Infrastructurii privind activitatea de privatizare pe anul 2010
ACT EMIS DE:
GUVERNUL ROMANIEI
ACT PUBLICAT IN:
MONITORUL OFICIAL NR. 212 din 2 aprilie 2010
In temeiul art. 108 din Constituţia României,
republicată, al art. 9 alin. (1) din Ordonanţa de urgenţă a
Guvernului nr. 88/1997 privind privatizarea societăţilor comerciale,
aprobată prin Legea nr. 44/1998, cu modificările şi
completările ulterioare, al art. 51 din Legea nr. 137/2002 privind unele
măsuri pentru accelerarea privatizării, cu modificările şi
completările ulterioare,
în conformitate cu dispoziţiile Ordonanţei de
urgenţă a Guvernului nr. 148/2002 pentru asigurarea condiţiilor
de finanţare a organizării şi desfăşurării
activităţilor legate de procesul de privatizare derulate prin
Ministerul Lucrărilor Publice, Transporturilor şi Locuinţei,
aprobată cu modificări prin Legea nr. 57/2003,
Guvernul României adoptă
prezenta hotărâre.
Art. 1. - Se aprobă bugetul propriu de venituri
şi cheltuieli al Ministerului Transporturilor şi Infrastructurii
privind activitatea de privatizare pe anul 2010, prevăzut în anexa care
face parte integrantă din prezenta hotărâre.
Art. 2. - (1) Cheltuielile totale aferente veniturilor
înscrise în bugetul de venituri şi cheltuieli al Ministerului
Transporturilor şi Infrastructurii reprezintă limite maxime, care nu
pot fi depăşite decât în cazuri justificate şi numai cu
aprobarea Guvernului.
(2) In cazul în care în execuţia bugetului de
venituri şi cheltuieli se înregistrează nerealizari ale veniturilor
totale aprobate, Ministerul Transporturilor şi Infrastructurii va efectua
cheltuieli totale proporţional cu gradul de realizare a veniturilor
totale.
Art. 3. -In scopul desfăşurării
corespunzătoare a activităţii sale, Ministerul Transporturilor
şi Infrastructurii reţine la dispoziţia sa, din veniturile
încasate în cursul anului 2010, o sumă reprezentând jumătate din
cuantumul cheltuielilor prevăzute în bugetul său de venituri şi
cheltuieli aferent activităţii de privatizare pe anul 2010.
Art. 4. - (1) Nerespectarea prevederilor art. 2
constituie contravenţie şi se sancţionează cu amendă
de la 1.000 lei la 5.000 lei.
(2) Contravenţiei prevăzute la alin. (1) i se
aplică dispoziţiile Ordonanţei Guvernului nr. 2/2001 privind
regimul juridic al contravenţiilor, aprobată cu modificări
şi completări prin Legea nr. 180/2002, cu modificările şi
completările ulterioare.
(3) Contravenţia se constată de către
organele de control financiar ale statului, împuternicite potrivit legii,
şi amenda se aplică persoanelor vinovate de nerespectarea
prevederilor prezentei hotărâri.
