2 se aduc la cunoştinţă publică prin afişare la
sediul consiliilor locale implicate şi vor rămâne afişate până la finalizarea
procedurii de despăgubire.
(2) Planul cu amplasamentul lucrării va fi publicat şi
într-un ziar local, potrivit legii.
Art. 6. - Regularizarea documentaţiilor cadastrale se
va efectua de către expropriator, pe baza proiectului tehnic şi a detaliilor de
execuţie, fără a afecta dispoziţiile prezentei hotărâri, cu respectarea
reglementărilor în vigoare.
Art. 7. -Anexele nr. 1 şi 2 fac
parte integrantă din prezenta hotărâre.

acesteia, imposibilitatea publicării în Monitorul Oficial al României, Partea I, a hărţii topografice fiind determinată
de impedimente de natură tehnico-redacţională.
