    In temeiul art. 10 lit. b) din Ordonanta Guvernului nr. 42/2004 privind organizarea activitatii sanitar-veterinare si pentru siguranta alimentelor, aprobata si modificata prin Legea nr. 215/2004,
    vazand Referatul de aprobare nr. 23.464 din 15 noiembrie 2004, intocmit de Directia generala sanitara veterinara din structura Autoritatii Nationale Sanitare Veterinare si pentru Siguranta Alimentelor,

    presedintele Autoritatii Nationale Sanitare Veterinare si pentru Siguranta Alimentelor emite urmatorul ordin:

    Art. 1
    Se aproba Norma sanitara veterinara si pentru siguranta alimentelor ce stabileste conditii de sanatate publica, de sanatate animala si certificarea veterinara pentru activitati de import in Romania din tari terte de carne de ratite de crescatorie, prevazuta in anexa*) care face parte integranta din prezentul ordin.

    Art. 2
    Autoritatea Nationala Sanitara Veterinara si pentru Siguranta Alimentelor, institutele veterinare centrale si directiile sanitare veterinare si pentru siguranta alimentelor judetene si a municipiului Bucuresti vor duce la indeplinire prevederile prezentului ordin.
    Art. 3
    Prezentul ordin constituie transpunerea oficiala a Deciziei Comisiei 2000/609/CEE ce stabileste conditii de sanatate publica, de sanatate animala si certificarea veterinara pentru activitati de import in Romania din tari terte de carne de ratite de crescatorie, amendand Decizia 94/85/CE ce stabileste o lista de tari terte din care statele membre autorizeaza activitati de import de carne proaspata de pui, publicata in Jurnalul Oficial al Comunitatilor Europene (JOCE) nr. L 258 din 12 octombrie 2000, pag. 9.
    Art. 4
    Prezentul ordin va fi publicat in Monitorul Oficial al Romaniei, Partea I, si va intra in vigoare la 15 zile de la publicare.

    ANEXA 1

    NORMA SANITARA VETERINARA SI PENTRU SIGURANTA ALIMENTELOR CE STABILESTE CONDITII DE SANATATE PUBLICA, DE SANATATE ANIMALA SI CERTIFICAREA VETERINARA PENTRU ACTIVITATI DE IMPORT IN ROMANIA DIN TARI TERTE DE CARNE DE RATITE DE CRESCATORIE

    Art. 1
    Autoritatea Nationala Sanitara Veterinara si pentru Siguranta Alimentelor poate autoriza importul de carne proaspata de ratite de crescatorie numai din tari terte sau parti din tari terte mentionate la anexa nr. 1, cu conditia ca aceasta sa intruneasca cerintele certificatului de sanatate corespondent, stabilit la anexa nr. 2 si sa fie insotit de un asemenea certificat, completat corespunzator si semnat. Certificatul trebuie sa includa partea generala, conforma cu anexa nr. 2, Partea 1 si una dintre atestarile de sanatate specifice, conform cu anexa nr. 2, Partea 2, in conformitate cu modelul solicitat (A sau B) asa cum este specificat de anexa nr. 1.
    Art. 2
    La anexa la "Norma sanitara veterinara stabilind lista tarilor terte din care Romania autorizeaza importul de carne proaspata de pasare", este introdusa urmatoarea noua linie in conformitate cu ordinea alfabetica a codului ISO:

    Art. 3
    Lista mentionata la anexa nr. 1 la prezenta norma sanitara veterinara si pentru siguranta alimentelor se reactualizeaza periodic in conformitate cu modificarile efectuate de Comisia Europeana si publicate in Jurnalul Oficial al Comunitatilor Europene.
    Art. 4
    (1) Autoritatea Nationala Sanitara Veterinara si pentru Siguranta Alimentelor, poate pune in aplicare acte normative, reglementari si prevederi administrative, necesare pentru conformarea cu prezenta norma sanitara veterinara si pentru siguranta alimentelor, le va transmite Comisiei Europene, prin intermediul Ministerului Integrarii Europene si Misiunii Romaniei pe langa Uniunea Europeana, impreuna cu tabelele de concordanta, in vederea evaluarii conformitatii transpunerii legislative si va stabili masurile necesare pentru implementarea corecta si la timp a prevederilor prezentei norme sanitare veterinare si pentru siguranta alimentelor.
    (2) Atunci cand Autoritatea Nationala Sanitara Veterinara si pentru Siguranta Alimentelor adopta cele mentionate la alin. 1, trebuie sa faca o referire expresa la prezenta norma sanitara veterinara si pentru siguranta alimentelor la publicarea oficiala a acesteia. Procedura privind realizarea referirii mentionate ramane in responsabilitatea Autoritatii Nationale Sanitare Veterinare si pentru Siguranta Alimentelor.
    (3) Autoritatea Nationala Sanitara Veterinara si pentru Siguranta Alimentelor va lua masurile necesare si va sanctiona, potrivit legii, orice incalcare a prevederilor prezentei norme sanitare veterinare si pentru siguranta alimentelor. De asemenea, va facilita intocmirea documentelor necesare pentru sanctionarea incalcarii legislatiei veterinare si pentru siguranta alimentelor ce constituie infractiuni.
    (4) Prezenta norma sanitara veterinara si pentru siguranta alimentelor constituie transpunerea oficiala a Deciziei Comisiei 2000/609/CEE.
    Art. 5
    Anexele nr. 1 si 2 fac parte integranta din prezenta norma sanitara veterinara si pentru siguranta alimentelor.

    (1) Carne proaspata de ratite inseamna oricare parte ce provine de la ratite de crescatorie, excluzand organele, proprie pentru consum uman si care nu a fost supusa nici unui alt tratament, decat tratamentul prin frig ce asigura pastrarea (conservarea) acesteia. Carnea ambalata sub vid sau carnea ambalata in atmosfera controlata trebuie, de asemenea, sa fie insotita de un certificat in conformitate cu acest model.
    (1) Fresh ratite meat means any parts, excluding offal, of farmed ratites which are fit for human consumption and which have not undergone any treatment other that cold treatment to ensure the preservation. Vacuum wrapped meat or meat wrapped in a controlled atmosphere must also be accompanied by a certificate according to this model.

    3.2. nu a venit in contact, in nici un moment al taierii, transarii, stocarii si transportului, cu ratite sau carne ce nu indeplineste cerintele "Normei sanitare veterinare privind conditiile de sanatate animala ce reglementeaza comertul statelor membre ale Uniunii Europene cu Romania si importul din tari terte de carne proaspata de pasare", aprobata prin Ordinul ministrului agriculturii, alimentatiei si padurilor nr. 391/29.08.2002, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 739/09.10.2002, norma ce transpune Directiva 91/494/CEE.
    3.2. has not been in contact, at any time of slaughter, cutting, storage or transport with ratites or meat which do not fulfill the requirements of Directive 91/494/CEE.

    II. Certificare pentru sanatate publica

Ca au fost indeplinite garantiile referitoare la animale vii si produse ale acestora, furnizate de planurile pentru reziduuri, transmise Comisiei in conformitate cu articolul 26 al "Normei sanitare veterinare privind masurile de supraveghere si control al unor substante si a reziduurilor acestora la animalele vii si la produsele lor", aprobata prin Ordinul ministrului agriculturii, alimentatiei si padurilor nr. 357/14.09.2001, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 812/18.12.2001, norma ce transpune Directiva 96/23/CE.
    4. That the guarantees on live animals and products thereof provided by the residue plans submitted according to Article 29 of Directive 96/23/EC are fulfilled.
    5. Ca, in fapt, carnea descrisa mai sus este obtinuta de la ratite ce:

    5.1. fie au fost insotite, pana la sosirea la abator, de un certificat veterinar emis de medicul veterinar responsabil de exploatatia de origine, stabilind ca acestea au fost supuse unei inspectii veterinare ante-mortem, in conformitate cu cerintele articolului 8 al "Normei sanitare veterinare privind problemele de sanatate publica si sanatate a animalelor ce reglementeaza producerea si comercializarea carnii de iepure si a carnii de vanat de crescatorie", aprobata prin Ordinul ministrului agriculturii, alimentatiei si padurilor nr. 257/14.04.2003, publicat in Monitorul Oficial al Romaniei nr. 257/14.04.2003, norma ce transpune Directiva 91/495/CEE, in exploatatia de origine, intr-o perioada de 72 de ore anterior incarcarii,
    5.1. either, were accompanied on arrival at the slaughterhouse by a veterinary certificate issued by the veterinarian responsible for the holding of origin, stating that they had passed a veterinary ante-mortem inspection in accordance with the requirements of Article 8 of Directive 91/495/EEC on the holding of origin within 72 hours prior to loading, or
    5.2. fie au fost supuse unei inspectii veterinare ante-mortem, in conformitate cu cerintele articolului 8 al "Normei sanitare veterinare privind problemele de sanatate publica si sanatate a animalelor ce reglementeaza producerea si comercializarea carnii de iepure si a carnii de vanat de crescatorie" ce transpune Directiva 91/495/CEE, la abatorul autorizat, intr-o perioada de 72 de ore imediat anterior taierii.
    5.2. passed a veterinary ante-mortem inspection in accordance with the requirements of Article 8 of Directive 91/495/EEC at the approved slaughterhouse in the 72 hours immediately prior to slaughter.
    6. Ca taierea ratitelor a avut loc intr-un abator autorizat, in conformitate cu articolul 8 al "Normei sanitare veterinare privind problemele de sanatate publica si sanatate a animalelor ce reglementeaza producerea si comercializarea carnii de iepure si a carnii de vanat de crescatorie" ce transpune Directiva 91/495/CEE, cu conditia ca aceasta intreprindere sa fie echipata potrivit pentru acest scop.
    6. That the slaughtering of the ratites took place in a slaughterhouse approved according to Article 8 of Directive 91/495/EEC provided that this establishment is suitably equipped for this purpose.
    7. Ca unitatile pentru taiere, manipulare sau transare au fost complet curatate si dezinfectate, sub supraveghere oficiala, inainte de a fi utilizate pentru producerea carnii la care s-a referit acest certificat.

    8.1. a fost manipulata in baza conditiilor de igiena ce intrunesc conditiile de la articolul 8 al "Normei sanitare veterinare privind problemele de sanatate publica si sanatate a animalelor ce reglementeaza producerea si comercializarea carnii de iepure si a carnii de vanat de crescatorie" ce transpune Directiva 91/495/CEE;
    8.1. was handled under conditions of hygiene meeting the conditions of Article 8 of Directive 91/495/EEC;
    8.2. a fost supusa unei inspectii post-mortem, in conformitate cu cerintele articolului 8 al "Normei sanitare veterinare privind probleme de sanatate publica si sanatate a animalelor ce afecteaza producerea si comercializarea carnii de iepure si a carnii de vanat de crescatorie" ce transpune Directiva 91/495/CEE si este considerata proprie pentru consumul uman;
