privind reglementarea drepturilor salariale si a altor drepturi ale
functionarilor publici pentru anul 2006

In temeiul art. 108 din Constitutia Romaniei, republicata, si al art. 1
pct. X.9 din Legea nr. 404/2005 privind abilitarea Guvernului de a emite
ordonante,
Guvernul Romaniei adopta prezenta ordonanta.
CAP. 1
Dispozitii generale
ART. 1
(1) Prezenta ordonanta reglementeaza drepturile salariale si alte drepturi
ale functionarilor publici pentru anul 2006.
(2) Sistemul de salarizare cuprinde salariile de baza, sporurile, premiile,
stimulentele si alte drepturi.
ART. 2
Prezenta ordonanta se aplica functionarilor publici numiti in temeiul Legii
nr. 188/1999 privind Statutul functionarilor publici, republicata, cu
modificarile ulterioare.
ART. 3
Gestiunea sistemului de salarizare a functionarilor publici se asigura de
fiecare ordonator principal de credite, cu incadrarea in resursele financiare
si in numarul maxim de posturi aprobate potrivit legii.
CAP. 2
Elementele sistemului de salarizare a functionarilor publici
SECTIUNEA 1
Salarii de baza
ART. 4
Salariul de baza se stabileste in functie de categorie, de clasa care
reflecta nivelul studiilor necesare exercitarii functiei publice si, dupa caz,
cu gradul profesional al functiei publice, precum si in raport cu nivelul la
care se presteaza activitatea, respectiv la nivel central sau local, potrivit
anexelor nr. I - V pentru luna ianuarie, nr. Ia - Va pentru perioada februarie
- august 2006 si, respectiv, anexelor nr. Ib - Vb pentru perioada septembrie -
decembrie 2006.
ART. 5
(1) Pentru functiile publice de prefect, subprefect, secretar general,
secretar general adjunct, secretar general al judetului, secretar general al
municipiului Bucuresti si secretar al unitatii administrativ-teritoriale,
salariile de baza sunt stabilite la lit. A din anexele la prezenta ordonanta.
(2) Pentru fiecare grad profesional al functiei publice de executie se
stabilesc trei trepte de salarizare, potrivit anexelor la prezenta ordonanta.
(3) Functiile publice de executie de grad profesional debutant au un singur
nivel al salariilor de baza prevazute in anexele la prezenta ordonanta.
(4) Pana la adoptarea sistemului unitar de salarizare pentru functionarii
publici, functionarii publici de conducere isi pastreaza nivelul salariilor de
baza ale functiilor publice de executie corespunzatoare, la care se adauga
indemnizatia de conducere, cu exceptiile prevazute de prezenta ordonanta.
ART. 6
(1) Salariile de baza ale functionarilor publici aflati in corpul de
rezerva si care in cursul anului 2006 sunt redistribuiti intr-o functie
publica, in conditiile legii, se stabilesc la nivelul treptei 3 de salarizare,
corespunzatoare categoriei, clasei si gradului profesional in care sunt
incadrati.
(2) Salariile de baza ale persoanelor care ocupa in anul 2006 o functie
publica de executie, in conditiile legii, se stabilesc la nivelul treptei 3 de
salarizare, corespunzatoare categoriei, clasei si gradului profesional in care
sunt numite.
(3) Functionarii publici promovati in cursul anului 2006 pe o functie
publica de executie de un grad profesional superior celui detinut beneficiaza
de salariile de baza prevazute in anexele la prezenta ordonanta, pentru gradul
profesional in care promoveaza, la treapta 3 de salarizare. Daca functionarul
public are un salariu de baza mai mare decat cel prevazut la treapta 3 de
salarizare, salariul de baza de care beneficiaza dupa promovarea in gradul
profesional se stabileste potrivit treptei de salarizare imediat superioare
care asigura o crestere salariala.
(4) Functionarii publici care ocupa in anul 2006, in conditiile legii,
functia publica de director general sau o alta functie publica de conducere
beneficiaza de salariul de baza prevazut pentru functia publica de executie
detinuta anterior, la care se adauga indemnizatia de conducere. In situatia in
care salariul de baza prevazut pentru functia publica de executie detinuta
anterior este mai mic decat salariul de baza al functiei publice de executie
aferente functiei publice de conducere vacante, prevazuta in statul de functii,
functionarul public va beneficia de acesta. De aceasta prevedere beneficiaza si
functionarii publici numiti in functii publice de conducere anterior anului
2006, drepturile salariale urmand a fi acordate de la data intrarii in vigoare
a prezentei ordonante.
(5) Pentru candidatii declarati admisi la concursul pentru ocuparea
functiei publice de director general sau a unei alte functii publice de
conducere, organizat in cursul anului 2006, care nu au avut anterior calitatea
de functionar public, salariul de baza se stabileste prin actul administrativ
al ordonatorului de credite, pana la nivelul de finantare prevazut in statul de
functii, aprobat potrivit legii.
(6) Functionarii publici care se transfera in cursul anului 2006
beneficiaza de un salariu de baza corespunzator treptei de salarizare detinute,
potrivit autoritatii sau institutiei publice la care se transfera, conform
anexelor la prezenta ordonanta, cu exceptia cazului in care functionarul public
se transfera la cerere intr-o functie publica de nivel inferior, situatie in
care salariul de baza si treapta de salarizare sunt cele prevazute pentru
functia publica vacanta respectiva.
ART. 7
(1) Salariile de baza ale functionarilor publici numiti in functii publice
specifice se stabilesc de ordonatorii principali de credite, prin asimilare cu
salariile de baza ale functionarilor publici numiti in functii publice
generale, in raport cu categoria, clasa si, dupa caz, gradul profesional al
functiei publice, cu avizul Agentiei Nationale a Functionarilor Publici.
(2) In situatia in care functiile publice specifice au fost avizate de
Agentia Nationala a Functionarilor Publici prin echivalare cu functii publice
generale pana la data intrarii in vigoare a prezentei ordonante, salariile de
baza ale functionarilor publici numiti in functii publice specifice se
stabilesc potrivit avizului Agentiei Nationale a Functionarilor Publici.
(3) In cazul autoritatilor si institutiilor publice care au stabilit functii
publice potrivit Legii nr. 161/2003 privind unele masuri pentru asigurarea
transparentei in exercitarea demnitatilor publice, a functiilor publice si in
mediul de afaceri, prevenirea si sanctionarea coruptiei, cu modificarile si
completarile ulterioare, persoanele incadrate cu contract individual de munca
in posturi care presupun exercitarea atributiilor de natura celor prevazute la
art. 2 alin. (3) din Legea nr. 188/1999, republicata, cu modificarile
ulterioare, vor fi numite in functiile publice stabilite si avizate. Salariile
de baza vor fi stabilite, in conditiile legii, de Agentia Nationala a
Functionarilor Publici, pe baza propunerilor inaintate de ordonatorii de
credite.
ART. 8
(1) Pentru rezultate deosebite obtinute in activitatea desfasurata,
ordonatorul de credite poate acorda, in limita a 20% din numarul de posturi
corespunzatoare functiilor publice, prevazut in statul de functii, un salariu
de merit lunar de pana la 15% din salariul de baza, care face parte din acesta
si care constituie baza de calcul pentru sporuri si alte drepturi care se
acorda in raport cu salariul de baza. Ordonatorii principali de credite care au
in subordine unitati bugetare cu un numar redus de functii publice pot aproba
ca incadrarea in numarul maxim de beneficiari de salariu de merit si in
proportiile stabilite pentru functiile publice de executie sa se faca la
nivelul unitatilor respective luate impreuna; repartizarea numarului de
beneficiari de salariu de merit pe unitatile luate in calcul, in acest caz, se
face de catre ordonatorul principal de credite.
(2) Salariile de merit se acorda functionarilor publici incadrati pe
functii publice de executie in proportie de cel putin doua treimi din numarul
total al functiilor publice stabilit in conditiile alin. (1).
(3) In cursul anului 2006, dupa aprobarea bugetului anual, pe baza
rezultatelor obtinute in activitatea desfasurata in anul anterior, se stabilesc
functionarii publici care beneficiaza de salariu de merit.
(4) Pot beneficia de salariu de merit functionarii publici care nu au fost
sanctionati si cei a caror sanctiune a fost radiata de drept, potrivit legii.
Ordonatorii de credite pot stabili, cu consultarea organizatiilor sindicale
reprezentative ale functionarilor publici, criterii suplimentare pentru
acordarea salariilor de merit.
(5) In cazul in care pe parcursul anului 2006 intervin modificari ale
raportului de serviciu din motive care nu sunt imputabile functionarului
public, inclusiv modificarea raportului de serviciu prin promovarea functionarului
public in cauza, salariul de merit acordat se mentine pana la expirarea
perioadei pentru care a fost stabilit.
(6) In cazul in care pe parcursul anului 2006 raporturile de serviciu ale
functionarilor publici care beneficiaza de salariu de merit inceteaza sau se
suspenda, salariile de merit se redistribuie, incepand cu data de intai a lunii
urmatoare, altor functionari publici care indeplinesc conditiile pentru
acordare.
(7) Pentru functionarii publici nou-angajati salariul de merit se poate
acorda dupa o perioada de cel putin 6 luni de la angajare.
(8) Functionarii publici debutanti nu pot beneficia de salariu de merit.
ART. 9
(1) Promovarea, in conditiile legii, a persoanelor incadrate in functia de
debutant se face prin transformarea postului pe care acestea sunt incadrate. In
termenul prevazut de lege, autoritatile si institutiile publice vor comunica
Agentiei Nationale a Functionarilor Publici modificarile respective.
(2) Promovarea, in conditiile legii, a persoanelor care au absolvit studii
de nivel superior in specialitatea in care isi desfasoara activitatea se face
prin transformarea postului pe care acestea sunt incadrate, cu avizul Agentiei
Nationale a Functionarilor Publici.
(3) Functionarii publici care absolva o forma de invatamant superior de
lunga sau de scurta durata, incadrati pe functii publice cu nivel de studii
inferior, se numesc, prin examen, intr-o functie publica de executie, un grad
profesional si o treapta de salarizare care sa le asigure acestora o crestere
de pana la 20% a salariului de baza avut anterior. Examenul se organizeaza de
autoritatea sau institutia publica in care isi desfasoara activitatea
functionarul public, pe baza unui regulament-cadru aprobat prin ordin al
presedintelui Agentiei Nationale a Functionarilor Publici. In cazul in care,
dupa aplicarea procentului de 20%, salariul de baza astfel stabilit se situeaza
sub nivelul prevazut pentru gradul profesional asistent, treapta de salarizare
3, se va acorda salariul de baza de la acest nivel.
ART. 10
Functionarul public care exercita cu caracter temporar pe o perioada mai
mare de 30 de zile, in conditiile legii, o functie publica corespunzatoare
categoriei inaltilor functionari publici sau categoriei functionarilor publici
de conducere are dreptul la salariul de baza corespunzator functiei publice
exercitate temporar, astfel cum este prevazut in statul de functii.
SECTIUNEA a 2-a
Sporuri
ART. 11
(1) Functionarii publici salarizati potrivit prezentei ordonante beneficiaza
de un spor de vechime in munca de pana la 25%, calculat la salariul de baza
corespunzator timpului lucrat in program normal de lucru, astfel:

(2) Sporul corespunzator vechimii in munca se plateste cu incepere de la
data de intai a lunii urmatoare celei in care s-a implinit vechimea in munca,
prevazuta la transa respectiva.
(3) Pentru acordarea sporului de vechime in munca, autoritatea sau
institutia publica va lua in considerare integral si perioadele lucrate
anterior in alte domenii de activitate decat cele bugetare.
ART. 12
Functionarii publici care, potrivit programului normal de lucru, isi
desfasoara activitatea in timpul noptii, intre orele 22,00 si 6,00, beneficiaza
pentru orele lucrate in acest interval de un spor pentru munca prestata in
timpul noptii de 25% din salariul de baza, daca timpul astfel lucrat reprezinta
cel putin jumatate din programul normal de lucru.
ART. 13
(1) Orele prestate peste durata normala a timpului de lucru de functionarii
publici numiti in functii publice de executie, de conducere sau din categoria
inaltilor functionari publici se vor plati cu un spor din salariul de baza,
dupa cum urmeaza:
a) 75% din salariul de baza pentru primele doua ore de depasire a duratei
normale a zilei de lucru;
b) 100% din salariul de baza pentru orele urmatoare. Cu spor de 100% se
platesc si orele lucrate in zilele de repaus saptamanal sau in celelalte zile
in care, in conformitate cu reglementarile in vigoare, nu se lucreaza.
(2) Munca prestata potrivit alin. (1) poate fi compensata cu timp liber
corespunzator, la cererea functionarului public, in conditiile in care orele nu
au fost platite.
(3) Munca peste durata normala a timpului de lucru poate fi prestata si
sporurile prevazute la alin. (1) se pot plati numai daca efectuarea orelor
suplimentare a fost dispusa de seful ierarhic, fara a se depasi 360 de ore
anual.
ART. 14
Functionarii publici care poseda titlul stiintific de "doctor"
beneficiaza de un spor pentru titlul stiintific de 15% din salariul de baza,
daca isi desfasoara activitatea in domeniul pentru care poseda titlul
stiintific respectiv, care se plateste cu incepere de la data de intai a lunii
urmatoare celei in care s-a solicitat acordarea acestuia.
ART. 15
(1) Sporul de confidentialitate se acorda functionarilor publici din
aparatul de lucru al Guvernului in cuantum de pana la 15% din salariul de baza,
precum si functionarilor publici din cadrul Administratiei Prezidentiale,
Consiliului National pentru Studierea Arhivelor Securitatii, Ministerului
Afacerilor Externe, Ministerului Integrarii Europene, directiilor subordonate
ministrului delegat pentru comert din cadrul Ministerului Economiei si
Comertului, Consiliului Legislativ.
(2) Categoriile de functionari publici, cuantumurile sporului de
confidentialitate si conditiile de acordare se stabilesc, in limitele prevazute
de lege, prin actul administrativ al ordonatorului principal de credite, cu
incadrarea in cheltuielile de personal prevazute in bugetul aprobat.
ART. 16
(1) Spor pentru conditii vatamatoare, de pana la 10% din salariul de baza,
se acorda functionarilor publici care desfasoara activitate in autoritatile si
institutiile publice in care functioneaza instalatii care genereaza campuri
electromagnetice de radiofrecventa produse de emitatori pentru comunicatii,
instalatii de microunde, instalatii de curenti de inalta frecventa, statii de
bruiaj.
(2) Categoriile de functionari publici, cuantumul sporului prevazut la
alin. (1) si conditiile de acordare se stabilesc, in limitele prevazute de
lege, prin actul administrativ al ordonatorului principal de credite, cu
incadrarea in cheltuielile de personal prevazute in bugetul aprobat.
(3) Locurile de munca pentru care se acorda sporul prevazut la alin. (1)
vor fi stabilite pe baza buletinelor de determinare emise de catre autoritatile
abilitate in acest sens.
ART. 17
(1) Spor pentru conditii periculoase, in cuantum de pana la 50% din
salariul de baza, se acorda functionarilor publici din cadrul Ministerului
Agriculturii, Padurilor si Dezvoltarii Rurale si al Autoritatii Nationale
Sanitare Veterinare si pentru Siguranta Alimentelor, care participa efectiv in
campaniile de prevenire si combatere a zoonozelor deosebit de grave si altele
asemenea, stabilite prin ordin al ministrului agriculturii, padurilor si
dezvoltarii rurale, numai pe perioada cat participa la aceste campanii.
(2) Categoriile de functionari publici, cuantumurile sporului prevazut la
alin. (1) si conditiile de acordare se stabilesc, in limitele prevazute de
lege, prin actul administrativ al ordonatorului principal de credite, cu
incadrarea in cheltuielile de personal prevazute in bugetul aprobat.
ART. 18
(1) Functionarii publici din cadrul Oficiului pentru Migratia Fortei de
Munca, care participa la selectia si recrutarea fortei de munca pentru lucrul
in strainatate, pot beneficia de un spor de pana la 5% din salariul de baza.
(2) Categoriile de functionari publici, cuantumurile sporului prevazut la
alin. (1) si conditiile de acordare se stabilesc, in limitele prevazute de
lege, prin actul administrativ al ordonatorului principal de credite, cu
incadrarea in cheltuielile de personal prevazute in bugetul aprobat.
SECTIUNEA a 3-a
Premii
ART. 19
(1) Pentru activitatea desfasurata functionarii publici au dreptul la un
premiu anual, egal cu salariul mediu lunar de baza realizat in anul pentru care
se face premierea.
(2) Premiul anual se plateste in luna ianuarie 2007.
(3) Pentru functionarii publici care nu au lucrat tot timpul anului,
premiul anual se acorda proportional cu perioada lucrata si se stabileste
luandu-se in calcul media salariilor de baza realizate in perioada in care au
desfasurat activitate, raportat la 12 luni.
(4) Ordonatorii de credite pot reduce sau anula premiul anual in cazul
functionarilor publici care in cursul anului 2006 au fost sanctionati disciplinar.
ART. 20
(1) Ordonatorii de credite pot acorda premii lunare in limita a 10% din
cheltuielile cu salariile aferente functiilor publice prevazute in statul de
functii, cu incadrarea in fondurile aprobate anual prin buget cu aceasta
destinatie. Premiile se pot acorda in cursul anului functionarilor publici care
au realizat sau au participat direct la obtinerea unor rezultate in activitate,
apreciate ca valoroase. Sumele neconsumate pot fi utilizate in lunile
urmatoare, in cadrul aceluiasi an bugetar.
(2) Ordonatorii principali de credite pot acorda premii in limita de pana
la 5% din cheltuielile cu salariile aferente functiilor publice prevazute in
statul de functii, din economiile realizate prin reducerea cheltuielilor cu
salariile, fara a depasi valoarea economiilor realizate. Premiile se pot acorda
in cursul anului functionarilor publici care au realizat sau au participat
direct la obtinerea unor rezultate in activitate apreciate ca valoroase.
(3) Premiile individuale se stabilesc de catre ordonatorii de credite in
limita sumelor alocate cu aceasta destinatie de catre ordonatorii principali de
credite, cu consultarea organizatiilor sindicale reprezentative la nivel de
unitate sau, dupa caz, cu consultarea reprezentantilor functionarilor publici,
acolo unde nu sunt astfel de organizatii sindicale.
ART. 21
(1) Autoritatile si institutiile publice care au dreptul de a constitui un
fond de stimulare potrivit legii pot acorda stimulente functionarilor publici,
in limitele prevazute de dispozitiile legale in vigoare. Modul de constituire
din fiecare sursa si conditiile de utilizare a fondului se stabilesc cu
consultarea organizatiilor sindicale reprezentative, prin hotarare a
Guvernului.
(2) Pana la intrarea in vigoare a hotararii Guvernului prevazute la alin.
(1), raman aplicabile reglementarile existente privind constituirea si
conditiile de utilizare a fondurilor pentru stimularea personalului.
ART. 22
Consiliile locale pot constitui, in limita a 5% din cheltuielile cu salariile
aferente anului respectiv pentru functiile publice prevazute in statul de
functii, un fond de premiere, in cazul in care veniturile curente acopera in
totalitate cheltuielile de personal, inclusiv acest fond de premiere. Fondul
poate fi utilizat conform criteriilor si conditiilor stabilite prin hotarare a
consiliului local, in luna decembrie a anului 2006.
SECTIUNEA a 4-a
Alte drepturi
ART. 23
(1) Functionarii publici au dreptul anual la un concediu de odihna platit,
in raport cu vechimea lor in munca, dupa cum urmeaza:

(2) Concediul de odihna se efectueaza in fiecare an calendaristic, integral
sau fractionat. In cazul in care programarea concediului se face fractionat,
conducatorul autoritatii sau institutiei publice este obligat sa stabileasca
programarea astfel incat una dintre fractiuni sa fie de cel putin 15 zile
lucratoare, neintrerupt. La solicitarea motivata a functionarului public, se
pot acorda fractiuni neintrerupte mai mici de 15 zile lucratoare.
(3) In cazul in care functionarul public, din motive justificate, nu poate
efectua, integral sau partial, concediul de odihna la care avea dreptul in anul
calendaristic 2006, cu acordul persoanei in cauza, autoritatea sau institutia
publica este obligata sa acorde concediul de odihna neefectuat, pana la
sfarsitul anului 2007.
(4) Compensarea in bani a concediului de odihna neefectuat este permisa in
cazul incetarii raporturilor de serviciu ale functionarilor publici.
(5) Functionarii publici beneficiaza, pe perioada efectuarii concediului
anual de odihna la care sunt indreptatiti conform legii, de o indemnizatie
pentru concediul de odihna. La determinarea indemnizatiei de concediu de odihna
se vor lua in calcul, pe langa salariul de baza, si sporurile de care
beneficiaza, potrivit legii.
(6) La cererea functionarului public, indemnizatia de concediu de odihna se
plateste de catre autoritatea sau institutia publica cu cel putin 5 zile
lucratoare inainte de plecarea in concediu.
(7) Celelalte prevederi ale Hotararii Guvernului nr. 250/1992 privind
concediul de odihna si alte concedii ale salariatilor din administratia
publica, din regiile autonome cu specific deosebit si din unitatile bugetare,
republicata, cu modificarile ulterioare, raman in vigoare.
ART. 24
In afara concediului de odihna, functionarii publici mai au dreptul, in
conditiile legii, la zile de concediu platit in cazul urmatoarelor evenimente
familiale deosebite:
a) casatoria functionarului public - 5 zile lucratoare;
b) nasterea sau casatoria unui copil - 3 zile lucratoare;
c) decesul sotiei/sotului functionarului public sau al unei rude de pana la
gradul al III-lea a functionarului public ori a sotului/sotiei acestuia,
inclusiv - 3 zile lucratoare;
d) controlul medical anual - o zi lucratoare.
ART. 25
Pe perioada in care functionarii publici sunt trimisi in delegare in alte
localitati decat cea in care isi desfasoara activitatea, autoritatile sau
institutiile publice le acorda indemnizatii de delegare si le deconteaza
cheltuielile de transport si de cazare, in conditiile stabilite pentru
personalul din institutiile publice.
ART. 26
(1) Cand detasarea sau mutarea temporara in cadrul altui compartiment se
face pe o functie publica la care este stabilit un salariu de baza mai mare,
functionarii publici detasati sau trecuti temporar in alta activitate au
dreptul la acest salariu in conditiile prevazute de lege.
(2) Pe perioada detasarii sau mutarii temporare in cadrul altui
compartiment functionarii publici primesc, pe langa salariul de baza stabilit
potrivit alin. (1), si celelalte drepturi ce se acorda personalului din
autoritatea sau institutia publica respectiva.
(3) Drepturile ce se acorda pe timpul detasarii sau mutarii temporare in
cadrul altui compartiment se suporta de autoritatea sau institutia publica in
care functionarul public respectiv isi desfasoara activitatea.
ART. 27
(1) Functionarul public mutat, in cadrul aceleiasi autoritati sau
institutii publice, in alta localitate are dreptul la:
a) rambursarea costului transportului pentru el si membrii familiei sale,
precum si pentru bunurile din gospodaria sa;
b) plata unei indemnizatii egale cu salariul de baza net din ultima luna;
c) un concediu platit de 5 zile lucratoare, in vederea mutarii efective,
acordat la cererea sa.
(2) Mutarea in alta localitate se va putea face, in toate cazurile, numai
cu asigurarea unei locuinte de serviciu, in conditiile legii.
ART. 28
(1) De drepturile prevazute la art. 27 alin. (1) lit. c) beneficiaza si
functionarii publici care solicita sa fie transferati in alta autoritate sau
institutie publica situata intr-o localitate diferita de cea de domiciliu, daca
in cererea de transfer s-a facut aceasta mentiune.
(2) Plata drepturilor respective se suporta de autoritatea sau institutia
publica la care se face transferul.
ART. 29
(1) La incadrarea intr-o autoritate sau institutie publica din alta
localitate decat cea de domiciliu, in primul an de activitate dupa absolvirea
studiilor, functionarii publici beneficiaza de o indemnizatie de instalare
egala cu un salariu de baza corespunzator functiei publice de debutant in care
urmeaza sa fie incadrati.
(2) Indemnizatia de instalare poate fi egala cu doua salarii de baza pentru
acele localitati unde atragerea specialistilor se face cu mare greutate. Lista
localitatilor respective se aproba prin hotarare a Guvernului, la propunerea
Ministerului Administratiei si Internelor, dupa consultarea organizatiilor
sindicale din administratia publica.
(3) Functionarii publici care au beneficiat de indemnizatia de instalare si
care ulterior au demisionat sau au incetat raporturile de serviciu din motive
imputabile lor inainte de implinirea unui an de la instalare vor restitui, in conditiile
legii, indemnizatia primita, calculata proportional cu perioada ramasa pana la
expirarea termenului de un an.
ART. 30
(1) Functionarii publici care isi continua studiile beneficiaza de concedii
de studii potrivit legii. In cazul in care conducatorul autoritatii sau
institutiei publice apreciaza ca studiile sunt utile autoritatii sau
institutiei publice in care functionarul public isi desfasoara activitatea, pe
perioada concediului de studii acordat, in limita a 30 de zile lucratoare anual
din acesta, functionarului public respectiv i se platesc salariul de baza
corespunzator functiei publice detinute si, dupa caz, sporul de vechime.
(2) Functionarii publici care urmeaza o forma de specializare sau de
perfectionare pe o durata mai mare de o luna, dar nu mai mult de un an, si care
primesc pe aceasta perioada drepturile salariale sunt obligati sa se angajeze
in scris ca vor lucra de la 1 la 3 ani in autoritatea sau institutia publica
respectiva. In cazul nerespectarii angajamentului, acestia vor restitui
autoritatii sau institutiei publice drepturile salariale primite pe perioada
cursurilor de specializare sau de perfectionare, proportional cu timpul ramas
pana la implinirea termenului, precum si celelalte drepturi acordate pe aceeasi
perioada de autoritatea sau institutia publica trimitatoare, cu exceptia
cazului in care functionarii publici respectivi nu mai detin functiile publice
din motive neimputabile acestora ori in cazul transferului in interesul
serviciului. Prevederile prezentului alineat se aplica si in situatia prevazuta
la alin. (1).
CAP. 3
Litigii
ART. 31
(1) Solutionarea contestatiilor in legatura cu stabilirea salariilor de
baza, sporurilor, premiilor si a altor drepturi care se acorda potrivit
prevederilor prezentei ordonante este de competenta ordonatorilor de credite.
(2) Contestatia poate fi depusa in termen de 5 zile de la data comunicarii
actului administrativ de stabilire a drepturilor salariale si a altor drepturi
ale functionarului public.
(3) Ordonatorii de credite vor solutiona contestatiile in termen de 10 zile
de la inregistrare, cu avizul organizatiilor sindicale reprezentative la nivel
de autoritate ori institutie publica sau, dupa caz, cu avizul reprezentantilor
functionarilor publici, acolo unde nu sunt astfel de organizatii sindicale.
(4) Impotriva masurilor dispuse potrivit prevederilor alin. (1) persoana in
cauza se poate adresa instantei de contencios administrativ sau, dupa caz,
instantei judecatoresti competente, potrivit legii, in termen de 30 de zile de
la data comunicarii solutionarii contestatiei.
CAP. 4
Dispozitii tranzitorii si finale
ART. 32
Prevederile prezentei ordonante se aplica si personalului vamal care are
calitatea de functionar public.
ART. 33
Pentru indeplinirea atributiilor ce revin unor posturi pe care sunt
incadrati functionari publici de executie si care devin temporar vacante, in
conditiile prevazute de art. 87 si 88 din Legea nr. 188/1999, republicata, cu
modificarile ulterioare, pot fi angajate cu contract individual de munca, pe o
perioada egala cu durata suspendarii, alte persoane care indeplinesc conditiile
prevazute de fisa postului, dar numai in situatia in care in corpul de rezerva
nu exista functionari publici care sa indeplineasca conditiile prevazute de
fisa postului.
ART. 34
(1) Avansarea in treapta de salarizare imediat superioara se face prin
transformarea posturilor ocupate de cei care indeplinesc conditiile de
avansare, de regula dupa aprobarea bugetului, la propunerea sefului
compartimentului in care lucreaza functionarul public, cu aprobarea
conducatorului autoritatii sau institutiei publice.
(2) La avansarea in treapta de salarizare imediat superioara se tine seama
de calitatile personale concretizate prin rezultatele obtinute in activitatea
profesionala, notate cu calificativul cel putin "bun" in anul
precedent. Vechimea minima necesara pentru avansarea in treapta de salarizare
imediat superioara este de 2 ani.
(3) In mod exceptional, vechimea minima prevazuta la alin. (2) poate fi
redusa la un an de catre conducatorul autoritatii sau institutiei publice.
ART. 35
(1) In anul 2006, functionarii publici incadrati in autoritati sau
institutii publice pot promova pe un post vacant, intr-un grad profesional
superior, pe baza de examen sau concurs.
(2) Examenul sau concursul va fi organizat la nivelul autoritatii sau
institutiei publice, care are obligatia de a afisa la loc vizibil posturile
vacante in vederea promovarii, cu 15 zile inainte de data sustinerii examenului
sau, dupa caz, a concursului, si de a comunica Agentiei Nationale a
Functionarilor Publici rezultatul examenului sau concursului de promovare.
(3) Conditiile minime de vechime in vederea inscrierii la examenul sau,
dupa caz, la concursul de promovare sunt cele prevazute in Hotararea Guvernului
nr. 1.209/2003 privind organizarea si dezvoltarea carierei functionarilor
publici, cu modificarile ulterioare.
(4) Posturile ramase vacante dupa promovarea functionarilor publici din autoritati
sau institutii publice, potrivit alin. (1), vor fi scoase la concurs in vederea
ocuparii, cu respectarea prevederilor Hotararii Guvernului nr. 1.209/2003, cu
modificarile ulterioare.
ART. 36
Salariul de baza al inaltilor functionari publici si al functionarilor
publici de conducere eliberati din functie in cursul anului 2006, din motive
neimputabile, numiti in conditiile legii intr-o functie publica de executie
vacanta pentru care indeplinesc conditiile prevazute in fisa postului, se stabileste
la nivelul aferent postului vacant prevazut in anexa corespunzatoare
autoritatii sau institutiei publice unde au fost numiti.
ART. 37
(1) Agentia Nationala a Functionarilor Publici acorda asistenta de
specialitate, coordoneaza metodologic si controleaza modul de aplicare a
dispozitiilor prezentei ordonante.
(2) Controlul aplicarii prevederilor legale privind salarizarea
functionarilor publici se realizeaza si de Ministerul Muncii, Solidaritatii
Sociale si Familiei si de Ministerul Finantelor Publice, potrivit atributiilor
din domeniul de activitate al acestor institutii.
ART. 38
(1) Salariile functionarilor publici sunt brute si impozabile, potrivit
legii.
(2) Data platii salariului se stabileste in conformitate cu prevederile legale
in vigoare.
ART. 39
(1) Salariile functionarilor publici se platesc inaintea oricaror alte
obligatii de plata ale autoritatii sau institutiei publice.
(2) Salariile functionarilor publici nu pot face obiectul unei executari
silite sau al altei masuri administrative ori judiciare decat in conditiile
legii.
(3) Salariile functionarilor publici nu pot face obiectul vreunei limitari
sau renuntari, cu exceptia retinerilor din salariu efectuate in conformitate cu
prevederile legale. Orice limitare sau renuntare efectuata cu incalcarea
acestui principiu este lovita de nulitate absoluta.
ART. 40
Functionarii publici ale caror raporturi de serviciu au fost suspendate in
conditiile legii si care isi reiau activitatea dupa data de 1 ianuarie 2006 vor
beneficia de salariile de baza prevazute de prezenta ordonanta, dupa
parcurgerea procedurii de reincadrare aplicate functionarilor publici in anul
2005, cu avizul Agentiei Nationale a Functionarilor Publici.
ART. 41
Functionarii publici care la data de 1 februarie 2006 au salariul de baza
mai mare decat salariul de baza stabilit potrivit prezentei ordonante isi
pastreaza salariul de baza avut, pe intregul an 2006.
ART. 42
Functionarii publici beneficiaza si de sporurile sau de alte drepturi
salariale prevazute de legislatia specifica autoritatii sau institutiei publice
in care isi desfasoara activitatea.
ART. 43
(1) Presedintele, vicepresedintele si membrii comisiilor pentru protectia
copilului, constituite potrivit legii, au dreptul la o indemnizatie de sedinta,
al carei cuantum se stabileste prin hotarare a consiliului judetean sau prin
hotarare a consiliilor locale ale sectoarelor municipiului Bucuresti si nu
poate depasi 5% din indemnizatia presedintelui consiliului judetean, respectiv
a primarului de sector.
(2) Secretarul comisiei pentru protectia copilului beneficiaza de o
indemnizatie al carei cuantum este de 75% din cea acordata unui membru al
comisiei.
ART. 44
Prezenta ordonanta se completeaza cu prevederile Legii nr. 188/1999,
republicata, cu modificarile ulterioare, precum si cu dispozitiile actelor
normative speciale care reglementeaza salarizarea si alte drepturi pentru
personalul bugetar.
ART. 45
(1) Functiile publice de prefect si subprefect vacante sau temporar vacante
pot fi ocupate in conditiile art. 80 din Legea nr. 188/1999, republicata, cu
modificarile ulterioare.
(2) In mod exceptional, in anul 2006, in situatii temeinic justificate,
functia publica de prefect si subprefect vacanta sau temporar vacanta poate fi
ocupata cu contract individual de munca pe durata determinata pana la
organizarea concursului pentru ocuparea acestor functii in conditiile legii,
salarizarea fiind cea stabilita pentru functia publica respectiva. In acest caz
se va initia cu celeritate procedura de organizare a concursului, in conditiile
legii.
(3) Concursul pentru ocuparea functiilor publice de prefect si subprefect
vacante la data intrarii in vigoare a prezentei ordonante se organizeaza in
termen de 60 de zile de la data intrarii in vigoare a acesteia.
ART. 46
Ordonatorii principali de credite pot aproba, o data pe trimestru, pana la
data de 1 septembrie 2006, in limita numarului maxim de posturi prevazut in
anexele la Legea bugetului de stat pe anul 2006 nr. 379/2005 si la Legea
bugetului asigurarilor sociale de stat pe anul 2006 nr. 380/2005, cu incadrarea
in nivelul alocatiilor bugetare aprobate pentru cheltuielile cu salariile,
numai pentru posturile corespunzatoare functiilor publice vacante, utilizarea
unui numar mai mare de posturi de nivel inferior sau de acelasi nivel, prin
reducerea corespunzatoare a unui numar de posturi de nivel superior, precum si
modificarea in ceea ce priveste calitatea acestor posturi, cu avizul
Ministerului Finantelor Publice si al Agentiei Nationale a Functionarilor
Publici. Fac exceptie de la obtinerea avizului Administratia Prezidentiala,
Camera Deputatilor, Senatul, Curtea de Conturi, Consiliul Legislativ, Curtea
Constitutionala, Consiliul National pentru Studierea Arhivelor Securitatii si
Consiliul Concurentei.
ART. 47
Autoritatile si institutiile publice care nu au obtinut avizele de
reincadrare potrivit Ordonantei de urgenta a Guvernului nr. 92/2004, aprobata
cu modificari si completari prin Legea nr. 76/2005, sunt obligate ca, in termen
de 45 de zile de la data intrarii in vigoare a prezentei ordonante, sa
transmita Agentiei Nationale a Functionarilor Publici documentatia necesara
avizarii.
ART. 48
La data intrarii in vigoare a prezentei ordonante se suspenda aplicarea
dispozitiilor lit. c) si d) ale art. 29 alin. (1) din Legea nr. 188/1999
privind Statutul functionarilor publici, republicata, cu modificarile
ulterioare, pana la 31 decembrie 2006.
ART. 49
La data intrarii in vigoare a prezentei ordonante se abroga:
a) dispozitiile alin. (5) si (6) ale art. XVI din Legea nr. 161/2003
privind unele masuri pentru asigurarea transparentei in exercitarea
demnitatilor publice, a functiilor publice si in mediul de afaceri, prevenirea
si sanctionarea coruptiei, cu modificarile si completarile ulterioare,
publicata in Monitorul Oficial al Romaniei, Partea I, nr. 279 din 21 aprilie
2003;
b) orice alte dispozitii contrare.
ART. 50
Anexele nr. I - V, Ia - Va si Ib - Vb*) fac parte integranta din prezenta
ordonanta.

Personalul prevazut in prezenta anexa beneficiaza si de sporurile prevazute

1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de

2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, republicata, cu

3. Personalul de executie din trezorerii beneficiaza de un spor pentru

NOTA:
1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de
salariile prevazute la punctele 1, 3 si 4 ale lit. B din prezenta anexa.
2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, republicata, cu
modificarile si completarile ulterioare, beneficiaza si de sporurile si alte

D. Sporuri specifice
Personalul prevazut in prezenta anexa beneficiaza si de sporurile prevazute
de dispozitiile legale in vigoare.
NOTA:
1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de
salariile prevazute la punctele 1, 3 si 4 ale lit. B din prezenta anexa.
2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, republicata, cu
modificarile ulterioare, beneficiaza si de sporurile si alte drepturi specifice
reglementate prin Statutul personalului vamal si alte dispozitii legale in
vigoare (personalul vamal care desfasoara activitati de control in cala de
marfuri a navelor si aeronavelor, compartimentele de marfuri si bagaje ale
mijloacelor de transport auto si de cale ferata, precum si in mesagerii la
coletele postale si la bagajele introduse sau scoase din tara, beneficiaza de
sporul pentru conditii deosebite).
3. Personalul de executie din trezorerii beneficiaza de un spor pentru
conditii deosebite de munca de 10% din salariul de baza.

D. Sporuri specifice
Personalul prevazut in prezenta anexa beneficiaza si de sporurile prevazute
de dispozitiile legale in vigoare.
NOTA:
1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de
salariile prevazute la punctele 1, 3 si 4 ale lit. B din prezenta anexa.
2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, republicata, cu
modificarile si completarile ulterioare, beneficiaza si de sporurile si alte
drepturi specifice reglementate prin Statutul personalului vamal si alte
dispozitii legale in vigoare.

D. Sporuri specifice
Personalul prevazut in prezenta anexa beneficiaza si de sporurile prevazute
de dispozitiile legale in vigoare.
NOTA:
1. Salariile de baza ale personalului vamal sunt mai mari cu 20% fata de
salariile prevazute la punctele 1, 3 si 4 ale lit. B din prezenta anexa.
2. Personalul vamal, echivalat potrivit Legii nr. 188/1999, republicata, cu
modificarile ulterioare, beneficiaza si de sporurile si alte drepturi specifice
reglementate prin Statutul personalului vamal si alte dispozitii legale in
vigoare (personalul vamal care desfasoara activitati de control in cala de
marfuri a navelor si aeronavelor, compartimentele de marfuri si bagaje ale
mijloacelor de transport auto si de cale ferata, precum si in mesagerii la
coletele postale si la bagajele introduse sau scoase din tara, beneficiaza de
sporul pentru conditii deosebite).
3. Personalul de executie din trezorerii beneficiaza de un spor pentru
conditii deosebite de munca de 10% din salariul de baza.
